Elections Attorney David Shestokas: State Legislatures Have Plenary Power Over Elections – House and Senate May Decertify With Joint Resolution

The U.S. Constitution grants plenary power to the State Legislature to oversee elections and choose or withdraw their state’s electors.

Attorney David Shestokas, Hearing Officer for the Chicago Board of Elections was a member of President Trump’s legal team. He is an elections and constitutional expert with over 30 years of experience and multiple books published.

For more information about David and constitutional education, visit Shestokas.com

The Gateway Pundit’s Jordan Conradson spoke to David Shestokas to learn more about the constitution in regards to decertifying a fraudulent election.

It is possible and it will happen.

Conradson:
Now, you’re a constitutional expert and an elections expert, what is the role of the state legislature in elections, and what authority does the Constitution grant them?

Shestokas: The role of the state legislators, of course, the founding fathers wanted to put the control of elections as close to the people as possible. And so they set the rules, basically, to allow the state legislatures to pick the times, places, manners, and to regulate elections generally. But when it comes to the situation regarding the electors of the presidential choices of the Electoral College, The Constitution gives the states what they call plenary power. its one of the very few grants of plenary power within the Constitution and by that means the state legislatures have the authority by themselves without the participation of either the executive or the or the judiciary to, in fact, set the standards for choosing electors it’s in Article two, section one, and actually it’s easiest if I just read it directly because it says “each State shall appoint in such manner as the legislature thereof may direct a number of electors equal to the whole number of senators and representatives to which the state may be entitled in Congress.”

Conradson:
So the state legislature has plenary authority over the electors in their state, what will it take to decertify Arizona’s election?

Shestokas: You know I want to note a couple of days ago, Arizona State Senate President Karen Fann made some comments in response to some questions in an interview about the limits on the power of the Arizona Senate, and I might mention that for the most part 99% of what Senator Fann had to say was correct because when asked about a question about the recall of electors, she said well the Senate doesn’t have that power, she’s correct in that regard because who has the power is the legislature in which case it would be the House and Senate, acting in concert.

Senate President Karen Fann has been under fire for some recent comments where she said the Senate does not have the authority to recall electors.
She was correct and deserves credit for leading the nation with election integrity.

If laws were broken and this election was unconstitutional, the Arizona Senate can make referrals to the U.S Attorney and Arizona Attorney Generals to make the necessary prosecutions.

If this election is proven to be fraudulent, the Arizona Legislature will need to recognize this and proceed to decertify the election through a joint resolution in both the State House and State Senate.

State Legislatures have plenary, or absolute authority to recall electors.
This is the case for all states in the union. Arizona will set the precedent.

The Arizona Senate and House must stand up for voting rights and we must hold them accountable.

RUMBLINGS: 2 of 3 Retired Policemen Drop From Wisconsin Speaker Vos’s Audit Team – Vos Refuses to Call for a Forensic Audit in Wisconsin

By Joe Hoft

Wisconsin’s Republican Speaker of the House continues to refuse a real forensic audit in the state. Now 2 of 3 policemen Vos selected for an audit of the state have reportedly resigned.

Wisconsin’s Speaker Vos has continueS to pretend he cares about election integrity while showing he does not. He’s taken numerous actions to indicate he knows the Wisconsin 2020 Presidential election was fraudulent. But he shows he doesn’t want to get to the truth by responding with actions that will never catch the fraud in the election in his state.

Last week we learned why.

1626898435136.png

Now we have learned that two of the three retired policemen that Vos selected to perform an audit of the election in the state have resigned. For some reason, Vos is keeping this on the down-low.

All that the Speaker has to do is order a forensic audit of the state’s 2020 Election results and the people in his state will know that he made an effort to get to the bottom of the fraud in the state. But Vos can’t do this. He is owned by his friends from the past.

Now Oklahoma: State Rep. Sean Roberts Requests Forensic Election Audit in Three Oklahoma Counties

By Joe Hoft

Oklahoma-Rep-Sean-Roberts.jpg

State Representative Sean Roberts is requesting a forensic audit in three counties in Oklahoma.

State Representative Sean Roberts has made a request for the state to forensically audit three counties in the state.

Oklahoma Representative calls for audits earlier this month.
Oklahoma State Representative Sean Roberts, R-Hominy, announced on Tuesday that he is requesting the State Election Board Secretary call for a “forensic and independent audit” of the 2020 general elections in Oklahoma County and two other random counties in the state.

“Every citizen deserves to have faith in the integrity of the election process and its outcome,” Roberts said in a letter sent to the Election Board secretary. “It is my responsibility, as an elected public servant, to assure my constituents that Oklahoma’s elections are safe and secure.”
This selection appears very similar to the request made by the Senate in Pennsylvania. There the audit covers Philidelphia, the hotbed for election fraud in the US for years, and two other smaller Pennsylvania counties.

In Oklahoma, Representative Roberts is asking for an audit of Oklahoma county, where Oklahoma City is located, and two other counties.

This is the time to get our elections right. Those who call for the forensic audits will be heralded in the future and given credit for cleaning up our corrupt election systems around the country.

BREAKING EXCLUSIVE: Five Counties in Michigan Will Likely Break the Law and a Cease and Desist Order by Erasing 2020 Election Data from Their Voting Machines

By Joe Hoft
Published July 21, 2021 at 9:22am

Five Michigan counties are allegedly moving ahead with guidance from the state that is likely to erase all activities on the voting machines in the county. A Cease and Desist order was mailed to the counties but these few counties may move forward anyways.

At least five counties in Michigan are reportedly moving ahead with the destruction of data from the 2020 Election on the voting equipment they used in the election. The problem with this is that the procedure that the vendor is performing reportedly removes all data from the machines but federal law states that information related to the 2020 Election is to be maintained in safekeeping for 22 months after the election. Also, all the counties in the state have been provided a ‘cease and desist’ order preventing them from removing the data from the machines.

1626899012028.png

According to Kagbro88 on Twitter, at least five counties have said they are moving ahead with the request from the state to remove the batteries in the machines which would also remove all memory from the machines.

Midland and Manistee Counties are two of the counties moving forward with the state’s request.

1626899109469.png1626899177182.png
Lake County says they are waiting for their attorney’s opinion while Dickinson is moving ahead with the ‘maintenance’.

1626899219552.png1626899278173.png

Iron County is planning on going ahead with the state’s request as well.

1626899317319.png
These counties are risking a lot due to their actions. Removing batteries from their machines will likely erase data that is residing on the machines and the law requires all data to be kept intact for 22 months after the election. Also, removing the battery will make the machines out of compliance and they will have to be recertified as a result.

House Speaker Nancy Pelosi on Wednesday rejected two of McCarthy’s Republican picks for her highly partisan January 6 committee.

Earlier this week GOP House Leader Kevin McCarthy released his pics for Pelosi’s sham Jan. 6 select committee:

The five included:

  • Jim Banks (ranking member)
  • Jim Jordan
  • Rodney Davis
  • Kelly Armstrong
  • Troy Nehls
Pelosi rejected GOP Reps. Jim Jordan (OH) and Jim Banks (IN), both strong allies of Trump.

The RINOs McCarthy chose are safe from the chopping block.

According to Forbes:

Rep. Rodney Davis (R-Ill.), the chair of the House Administration Committee and a relative moderate in his caucus who was one of 35 House Republicans to vote to create a bipartisan commission to probe the attack, which was blocked by Senate Republicans.

Rep. Kelly Armstrong (R-N.D.), one of seven House Republicans who signed a letter criticizing objections to President Joe Biden’s electoral college victory, which a majority of House Republicans voted for even after the Jan. 6 attack.
Pelosi also chose RINO Trump hater Liz Cheney to be on her sham committee.

GOP Minority Leader Kevin McCarthy on Wednesday pulled all five of his Republican members from Pelosi’s partisan January 6 committee after the Speaker vetoed his appointment of Reps. Jordan and Banks.

