Malicious prosecution. How many people who did actual rioting and burning in Portland and other cities that summer were prosecuted? Shame they are wasting time and resources on J6 "rioters" when so many actual criminals are still not charged -- like Biden and son or the 100's of Epstein Island visitors or Clintons or Pelosi, etc.

Sounds a bit over the top; but consider this. Dudley DoRight is sniffing like a bloodhound and the preliminary hearing is going to probably be like Lets make a deal. You know, where Monte Hall goes into the crowd and offers people in the audience 50 bucks for a egg, or 100 for a dry cleaning receipt, or a paperclip, etc. Make sure your "pockets are full" of details ready to pull out, no matter how weird of insignificant they seem. Every detail you provide can convince the jury the complete lunacy of making charges stick on your son. Law types thrive on details-be better at the job than they are.

Also, it needs to be nailed down where the trial (if it even goes that far) is held. Keep it local !!!! If they try to move it do DC, is your lawyer licensed to practice in DC if it ends up there? If not (likely) then put that forth in the court-your representation isn't licensed for DC and a change in venue will not give your son right to proper legal representation.

Remember, thrust and parry-just like a sword fight. If they "thrust" with "evidence" "parry" with facts. Win the fight.

And if you need help, please let us know. Keep your chin up, keep your son's chin up. Right will prevail.

We had a good evening with a lot of good friends, supportive friends. One got us a good lawyer and the lawyer knows this stuff well. We're documenting everything for him and they already told us the hearing will be in DC but it will be done on zoom. We haven't met with the lawyer yet but talked to them a few times. I feel pretty confident with him.

One of the friends we talked to tonight was a criminal justice and looked over the paperwork. They said the worse they could do to him was 5 years probation or 100 days house arrest. Probably some counseling thrown in because he doesn't have money so they'll milk his health insurance. What a racket. It's always about the money.

As far as the lawyer being licensed in DC, I believe he is. This case is the type of cases he handles. Can't imagine what the costs will be but the friend that got this lawyer for us told us they would work something out. Told us not to fret over it so we wait. Hopefully we will hear more tomorrow. I can honestly say I've never seen a lawyer or a small group of lawyers move as fast as they seem to be doing. This is good I think.

BTW, just heard the girlfriend has not been charged. They probably can't find her or they just have an ax to grind with us. I seem to attract these people, maybe from posting on here, I don't know. :(

Why would your son get counseling out of a possible (but not likely) conviction? That's just odd. Go into a building, get mental health counseling? Sorry but thats' just bizarre.

GLAD you have good representation. And he'd have to be licensed in the federal ..gov system to be able to conduct activity as a lawyer in the case. He's moving fast? Probably handling other similar cases. God knows the .gov is trying to wreck as many lives as they can. He's probably trying to make a name for himself in this type of case, which is a good thing. Being a "go to" lawyer for this type of case to others would be good for his practice and good to have available for others.

Use him to the best of his abilities. Don't be afraid to light his phone up any time you have a question-that's what he's being paid for. And if you need help with the bills, set up a go fund me page. I'm sure there's lots of people on here that would be happy to chip in. I certainly will.

Glad to see my rambling helps in some way. When I get into a situation I talk (or write) it out. I look crazy when I do it but it does help ID the problem, figure out responses and implement them. It helps.

Photographic evidence is all there is and it's false. The evidence was taken from CCTV and Body cam images.

Girlfriend was in two pictures in the hallway entrance. Son was in one of 9 of relevant evidence.
They are not together and she did not turn him in as far as we know. I talked to her parents.

Shaking tree hard, YES. The agent bringing the charges was the same agent who came to our home last year and tried to entrap my son putting words in his mouth and asking him to admit to it. I called him out on entrapment and he didn't like that. They left shortly after. A year later he presses charges. Must be a Trump hater.

Photoqraphic evidence is not evidence. It's relevant evidence only. They don't have a shot with their full faces. It's conjecture only on the part of this agent.

AlfaMan, you are an amazing guy. Thank you. I really have trouble with asking for financial help but the Lord knows we could use it. I still owe my own lawyer a grand that he is going to have to wait for. He sucked the life blood out of me since Jan 2021. I'm going to call the sons lawyer again today and see what we're looking at as far as costs. The reason they said some counseling may be required is because we don;'t have the money to pay these leeches. They can milk the medicare system if they get him going to counseling. He didn't have money for bail so that was what they offered him along with the probation officer.

When I know more on how we stand here, I will attempt a gofundme. I've never done anything like that before so I'm a bit leery but you encourage me. Thank you.

I'm not amazing. Just a regular Joe with a deep disgust of our current communist .gov. And an equal disgust of .gov fools making their promotions and attaboys using regular Americans' lives and livelihoods like toilet paper. Up here you see it every single day too.

It's the .gov and the little people these days. We live within walking distance of Mount Vernon, home/estate of Mount Vernon. George Washington's "great experiment" meaning democracy was a success for many years. These days it's in danger of going the way of the dodo bird.

And don't be afraid to set up a go fund me page-It's a perfect reason for doing it and a honestly necessary need. And I'm sure it will be a big help.

AMERICANS ARE BEING WRONGLY INCARCERATED​

Americans from across this great country find themselves as targets for prosecution by the Biden Justice Department for exercising their constitutional right to protest what they feared was the onset of governmental tyranny on January 6th, 2021. Because of their beliefs, they have been defamed and maligned by the Justice Department in charging documents and press releases for exercising their civil liberties. Some remain incarcerated primarily because they publicly avowed their beliefs in the traditions of conservatism and American values.