House Speaker Nancy Pelosi on Wednesday rejected two of McCarthy’s Republican picks for her highly partisan January 6 committee.

Reps. Jim Jordan (OH) and Jim Banks (IN), both strong allies of Trump.
“With respect for the integrity of the investigation, with an insistence on the truth and with concern about statements made and actions taken by these Members, I must reject the recommendations of Representatives Banks and Jordan to the Select Committee,” Pelosi said. “The unprecedented nature of January 6th demands this unprecedented decision.”

Earlier this week GOP House Leader Kevin McCarthy released his pics for Pelosi’s sham Jan. 6 select committee:

The five included:
  • Jim Banks (ranking member)
  • Jim Jordan
  • Rodney Davis
  • Kelly Armstrong
  • Troy Nehls
McCarthy responded by pulling all five Republicans and said Pelosi was abusing her power.

“Speaker Nancy Pelosi has taken the unprecedented step of denying the minority party’s picks for the Select Committee on January 6. This represents an egregious abuse of power and will irreparably damage this institution. Denying the voices of members who have served in the military and law enforcement, as well as leaders of standing committees, has made it undeniable that this panel has lost all legitimacy and credibility and shows the Speaker is more interested in playing politics than seeking the truth,” McCarthy said in a statement.'

“Unless Speaker Pelosi reverses course and seats all five Republican nominees, Republicans will not be party to their sham process and will instead pursue our own investigation of the facts,” McCarthy added.

Rep. Jim Jordan (R-OH) said Wednesday that House Speaker Nancy Pelosi (D-CA) “admitted the obvious” after she rejected two of House Minority Leader Kevin McCarthy’s five Republican recommendations for the select January 6 committee.

“Speaker Pelosi just admitted the obvious, that the January 6th Select Committee is nothing more than a partisan political charade,” Jordan wrote in a tweet, including an article detailing her rejection.

Along with Jordan, Pelosi also rejected McCarthy’s recommendation of Rep. Jim Banks (R-IN).

“Monday evening, the Minority Leader recommended 5 Members to serve on the Select Committee,” Pelosi said in a statement. “I have spoken with him this morning about the objections raised about Representatives Jim Banks and Jim Jordan and the impact their appointments may have on the integrity of the investigation.”

“I also informed him that I was prepared to appoint Representatives Rodney Davis, Kelly Armstrong and Troy Nehls, and requested that he recommend two other Members,” she added.

According to Pelosi, the rejections were made out of “respect for the integrity of the investigation, with an insistence on the truth and with concern about statements made and actions taken by these Members.”

Earlier this month, Pelosi appointed Rep. Liz Cheney (R-WY), a longtime critic of former President Donald Trump, to the select committee. Cheney is one of twelve Republican representatives who voted to impeach Trump twice.

House Speaker Nancy Pelosi (D-CA), after announcing she will reject Republican Reps. Jim Jordan (OH) and Jim Banks (IN) from the January 6 Select Committee, said it would proceed if there is bipartisanship.

Infamous CNN reporter Manu Raju asked Pelosi if she had any concerns about the Republicans being pulled from the committee after denying Jordan and Banks a seat. She said, “We have a bipartisan quorum we can proceed.”

The speaker was pressed on why she would not allow Jordan and Banks a seat on the committee but would allow Republican Rep. Troy Nehls (WI) since he also voted not to certify the election. Pelosi dodged the questions and said those votes were not part of the criteria.

“That was not the criterion as I told you yesterday,” Pelosi said.

The Zuckerberg-funded Center for Tech and Civic Life (CTCL) and other nonprofits have been part of ongoing investigations and legislative hearings in Wisconsin. CTCL gave $6 million in grant money, much of which went to support vote-by-mail and early voting efforts, to 5 major metropolitan areas of Wisconsin.

Attorney Erick Kaardal represents clients through his own firm and The Amistad Project. The Wisconsin Voters Alliance (WVA) filed a complaint against CTCL with the Wisconsin Elections Commission (WEC). Since the five largest recipients of CTCL grants—Green Bay, Kenosha, Madison, Milwaukee, and Racine—are considered to have demographics that lean Democrat, the complaint argues that the grants violate Wisconsin laws against funds that influence the outcome of an election.

Kaardal, also associated with the Thomas More Society, went on War Room with Steve Bannon to discuss CTCL involvement in Wisconsin, describing a “privately funded, government-administered plan” to target votes:

“They were targeting minorities, low-income people, and they were targeting certain geographies. That’s all Unconstitutional.”

Rumble video on website 9:34 min

Wisconsin has a Republican-controlled legislature that has put forward numerous potential reforms of election law that might reduce the potential for fraud in future elections. However, its Democrat governor will most likely veto anything election reform related. Further, Donald Trump has criticized Republican leadership in Wisconsin who might otherwise push for reform, naming Robin Vos, Chris Kapenga, and Devin LeMahieu as among those “working hard to cover up election corruption in Wisconsin” and “actively trying to prevent a Forensic Audit of the election results.”

A review of election complaints like the one against CTCL is part of an audit supervised by the state auditor. That audit is not expected to be completed until the fall 2021. From Kaardal’s perspective, complaints like his have not attracted due attention from Republican leadership. As to why Kaardal told Bannon:

“The reason why it’s taken a while for… the establishment Republicans to catch up… is because the left is so sophisticated with all these non-profits… that this was so carefully calibrated to exploit a vulnerability in our system… that it takes a lot of… education, a lot of looking at it to figure it out.”

Kaardal gave his thoughts on the citizens’ solution and then on the legal solution:

“So the people have to declare that they are the leaders in a populist moment. My clients in each of these five cities said, ‘we’re taking charge, our election officials can’t violate the U.S. Constitution, they can’t violate the state statutes anymore’. So this is just a perfect example of the people rising. You’ve got to trust the courts because we’re fighting a battle over our culture, our democracy—and if we lose the courts, we’re lost—we’re not protected from prosecutors, we’re not protected from civil lawsuits by the government. So we have to trust the courts.”

Kaardal seemed to be optimistic about his side’s chances:

“We’ve got them dead to rights. I think we’re gonna prevail in this one because the left put down everything in writing…”

As to the big picture, Kaardal remarked:

“I think the people on our side are just far too trusting of the government. The government is basically the problem that needs to be solved. The government doesn’t represent the people anymore.”

Keshel and Clements: Biden Had an Estimated 675,000 fraudulent Votes in Texas – The Actual Vote was Likely a 55% – 43% for Trump

By Jim Hoft
Published July 21, 2021 at 8:31pm

The Texas heat map:
Red – Rampant Fraud
Yellow – Likely/Suspect Fraud
Green – Clean/Low Fraud

Dr. David Clements and Seth Keshel togethere are analyzing the election data from every US state and creating a strategy for those interested in an individualized forensic audit plan for each state.

On Wednesday the two experts looked at the state of Texas.

Via The Professor’s Record: Texas Quartermaster Audit Packet

Captain Seth Keshel’s observations:

President Trump defeated Joe Biden 52% to 46.5% in Texas in 2020.
Trump
– 5,890,347 (52.1%)
Biden – 5,259,126 (46.5%)

Dr. Keshel estimated there were 675,000 excess votes for Biden, conservatively estimated, in the 2020 election. Biden was up 1.38 million votes from Hillary Clinton, with Trump also up at a record number 1.21 million votes from 2016.

No party reg, heavy on 20-year pattern plus political trend. Trump trended Hispanic vote in Texas heavily Republican, but somehow “lost” Tarrant County and lost big margins in suburbs despite huge ~30% gains or more in all of them. Dem activity is obvious, many suburbs over 60% growth, huge urbans over 40%.

Put simply, massive Trump gains in San Antonio, Fort Worth, and Houston don’t agree historically with a corresponding massive Dem jump in those counties.
If accurate on the 675,000 excess vote, the Trump margin should have been roughly 55.4 to 43.1 (12.3%) with a margin of 1.3mm votes instead of 631k.

Best audit targets (RED) – Tarrant, Collin, Denton, Wichita, Taylor, Bell

Pennsylvania Democrat Acting Secretary of State Decertifies Election Machines After Software Audit

By Joe Hoft
Published July 21, 2021 at 9:44pm
Veronica-Daffenberg.jpg

The Democrat Acting Secretary of State has decertified the voting machines in a small county in the state after a recent audit was performed.
In February the Pennsylvania Secretary of State Kathy Boockver resigned following the 2020 Election.

1626927860503.png

Bookver was replaced with Veronica Degraffenreid. Ms. Degraffenreid recently issued a directive preventing county elections boards from cooperating with Senate Elections audits. However, as Senator Mastriano noted when announcing the audit, his committee has the absolute legal right to this data.

As set forth in Pennsylvania Senate Rule 14 (d), each standing committee is empowered with the authority to inspect and investigate the books, records, papers, documents, data, operation, and physical plant of any public agency in this Commonwealth, including county boards of elections.

The United States Constitution Article 1, Section 4, Clause 1 invests the power over federal elections in state legislatures:
The Times, Places and Manner of holding Elections for Senators and Representatives, shall be prescribed in each State by the Legislature thereof; but the Congress may at any time by Law make or alter such Regulations, except as to the Places of chusing Senators.
Senator Mastriano shared that he is empowered to conduct and lead a forensic investigation in the Commonwealth of Pennsylvania.

Rumble video on website 1:15 min

But Pennsylvania Democrats don’t care about election laws. This was made clear during the 2020 Election. Today the Acting Secretary of State made it clear as to what she will do whenever a Senate auditor looks at a voting machine. She will render the machines uncertified. It doesn’t matter if copies of the machine data are copied and the machines protected from any changes as a result of the copy, she’ll still find the machines inoperable.
Pennsylvania’s top election official has decertified the voting machines of a small southern county that disclosed that it had agreed to requests by local Republican lawmakers and allowed a software firm to inspect the machines as part of an “audit” after the 2020 presidential election.

The action by Acting Secretary of State Veronica Degraffenreid almost certainly means that Fulton County will have to buy new voting machines or, as it did in the May primary election, lease new ones.
The Democrats will continue to do all they can to stop any audits of the fraudulent results that were certified from the 2020 Election.

[COMMENT: Amend her budget to pay for replacement machines for those she decertifies, taken from her existing budget bottom line.]

Arizona attorney general receives records on 'potential violations' of election laws

by Kaelan Deese, Breaking News Reporter |
| July 21, 2021 06:54 PM

Arizona Attorney General Mark Brnovich received records related to "potential violations" of the state's election laws.

A letter from Democratic Secretary of State Katie Hobbs's office — which was sent on Tuesday in response to the Republican attorney general's request on July 14 asking for "any and all records … related to potential violations of Arizona’s election laws" — states the documents are partly related to a "pressure" campaign by former President Donald Trump's allies regarding the 2020 election aimed at officials in Maricopa County, where a partisan audit is underway.

"Reporting by the Arizona Republic detailed a number of troubling communications from Arizona Republican Party Chairwoman Kelli Ward and others that were directed at members of the Maricopa County Board of Supervisors," wrote State Elections Director Sambo Dul.

Some of the communication attempts "appear to evidence a violation of" Arizona's election laws, Dul added.'

Jennifer Wright, Brnovich's assistant attorney general, requested Hobbs to provide "any information from your office regarding potential double voting in the 2018 or 2020 election." Dul stressed Hobbs is still awaiting a report from the Election Registration Information Center regarding possible instances of people voting twice in the November election.

A campaign finance complaint Hobbs's office received in April regarding State Rep. Mark Finchem and the Make Arizona Precincts Sound Committee was also mentioned in Dul's letter.

Finchem's "efforts to allegedly pay off his debts" related to an election fraud hearing the Republican helped arrange at the Downtown Phoenix Hyatt in November, which included then-Trump personal lawyer Rudy Giuliani, raised questions about the sources of funding.

The Washington Examiner contacted the offices of Brnovich and Finchem, who announced in late March he is running for election for the Arizona secretary of state, regarding Dul but did not immediately receive a response.

So far, four cases of election fraud have been discovered and met with criminal charges in Arizona, two involving Democratic voters and two involving Republican voters. There are fewer than 200 cases of possible voter fraud among the more than 3 million ballots cast in the 2020 contest in Arizona, according to an Associated Press report.

Trump has kept a careful eye on Arizona since the election, recently stoking attention among his following the audit in Maricopa County would find evidence to support his claims of widespread fraud during the general election.

The Arizona Senate hired contractors, led by Cyber Ninjas, to conduct the audit, and a comprehensive report is expected in the coming months. Audit officials revealed more election materials are needed from Maricopa County to submit a complete report.

Senate President Karen Fann has said the audit is not about Trump's election and is intended to revive confidence in the county's election system.

Brnovich shot back at criticism from the U.S. Justice Department of the Arizona Senate's audit of the 2020 election in Maricopa County.

“Arizona will not sit back and let the Biden administration abuse its authority, refuse to uphold laws, or attempt to commandeer our state's sovereignty," Brnovich said in June.

This after she and others at the RNC bilked a couple of hundred million dollars of donations from Trump supporters who thought that money was going to be used by the RNC on election-related lawsuits and other actions. Funny how not a single RNC lawyer was involved in any of the post-election lawsuits on behalf of President Trump, and the likes of McDaniel, Mitch McConnell (RINO-KY), and other “top Republicans” have been silent about election fraud even after the AZ senate hearing that dropped bombshells last week.

McDaniel’s GOP establishmentarian bent didn’t just materialize during her stint at the RNC. Lest we forget, the Michigan GOP is “the house that Ronna McDaniel built.” Before being rewarded for “delivering Michigan” to President Trump in 2016 in her elevation as Republican National Committee chairwoman, McDaniel was the Michigan state GOP chairman, and as such imprinted her moderate stamp on the Party (a chip off her grandfather and former 3-term governor George Romney, who was tagged in this piece as “The Lone Liberal Republican”).

Moderates dominate GOP politics in Michigan. That would explain many of them refusing to give adequate review and follow-up to the forensic analysis conducted in Antrim County showing evidence of manipulation of vote tabulation machines and external access to election management systems, as excerpted from this 17 May article:
[Lawyer Matt] DePerno announced that Lenberg found this weekend, per Exhibit 17, a significant “subset of the critical deficiencies in the security of the electronic voting systems used in Antrim County, Michigan for the November 3, 2020 election.” Exhibit 17 also notes that “password enforcement policies on the EMS are substandard, they even allow the users to set purposefully ‘weak’ passwords as a feature.”

One of the critical deficiencies highlighted by DePerno is the ability of the election workers “to set the time on a tabulator at any time in order to print paper tapes that show the appropriate date/time stamp. The technician/supervisor password enables the workers to have this capability.” This is a significant issue because an election worker can potentially run extra ballots without detection “outside of the election window or after hours” to create ballots to produce a desired number of votes.

It seems the DePerno team has also found “duplicate matching ballot indexes.” DePerno stated, “It gets worse, people. Based on a review of the Antrim County results, it indicates duplicate matching ballot indexes—which is evidence of ballot stuffing and fraud.” While they are still studying the evidence, he explained that “this means there were ballots fed into the system more than once—repeatedly.” This issue showed up in the Antrim County election to the tune of 1,060 potential fraudulent phantom votes that showed up in the hand recount according to DePerno and do not match the records held by Secretary of State Benson.