On February 24, 2023, David Mehaffie was sentenced to 14 months in custody to be followed by 24 months of supervised release -- which is federal "probation" that follows a custodial sentence. Mr. Mehaffie was convicted of "aiding and abetting" the impeding or interfering with officers after a bench trial in September 2022 before District Judge Trevor McFadden. He was acquitted by Judge McFadden on the charge of "corruptly obstructing" Congress in its certification of the electoral vote.

In its Sentencing Statement the DOJ asked for a 64 month sentence based on a quite dubious interpretation of the sentencing guidelines, arguing that Mr. Mehaffie's actions fell within the definition of "aggravated assault" in the sentencing guidelines. David's Attorney, William Shipley, pointed out in his Sentencing Statement and in his comments at the hearing that the Court had exonerated Mr. Mehaffie at trial of being involved in or intending to "assault" or injure police officers.

The distinction was critical because the answer to the question determined which provision of the United States Sentencing Guidelines would apply. The DOJ claimed that the "aggravating" factor was the finding by the Court that acted with the intent to commit another felony -- "civil disorder" -- as part of his conduct that interfered with the officers.

Shipley pointed out that the definition of "aggravated assault" began by describing it as a "felonious assault" that then has the added factor as argued by the DOJ. What the DOJ was lacking, however, was an "assault". Shipley made the argument that in reading his verdict in September, Judge McFadden seemed to choose his words very carefully in that he deliberately avoided using the word "assault" in describing Mr. Mehaffies' guilt, but rather emphasized that it was his "nonassaultive" behavior that nevertheless violated the statute with with he was charged.

Judge McFadden confirmed Shipley's view of the verdict, and agreed with Shipley's interpretation of the Sentencing Guidelines. Without a factual finding that Mr. Mehaffie had committed, or aided and abetted another in committing a "felonious assault", the provisions for "aggravated assault" did not apply.

Shipley had asked for a sentence of 6-12 months, with some or all of that term being served via "home confinement" which was allowable under the guidelines for such a sentence. Judge McFadden thought a longer sentence was appropriate given that Mr. Mehaffie's conduct caused more police officers to be needed in the "tunnel" where much violence occurred, thereby preventing them from going elsewhere in the Capitol where they might have been needed. He determined that 14 months was an appropriate sentence under all the facts of the case.

This is a good example of why having an experienced federal criminal defense attorney can made a significant difference in the outcome of the case -- for Mr. Mehaffie it was a difference of more than 4 years in custody. The DOJ wanted over 5 years in prison. The sentence imposed was just over 1 year.

Mr. Mehaffie will likely serve his sentence at a Bureau of Prisons "Camp" facility, and could be released to a "halfway house" in his home community to serve the remainder of his sentence after approximately 6 months.

J6: More and more video footage shows very sophisticated planning went into law enforcement’s effort to infiltrate the Capitol protesters to incite trespass, vandalism, and violence. Wristbands and barrel markings were coordinated between DC Police, Capitol Police, HSI, and FBI assets and agents.

On January 6, a US Capitol Police Officer detailed characteristics and identifiers of undercover officers infiltrating the crowd, “There’s a guy [inaudible] up here. Short guy, dark hair, black vest, Thin Blue Line uh thing on, dark hair and he’s got a little 27 or something on his hip. No police identification on him at at all. I couldn’t get to him because there was so many people.”

Officer 2: “White male?” O1: “White male, dark hair. Looked like a grayish-black maybe digital fatigue.”

Footage shot by a police officer at the infamous January 6th riot at the U.S. Capitol reveals him telling uniformed colleagues “we go undercover as Antifa in the crowd,” adding to the mountain of evidence that there was significant law enforcement presence among the protesters, as well as provocations from government operatives.

The short clip going viral on social media has been excerpted from a much longer recording uploaded to the Rumble video-sharing site, with the policeman making his comments to Capitol officers suffering the effects of pepper spray.

He then heads down to the barriers separating police and protesters – remaining on the police side of the barrier – and records scuffles from a distance for just short of an hour.
The news comes days after The National Pulse exclusively released clips from the Tucker Carlson interview with former Capitol Police Chief Steve Sund, which Fox News attempted to suppress. The interview, never released before The National Pulse provided it to the public, shows Sund calling the day’s events a “cover-up” as well as detailing the high level of undercover government agent activity in the crowd.

“It sounds like a number of the intelligence agencies had resources in the crowd,” Sund asserts, to which Carlson responds: “In the parlance of the internet, it was crawling with feds?”

“There was a fair amount of law enforcement in the crowd,” Sund replied.

Washington, DC/WTIC Radio - Another Connecticut resident has been arrested for his alleged part in the January 6 riot at the U.S. Capitol.

Prosecutors say Benjamin Cohen, 21, of Westport is facing felony charges of civil disorder and assault on officers.

He also faces disorderly conduct and other misdemeanor charges.

Video appears to show Cohen and other rioters pushing and shoving officers who formed a police line that day.

He's also seen entering the Capitol to join rioters, and was spotted on video in an office within the complex.

Cohen was arrested Wednesday in Westport and made his initial court appearance in court in D.C