One would think that DePerno’s forensic evidence would have instigated an investigation by the Republican-dominated Michigan Senate Oversight Committee. Instead, Sen. Ed McBroom, chairman of the committee, issued a summary report on “The November 2020 Election in Michigan,” claiming in the Executive Summary, “This Committee found no evidence of widespread or systematic fraud in Michigan’s prosecution of the 2020 election.” That statement is false, not only due to DePerno’s evidence, but also from independent analyses conducted since Election Day, including this one completed on 27 November with these conclusions:
1) There are some major statistical aberrations in the MI voting records, that are extremely unlikely to occur in a normal (i.e., un-manipulated) setting.
2) The appearance of software manipulation is most troubling.
3) The anomalies almost exclusively happened with the Biden votes. By comparison, the Trump votes looked statistically normal.
4) Nine (out of 83) Michigan counties stood out from all the rest. These counties showed distinctive signs of voting abnormalities — again, all for Biden.
5) The total number of Michigan suspicious votes is 200,000± — which exceeds the reported margin of Biden votes over Trump. See the next page for an outline of the the several analyses and our conclusion of how many suspicious votes there are.
6) These statistical analyses do not prove fraud, but rather provide scientific evidence that the reported results are highly unlikely to be an accurate reflection of how Michigan citizens voted. [Proof can only be conclusive through a full forensic audit.]
That is by no means all. Here is an excerpt from an election night county-by-county analysis of voter registration trends in Michigan by Seth Keshel that provides ample rationale for a state-wide audit. Recommend reading the entire analysis report here.
The consistent characteristic in the shift in Michigan’s political landscape is the declining Democratic Party raw vote totals, and the increasing Republican totals. Thus far, according to the Decision Desk unofficial vote tally, President Trump is substantially adding to his vote totals in every Michigan County, while his opponent adds votes at a greater percentage, often in counties that have trended steadily away from Democrats since at least 2008.

All counties showing two consecutive cycles of inverse party trend (Republican up twice, Democrat down twice), with Democrats substantially up this year, may be subject to counting errors, or “glitches,” like those reported in Antrim County. These voting machines and their associated software should be audited and examined by coding professionals, especially if the recent newsworthy events regarding corrupted voting software are widespread.

The entire vote in Michigan is suspect against historical trends and should be subject to recanvass and audit, not just a recount of hundreds of thousands of illegal ballots. It appears that the major case in the state is that in spite of substantially growing his vote share in strong-Trump counties, and surging in votes in urban and suburban counties, Trump’s margin is substantially limited, even after two consecutive inverse party trends. In urban or suburban areas, Democratic vote share is soaring to record numbers, even over Obama’s totals after a 16.44% win, all while Trump surges in votes in those counties as well. Urban areas have issues with transparency and should be fully audited for mail and absentee fraud.

But Sen. Ed McBroom didn’t stop with his ridiculous letter; he subsequently asked Dana Nessel, the Democrat AG in Michigan, to “investigate allegations that unnamed individuals are making false claims about the 2020 election for personal profit.” One wonders what is motivating him since most people support audits, and there is ample rationale to conduct one in Michigan. Where is the harm in conducting an audit – except to Democrats if fraud is confirmed or to Republicans if none is found?

Is McBroom making common cause with Soros Democrats in Michigan?

Democrat Secretary of State Jocelyn Benson, who has been fighting Deperno about the Antrim County findings, piled on about Nessel’s investigation:
Benson said her office looked forward to partnering with Nessel “on this critical investigation into the real fraud that took place in 2020: efforts to deceive Michigan citizens about their vote with misleading, false statements about the accuracy & integrity of our elections.”
Here is DePerno’s response to the Nessel-Benson investigation; it’s the kind of response that rank-in-file Republicans in Michigan might have expected from McBroom and other of their RINO state legislators (this means you, Sen. Mike Shirkey, among others):
Dana Nessel is a lawless Marxist. She is trying to stop our investigation into election fraud. She is also opposing counsel in the case Bailey v Antrim County and Jocelyn Benson. She is now using the power of the police state and her to actively investigate opposing counsel. This is unethical, unconstitutional, and criminal (see MCL 750.505). Dana Nessel must resign immediately for her unethical conduct.
And here are excerpts from a response to McBroom’s letter by former Michigan Representative Patrick Colbeck (R):
  • The report consistently repeats the flawed assertion that the integrity of the election can be demonstrated simply by running ballots through the tabulator. Using their logic, if the tabulation yields the same results as the tape printouts from election day, then all is good. No wonder they equate recounting ballots with an audit. Anyone who understands how elections are conducted, however, knows that the integrity of any election is dependent upon much, much more than a successful tabulation of the ballots at hand. In order to demonstrate the integrity of an election, it is critical that the chain of custody for election materials is maintained. That is why it is a federal felony to destroy election records within 22 months of an election. Yet, the report asserts that insisting that election officials demonstrate that the chain of custody has been secured is “incredibly misleading, demeaning, and irresponsible.” I would assert that the exact opposite of this is true. Fraudulent voters in the Qualified Voter File result in fraudulent voters in Poll Books. Fraudulent voters in Poll Books results in fraudulent ballots being issued.
Fraudulent ballots being issued results in fraudulent election results. Not a difficult concept to grasp for most reasonable observers. Demonstration of the integrity of the chain of custody is an important factor in the call by citizens for a forensic audit. The report’s dismissal of the importance of the chain of custody demonstrates why the pursuit of a forensic audit has been dismissed by members of the Michigan Senate. Their failure to understand the importance of the chain of custody is a serious issue.
  • The Committee appears to be operating under an extremely unique definition of “election fraud” that dismissed any evidence of fraud if it did not add up to the 154,188 votes promoted as the margin of victory for Joe Biden. This failure of reasoning dismisses the cumulative effect of breaches in the chain of custody and violations of existing statute.
The rest of Colbeck’s exhaustive response is broken down into comparing “the big lie” from the McBroom report versus “the big truth” in the following categories:
  • Deceased and Non-Residents Voting
  • Unsolicited Absentee Voter Ballot and Application Mass Mailings
  • 3rd Party/Private Funds Used for Public Election Activities and Equipment
  • Rights and Duties of Poll Challengers/Watchers Improperly and Unlawfully Restricted
  • Antrim County Results
  • Operating Issues with Tabulators and Precinct Computers
  • Signature Verification Process
  • Jurisdictions Reporting More Than 100% Voter Turnout
  • Absentee Ballots Tabulated Multiple Times
  • Thousands of Ballots “Dumped” at the TCF Center on Election Night/The Next Morning
  • Vote Totals Abnormal Compared to Past Presidential Election and Other Vote Count Irregularities
  • Other Irregularities
  • Additional Issues
  • Audits
Think that is enough to both debunk McBroom’s report and to warrant a full forensic audit in Michigan? There is even more! Here’s an excerpt from an affidavit from Wayne County precinct supervisor and whistleblower Keith Kaminski showing that there were indeed write-in votes that were never included (or were falsely adjudicated) in Precinct 374 in Detroit:

Stu3.png

According to the official results, there were ZERO write-in votes for that precinct. It is also pretty strange that Biden got 95% of the votes in that district. This table is for the entire city of Detroit. There were no write-in votes for any and all races in the Detroit results. That means adjudication was not being used (as Kaminsky realized after the election).

Stu4.png

Retired senior DoD analyst Ray Blehar recently provided some additional justification for conducting a forensic audit in Michigan. Here are a few excerpts from his findings:
  • The official results also show that NO WRITE-IN votes were recorded for any of the contests held in the November 2020 election. This is smoking gun evidence of an Election Management System (EMS) failure in the City of Detroit.
  • It is possible that all write-ins were coded on the ballot definition file assigned to Biden because he got an incredible 95% of the vote. For example, let’s say Biden is assigned a numerical ID of 75 on the Detroit ballot. The Detroit ballot would then have also assigned number 75 to every write-in slot in every race in the election. That would cause every write-in vote to bypass adjudication and be directly assigned to Biden.
  • [The McBroom} report repeats the false statements that the Antrim County, Michigan vote switching problem was caused by “human error.” Three different forensic audits, including that of the Michigan SOS, refuted the “human error” argument and instead attributed the vote shifts to the voting systems. The Michigan SOS forensic audit (aka, Halderman), the Allied Security Operations Group(ASOG) audit, and a review by expert Jeffrey Lenberg confirm that votes were wrongly shifted in the election due to software issues.
  • The official election results transmission from Michigan reveals that a vote spike of 149,772 total votes — 135,290 or 95% of them for Biden and 5,968 votes (4%) for Trump — occurred approximately 3 hours after the delivery of votes (6:30 AM) on November 4, 2021. This is the single most anomalous data point in the 2020 election.
  • McBroom tried to down play the size of the 3am vote dump, alleging it may have been 16k according to one election official while others said it was 30-45k ballots in size. The Edison results show it was 149,772 with Biden getting 96%. McBroom was completely obfuscating the significance of this anomalous vote dump.
  • The Non-Trump/Biden (aka Write-In, Minor Party or WIMP) vote of 2,546 is over half of Trump’s total of 5,968 votes in the dump. That too is a suspicious result.
Blehar concludes: “[the McBroom report] wasn’t attempting to find out the facts about the 2020 election – they were using false information in order to sweep the massive voting fraud in Detroit and elsewhere in Michigan under the rug.”

And the big question is why because there are more than enough reasons to justify a full forensic audit in Michigan! Some serious accountability is required for at least a few elected Republicans, not to mention the likes of Democrats Gretchen Whitmer, Jocelyn Benson, and Dana Nessel.

Over to you, Michiganders, for more grassroots pressure and action…
The end.

———————————-

The following is a statement from Mr. Gerald Buglione taken on Monday July 19th 2021. The statement was conducted via telephone. Mr Buglione resides in Surprise Arizona, the undersigned was in New Jersey.

Q) Mr. Buglione, where do you currently reside?

A) Surprise Arizona

Q) Mr. Buglione can you state your professional work experience

A) I was a Newark Police Officer for 28 years. I started in 1986 and retired June 1 2014 with the rank of Lieutenant

Q) Can you tell me your assignments as a member of the Newark Police Department?

A) From 1991 to 1997 I was a Detective in the narcotics unit. From 1997 to 2000 I was a Detective in the intelligence unit. 2000 to 2001 I was a police sergeant.

From 2001 until 2006 I was Detective Lieutenant. I supervised a detective unit investigating aggravated assaults, thefts and burglaries . In 2006 I was promoted to Lieutenant and supervised a detective unit investigation citizen complaints .I also supervised special operations with the DEA, Customs and Postal Service, I did this from 2006 to 2007. When I was then transferred to the narcotics and gang squad. Here we did long term narcotics and gang investigations, gathered intelligence . I was using our intelligence to work with the Essex and Hudson County Homicide task force which I was also assigned to. Where I retired from on June 1 2014 with 28 years of service.

Q) After you retired did you continue to work?

A) Yes ,I worked for Global Mark Security from 2016 to 2019 doing armed security, threat assessment and investigation.

Q) Since you have moved to Arizona, have you continued to work? and where?

A) I worked security for Wigwam Resort, Litchfield Arizona from January 2020 until the end of November 2020, I was furloughed for the month of July.

Q) In your role of security officer for the resort did you come across a situation that you thought unusual? and can you explain what occurred ?

A) Yes I did, In September 0f 2020 a company called Fieldworks LLC rented 2 ballrooms for six weeks preceding the 2020 presidential election, as part of my duties I was to check on and secure all hotel facilities and ballrooms, when I went to the two ballrooms rented by Fieldworks LLC I was denied access. I was told by Fieldworks workers I was not allowed in . I question them as to why, as I was resort security and that was our job to safeguard all property and possessions, I was given a stern answer that I was not allowed in the two ballrooms. I found this strange because security had always had access to every location ,as these were big money high end ballrooms. I asked them what they are there for and again they refused to answer stating I was not allowed in. Security was never denied access to the ballrooms by any other entity. Even Vice President Mike Pence had utilized these ballrooms and the Secret Service submitted an itinerary and co ordinated with hotel security.

Q) What did you do next?

A) I went to check for the itinerary for contact information, this is hotel standard procedure, I was unable to find the itinerary. Fieldworks had either not given one to the hotel or was hiding it.I asked some of the other security personnel if they knew where it was, No one did. I went to my boss and asked him what this was all about all he told me was they were a political group and he didn’t know anything else.

Q) What happened during the course of Fieldworks time at the resort?

A) During my rounds I noticed there was a sign up ,they were hiring people to work for $21 an hour, I asked some of the other resort workers about this and I was told they were recruiting workers for voter registration. During their time there I observed people constantly moving in and out of the ballrooms and they were moving boxes back and forth in and out. The ballrooms were filled with computers and workers and boxes of voting ballots. One day there was a Federal express package at the desk for them and I delivered it to the ballroom, no one was at the door so I went in looking for someone, when I went into the ballroom with the package I saw voting ballots loaded in bins, the room was filled with them. I was then approached by a Fieldworks worked and they told me I was not allowed to be in there. I told them I was bringing them a package. They took the package and told me to leave. These were the same boxes that they were wheeling in and out the whole time, I then found out that they were hiring workers from Arizona to drive to Georgia and work there. Also the Fieldworks group was working strange hours, coming in extra early and parking with immunity, not following any of the rules, I went to the Director of Security and asked him about this group and the activities that were going on and he ignored me. I asked some of the other resort workers about them and was met with silence ,no one wanted to talk or get involved.

Q)What were feelings based on these observations ?

A) Based on my experience in investigations and what I knew about the presidential election I believed this was election fraud and ballot harvesting.

Q) What else did you do?

A) I made a phone call to Congresswoman Debbie Lasko , she is the congresswoman for Surprise Arizona. I wanted to forward the information to her.

I spoke to a staffer who was not interested in what I had to say, the staffer told me the Congresswoman or someone would get back to me but they never did. I then placed a phone call to Stan Fitzgerald because I knew he was working on the Georgia election and forwarded the information I had to him

Q) You said based on your experience in the field of investigations that you think this was ballot harvesting and election fraud. Can you tell me have you ever testified in court?

A) Yes

Q) Have you ever testified as an expert witness in court?

A) Yes

Q) Approximately how many times?

A) I’ve testified hundreds of times as an expert witness I’ve testified in Federal, State, and Municipal court all as an expert witness in police criminal investigations

Q) Can you state some of your training in the field of investigations.

A) I attended the following courses during the course of my career that pertained to investigations, plus I participated as a detective and supervised as a Sgt and Lt. thousands of investigations

Bergen Co. NJ Police Academy Drug Enforcement Administration, Basic Drug Education National Intelligence Academy-Electronic Surveillance/Covert Operations Ft. Lauderdale, FL. Q) Has everything you told me the truth

A) Yes it is

Q) Thank you Statement of Mr Gerald Buglione concluded at this time

WPolitics reported the following in January of this year:

Runbeck Election Services has a website where they affirm:
Since 1972, Runbeck Election Services has preserved the integrity of the American democratic process. We partner with cities, counties and states to provide a trusted election experience with ballot print and mail services, and equipment and software technology solutions that are accurate, transparent and efficient.

Rey Valenzuela, the Director of Elections for Maricopa County Arizona is listed on the front page of Runbeck’s website. He provides the one and only testimony of Runbeck where he shares:

Runbeck Elections is a subject matter expert on the process. They are always involved and want to know more. Runbeck is reliant as a partner, not a vendor; their competence helps them identify issues before they become an issue.

Having the Director of Elections for Maricopa County Arizona as your reference is not a good thing; it clearly indicates connections to corrupt election activities.

Although not listed as a member of the Executive Team, Brian Runbeck identifies himself as the Client Services Manager/Project Manager and Production Coordinator at Runbeck Election Services.

He manages the production of election ballots and related official election material. He says he handles high-pressure deadlines and high volume production.

Mr. Runbeck also made 50 different donations to Act Blue, Biden for President, and the Democratic Senatorial Campaign Committee between August 15 and October 30, 2020:
Fieldworks was investigated in PA in 2016 for voter fraud reported WPVI TV as shown below:
————————

MEDIA, Pa. (WPVI) — The issue of voter fraud has become part of the political conversation this year, with complaints and warnings coming primarily from the Republican side of the coin.

Thursday morning, Congressman Patrick Meehan called for United States Attorney General Loretta Lynch to launch an investigation of FieldWorks LLC.
FieldWorks bills itself as a Democratic Grassroots organization.

State Police raided its Delaware County office earlier this week, looking for evidence of voter registration fraud.

Meehan and other local Republicans question whether roughly 7,000 registrations were submitted by the Oct. 11 deadline and other irregularities.

“What do you do about the 52 registrations in which there’s no valid address? It’s not that there’s no valid address. There’s an address listed. There’s just no such location in Delaware County,” said Meehan.

FieldWorks denied any wrongdoing in a statement to Action News, and said it’s cooperating with investigators.
Witnesses will also present testimony of alleged election fraud in ballot harvesting in GA.

Background- Target company is Fieldworks LLC , a Democrat operative organization whose Delaware County office was raided by the PA state police in 2016 seeking evidence of voter registration fraud. In December 2020 their website was offering employment in GA for what we allege was ballot curing in the upcoming Senate run off on Jan 5th. Curing of course is not illegal but in GA the state has specific laws and procedures, none of which include third parties going to homes and handling the ballots – at that point it becomes criminal harvesting. GA requires cured ballots to be mailed back by the voter prior to the election or they must vote in person on election day. The November election was plagued with harvesting in GA , in fact David Litt of the Biden campaign itself boldly tweeted on November 4th at 5:32pm — “Anyone in Georgia? Team Joe needs people to go door to door helping voters fix their mail in ballots so they count. Sign up! “ The problem is based on my understanding of Georgia law there is no way these ballots could be mailed in the special secured cured envelopes so the voters were supposed to vote in person making the tweet from the Biden campaign a criminal conspiracy to commit ballot harvesting.

ELECTION INTEGRITY
North Carolina State Board of Election Denies Audit Request

BY MATT MCGREGOR
July 21, 2021 Updated: July 21, 2021

Citing overriding federal authority under the Cyber and Infrastructure Security Agency (CISA), the North Carolina Board of Elections (BOE) has denied a North Carolina House Freedom Caucus (HFC) request to examine voting machines.

Chairman of the caucus, Rep. Keith Kidwell (R-Beaufort), told The Epoch Times that although there is a statute that requires state employees to comply with requests for data from the North Carolina General Assembly, Karen Brinson Bell, executive director of the elections board, declined the request to inspect voting equipment used in the November 2020 election in a July 7 letter.

During a July 15 press conference, Kidwell said the HFC had been responding to public concern regarding transparency in the election process.

Before the denial, the HFC met with the BOE twice, and Kidwell added that Elections Systems & Software (ES&S), the largest election vendor for North Carolina, agreed to provide access to three voting systems it manufactures.

At the time, ES&S indicated that they would be willing to take any inspected system at a randomly selected precinct by the HFC and recertify the equipment so that there would be no cost to the BOE or county, Kidwell said.

ES&S, he said, “seemed eager” to have the inspection to relieve the public concerns about the equipment.

“We would not invade, compromise, or damage the machines,” Kidwell said in the press conference. “The only thing that would happen is the ES&S service technician would open, show us and allow us to see that there are no modems in the machines.”

According to Bell, in her statement to the HFC, neither ES&S nor the machines manufactured by Hart InterCivic (Hart) have modems, which are prohibited by state law.

After speaking with ES&S officials, Bell said in the statement that “they [ES&S] were unaware of any commitment by the company to take any accessed machines back to their headquarters for recertification.”

ES&S didn’t respond immediately to The Epoch Times in request for a statement.

Critical Infrastructure
CISA, a division of the Department of Homeland Security, classifies voting equipment as “critical infrastructure,” Bell said.

She included a letter from Geoff Hale, director of the Election Security Initiative (ESI) at CISA, in which he said “allowing unknown, unauthorized, or inexpert actors” to access the machines could risk damage and manipulation, which would compromise the security of the equipment.

Bell said that the BOE would not “partake in, nor perpetuate, myths and falsehoods about voting systems or elections.”

Kidwell said he wouldn’t classify members of the General Assembly as “unknown, unauthorized, or inexpert actors.”

The goal of the HFC is to show the public that voting equipment is not a problem, Kidwell said.

“I want to point out that first, we seek transparency in the election process,” Kidwell said. “The North Carolina House Freedom Caucus believes that every legal vote should be counted, but not a single illegal vote should be counted.”

The HFC has made no false or “misleading statements about the machines, processes, or staff,” Kidwell said.

“In fact, we have sent out press releases and made social media post that clearly stated we thought—from what we had seen to date—our system did not have modems, and appeared to be secure,” Kidwell said.

Up until the statement from Bell, Kidwell said the HFC had been “impressed by the cooperation” from the BOE.

“Now we’ve hit a wall,” Kidwell said in the press conference. “That wall—they’re seemingly hiding behind. Miss Bell, tear down that wall, unless you have something to hide.”

The BOE told The Epoch Times that it’s not aware of a statute that allows a member of the General Assembly access to voting machines.

Because county boards of elections are legally responsible for the voting equipment, access must be restricted to prevent tampering, said the BOE.

North Carolina General Statute 120-19 states that “all officers, agents, agencies and departments of the State are required to give any committee of either house of the General Assembly, or any committee or commission whose funds are appropriated or transferred to the General Assembly or to the Legislative Services Commission for disbursement, upon request, all information and all data within their possession, or ascertainable from their records.”

“Here is the key,” Kidwell said. “This requirement is mandatory.”

Kidwell added that, at this point, he’s not asking for a “full-blown audit,” which is what took place in Arizona when Florida-based tech firm Cyber Ninjas performed a months-long forensic audit.

Last week, Arizona’s GOP-led state Senate held a hearing in which Cyber Ninja CEO Doug Logan spoke, telling senators that, among other discrepancies, auditors could find no record of the county sending more than 74,000 mail-in ballots.

After the hearing, some Republicans called for Arizona’s 11 electors—who went for Biden—to be recalled, to which Arizona Senate President Karen Fann, a Republican, said that the state Senate can’t recall electors.

Correction: A statement from Bell was misattributed to Hale. The Epoch Times regrets the error.

SHARPIE-GATE EXPLAINED: It Now Appears Sharpies Were Provided in Certain Precincts to Disqualify Trump Votes in 2020 Election (VIDEO)

By Joe Hoft
Published July 22, 2021 at 7:20am

In the days immediately following the election, the sharpie-gate story was created. Democrats and the media made fun of it and called it a conspiracy theory.

Now we know the entire story was valid and massive fraud may have occurred in the 2020 Election because of voters using sharpies to vote.

On November 5th, a few days after the investigation, the sharpie-gate fraud was uncovered.
1626988100846.png

However, sharpie-gate was missing factual information regarding what happened and the technology to determine what was the impact in the election.

Then this past week, the Arizona Senate released information on sharpie-gate where they unraveled how it worked.

1626988060084.png

Then we found out that sharpies were used across the country.

1626988013142.png

Last night we uncovered the rationale for why sharpies were used in the election and how this likely impacted thousands of votes for President Trump.

Below is a video that was shared last night in the interview with Jovan Pulitzer regarding sharpie-gate.

Rumble video on website 2:13 min

Sharpie-gate was not a conspiracy. It was one tactic amongst many that were used to steal the election away from President Trump.

The Arizona audit is performing its final phase of a 3rd recount to recheck the accuracy of ballot totals, AGAIN.

This process does not tabulate votes. It only counts the total number of ballots.

They are auditing their own numbers now in preparation for a historic legal battle.

The Gateway Pundit reported that stacks of ballots are aligned in the paper jogger then counted twice with the paper counting machine.
1626988532574.png

Randy Pullen told TGP that a batch of ballots is counted then compared to the hand-count sheet for that batch. If the numbers agree, then it is accurate.

If the machine gives a different number, the batch is rotated so that another corner may be counted to ensure an accurate total is produced.

They are counting each batch of roughly 200 ballots at a time. A batch takes less than a minute to analyze. A box of about seven batches takes less than five minutes to count. There are over 30 boxes on each pallet.

AZAudit.org Livestream: July 21, 11:54 PM

17 pallets have been completely recounted and volunteers started two more during the night shift which ends at 12 AM.

Audit officials spent days calibrating the machines and conducting test counts before using them. These machines have been certified to be accurate.

The Gateway Pundit reported that, according to Steve Bannon, former Chief Strategist for President Trump, the Arizona audit numbers are holding up in this final hand recount taking place this week at the counting center.
1626988628782.png

Randy Pullen said that we can expect this phase of the audit to be completed by next Wednesday.

What is next?

Pullen:
If there is a difference in the count, there is going to have to be more analysis of the CVR (cast vote record).
What about the subpoenas?

We still need answers for the anomalies and discrepancies presented by audit officials at last week’s Senate hearing.

1626988681941.png

Who ran a script that produced 37,646 queries looking for blank passwords on a system with only eight user accounts?

Subpoenas for the routers, passwords, and Splunk logs, needed to complete the forensic analysis and answer the questions have been ignored.

The county refuses to cooperate with this investigation. Instead, they tweet jabs and unsubstantiated claims.

1626988743406.png

We already know that the certified total was not accurate.
What else are they hiding?

On Tuesday, Arizona State Senator Wendy Rogers said, “We have to hold the Maricopa County Board of Supervisors accountable to include possibly sending them to jail.”

1626988809017.png

Is this the next step when we discover a significant delta in the number of certified ballots versus actual ballots?

Will the Senate use this evidence to arrest the County Supervisors, hold them in contempt, and issue a criminal subpoena?

This wasn’t an accident or a mistake. It was a pattern of criminal activity and the cover-up is worse than the crime.

This is the crime of the century.

We need to trust our elections if America is to survive.

Elections Assistance Commission (EAC) Is Being Sued for Secretly Permitting Internet Access on Election Machines

By Joe Hoft

EAC-Stands-For-1.jpg

In a strange series of events, the Elections Assistance Commission (EAC) is being sued for updating its policy and allowing voting machines to include Internet access. These policy changes were discussed in private with voting machine companies and silently passed by the EAC without required public debate.

EAC

We’ve reported on the EAC before. Earlier this year we reported that the EAC approved the certification for two audit firms within four hours of TGP reporting that the firms were not certified.

1626989231649.png

We’ve asked what processes did the EAC go through to update these individuals’ credentials and re-certify them within 4 hours of our article being published noting that they weren’t certified.

Philip Stark

Philip Stark has a checkered past. He resigned from Verified Voting which would suggest he is a good guy.

1626989308430.png

Philip Stark is also a Board member of the EAC and was also in the news lately when he was selected to be one of three ‘auditors’ selected for the New Hampshire audit. We reported the following on Stark.
It appears very likely that the course of this audit has been quietly steered by top Democratic leadership in the U.S. Congress, House Speaker Nancy Pelosi (D) and Senate Majority Leader Chuck Schumer (D), through the auditors themselves. Both Philip Stark, Ph.D. and Barbara Simons, Ph.D., the board chair of Verified Voting and also a member of George Soros’ elite Democracy Alliance Board, are current appointees to the corrupt and powerful U.S. Election Assistance Commission (EAC).

Stark was appointed by Speaker Pelosi in 2016 and Simons was appointed by former Senate Minority Leader Harry Reid (D) in 2008 and was re-affirmed by then-Senate Minority now Majority Leader Schumer.
1626989431302.png

Stark made an early exit in New Hampshire never to be seen again. It’s not known how much time and effort he supplied to the audit and what he was paid for being an auditor in name only. Nor is it known why he left.

1626989479307.png

But now Stark is back in the news. This time he is suing the EAC, where he is a Board member. Stark and the organization, Free Speech for People, are suing the EAC for updating voting machine guidelines that allow them to have access to the Internet.

EAC-Policy-Changes-2.jpg

The complaint also shares that the EAC passed the new guidelines after holding secret meetings with the voting machine manufacturers. Then the EAC passed updated guidelines which allow the voting machine companies to include Internet access in their machines.

Below is the entire case.

The EAC does not seem like an agency full of integrity especially now after secretly updating the guidelines to allow voting machines to have Internet access.

“We Are Leading the Charge Here in Arizona to Say Decertification Should Happen” – State Sen. Wendy Rogers on The War Room (Video)

By Jim Hoft

senator-rogers-bannon-wendy.jpg

Arizona state Senator Wendy Rogers joined Steve Bannon on The War Room on Thursday morning to discuss the latest developments in the historic audit of the 2020 ballots.

Senator Rogers says decertification should happen in the state of Arizona based on what was already discovered.

Sen. Wendy Rogers: We have doubt now and we have confirmation that the data points we did turn in were not accurate. I would love it if it spread to Pima and Pinal and one of my own four counties, Coconino… These are the type of things that for Bret Baier to say there is nothing here is not credible…

Steve Bannon: …Maricopa County has basically said now we’ve given you everything we’ve got, or we’ve given you everything we’re going to give you and you’re just going to have to embrace the suck. So what say you, Senator Rogers? What are you guys prepared to do next?

Sen. Wendy Rogers: Well, we have to absolutely follow through. And we’re not just accepting that as an answer… Maricopa still needs to hand over 40% of the machines and the routers. The company still has the passwords. We are doing everything we can to coalesce support among ourselves… We are not accepting their answer… I think every county that has had these machines and every state should be audited because they’re absolutely suspect.

Why Did Georgia Mail Out 7 Million Absentee Ballots in 2020 Election When that Was the Number of Registered Voters in the State?

Why did Georgia mail out 7 million ballots in the 2020 Election when that was the number of registered voters in the state?

Has anyone asked Georgia Secretary of State Brad Raffensperger how the state could mail out over 7 million ballots in the 2020 Election and will it happen again?

We reported in December how the results in Georgia made no sense. Clearly, the results were tainted.

1626990319863.png

Also, to date, there are reportedly over 300,000 ballots included in the 2020 Election results in Georgia that have no attached legally required chain of custody documentation.

1626990256465.png

But today we can report that the state sent out 7 million absentee ballots in the 2020 Election in the state.

The number of ballots mailed out in the state of Georgia was over 7 million. This comes from the Georgia 2020 Cares report on item 12 page 5 where the state claims over 7 million absentee ballots were prepared and mailed out in the 2020 Primary Election. The assumption is that this number was the same only a few months later in the general election in November.

GA 2020 CARES Financial and Progress Report by Jim Hoft on Scribd (Scribd. Doc on website)
1626990179051.png

CBS in April 2021 claimed there were 7.4 million voters in Georgia.

Every voter in Georgia reportedly received an absentee ballot in the 2020 Election. This left the statewide open for voter fraud which we know happened.

The new law passed earlier this year will now prevent the state from sending every voter an absentee ballot.

The more you look into Georgia, the more suspect the results of the 2020 Election become.

Update – originally we reported only 5.4 million voters in Georgia were registered based on a report. However, per a reader, we determined that the Secretary of State’s website shows a little more than 7 million registered auditors in the state.

President Donald Trump released a statement Thursday ripping Arizona’s most disgraceful State Senator.

Paul Boyer recently cosponsored a resolution to hold the Maricopa County Board of Supervisors in contempt then later killed the resolution after getting cold feet.

1626990744275.png

Arizona State Senators are now calling for decertification of this fraudulent election and based on past attempts to derail this process, Boyer can’t be trusted.

President Trump released the following statement regarding RINO Boyer’s obstruction of justice.
Statement by Donald J. Trump, 45th President of the United States of America
Republican Arizona State Senator Paul Boyer, a RINO if there ever was one, is doing everything in his power to hold up the damning Forensic Audit of Maricopa County which has been taking place over the last 90 days. The people of Arizona are demanding it. Boyer has been nothing but trouble, and nobody knows why. All we demand is Voter Integrity!
He is being primaried by a strong and highly respected challenger, former Arizona State Representative Anthony Kern.

What is Boyer hiding? What or who changed his mind?

We’ve seen his true colors.

Paul Boyer also recently killed critical election integrity bills in the Arizona Senate along with RINO Michelle Ugenti Rita.

Boyer and Ugenti Rita have failed their constituents.

We must hold them accountable.

Pennsylvania Decertifies County's Voting System, Cites Violation Of Election Code

THURSDAY, JUL 22, 2021 - 09:25 AM
Authored by Mimi Nguyen Ly via The Epoch Times,

Pennsylvania’s top election official has decertified the voting system of rural Fulton County for future elections, saying that an election assessment by a third party had violated the Keystone State’s election code, according to a release on Wednesday.

Acting Secretary of State Veronica Degraffenreid, an appointee of Democratic Gov. Tom Wolf, informed the Fulton County Board of Elections that she “did not arrive at this decision lightly.”

Wake Technology Services Inc. (Wake TSI), a software company based in West Chester, Pennsylvania, had carried out an election assessment that involved its workers visiting Fulton County in December 2020 and in early February.

The company in May released a report that concluded the election was “well-run” and did not indicate any signs of fraud in Fulton County. However, five “issues of note” were uncovered, three of which are related to Dominion Voting Systems, whose electronic voting system was used in the county for the 2020 election.
“While these may seem minor, the impact on an election can be huge,” Wake TSI said of the five issues. At the time, Dominion disputed the report’s findings.
The Pennsylvania Department of State said in a statement on Wednesday that Wake TSI’s access to the Fulton County’s voting system “undermined the chain of custody requirements and strict access limitations necessary to prevent both intentional and inadvertent tampering with electronic voting systems.”

It added that the “unauthorized access” prevents the vendor—Dominion—from “affirming that the system continues to meet state and federal certification standards.”

Fulton county officials had allowed Wake TSI to “access certain key components of its certified system, including the county’s election database, results files, and Windows systems logs,” and to “use a system imaging tool to take complete hard drive images of these computers and other digital equipment,” the department noted.
“These actions were taken in a manner that was not transparent,” Degraffenreid said in her letter to Fulton County officials on Tuesday. She said the access given to Wake TSI has caused Fulton County’s voting system to be “compromised,” and that neither the county, state officials, nor Dominion could now “verify that the impacted components of Fulton County’s leased voting system are safe to use in future elections.”
“I have no other choice but to decertify the use of Fulton County’s leased Dominion Democracy Suite 5.5A voting system last used in the November 2020 election,” Degraffenreid wrote.
The Fulton County Board of Elections and Wake TSI did not immediately respond to requests for comment.

The Pennsylvania Department of State previously said that a risk-limiting audit of the 2020 election has confirmed the state’s election results.

The Pennsylvania Capital-Star reported that Fulton County needed to pay $25,000 to lease new equipment for its municipal elections in May, because Dominion refused to let the county use the voting machines that Wake TSI had accessed. According to the outlet, Dominion told the county that it violated its contract in letting a unaccredited and non-certified company inspect the machines.

Wake TSI’s assessment in Fulton County was “set” by Pennsylvania Sen. Doug Mastriano, a Republican, according to a Dec. 31, 2020 document signed by the company that was obtained and published by the Arizona Mirror and The Washington Post. Wake TSI said in its report that Mastriano and Pennsylvania Sen. Judy Ward, also a Republican, “were aware of our efforts.”

The document also said that Wake TSI was “contracted to Defending the Republic,” a nonprofit founded by lawyer Sidney Powell, who has alleged that widespread fraud occurred in the 2020 election.

Mastriano earlier this month issued letters to York, Tioga, and Philadelphia counties requesting that they voluntarily submit information and materials by July 31, to enable what he calls a “forensic investigation” of the 2020 and 2021 elections. He told The Epoch Times that he seeks for an investigation that would be “a big deep dive, like we saw in Arizona, but even deeper.”

Wake TSI was also involved in the election audit still underway in Arizona’s Maricopa County up until its contract expired in May. The audit in Maricopa County was ordered by the Arizona state Senate’s Republican majority. Dominion machines in Maricopa County will also be replaced.

Arizona Senate President Karen Fann, a Republican, said the machines were not tampered with during the audit and questioned the Board of Supervisors’ decision to get new machines.

“If their experts can’t prove the machines have not been tampered with, then how does the [Secretary of State’s office] or County Elections certify the machines before every audit to make sure the machines haven’t been tampered with?” she asked in June.

Establishment Congressional Members Are For Sale, And China Is Happy To Buy

beijing-opera-1160109_1920.jpg

The Legacy of the United States of America

The course of history is a rising, falling, twisting, and turning road. It is rather easy to look back and determine which roads may have been a superior route to travel. At the time, things had a rather different perspective. Man is a slothful little animal despite all propaganda to the contrary. This reality has left us with quite a few “what ifs” on the rearview radar.

In the final analysis, the Second Law of Thermodynamics boils down to this: a closed system deteriorates into nothing, while an open system does deteriorate but it becomes larger and more complex while deteriorating. The ending is equivalent, but the journey is quite a bit different. Influencing other systems and people is the only measurable effect on our lives and beliefs.

The meetings in Philadelphia among the wealthy, well-educated class of colonists was a unique situation in the course of 2,000 years. (I am leaving out Iceland.) The colonies were wealthy while London was poor, as the wealth had been spent propping up North America during the French Colonial wars. Was London justified in wanting Virginia and South Carolina and Massachusetts to send money? Of course.

Unfortunately, the usual English arrogance overwhelmed common sense in governing their possessions. The usual clowns were in the political drivers’ seat.

“Give me the money now” was the continuing speech of the government. A few wise men realized that the situation was significantly different from the Gordon Riots or some foolish James the XX wanting his throne returned. A political situation that could have been easily resolved became a world-shaking event to the detriment of Britain.

This decision relegated Britain to a jealous observer role after “two long lifetimes.” W. Churchill. Other regional empires have come and gone since 1776 but none has approached the significance of the United States. The only enemies we have are the international political and banking maggots that have infested our governmental halls since Woody Wilson.

The entire western ideology of government has been based on domination by a financial conclave of self-appointed Wise Men. The result of these machinations is rather simple to envision, Thermodynamics wins again! Continuously dissolving is our governmental and physical fate. A few will benefit but certainly not a majority.

Our civilization is confronting a stagnant primitive cultural behemoth that has existed for millennia. China’s culture has not developed in thousands of years. The basis of today’s rapidly evolving governmental and technical society is adaptability. We have little, the Chinese have less. Their monarchical government only allows for the adaptation of ideas which can be easily remolded into old forms. Their pictograph form of written communication alone requires adaptation of English to transmit new ideas.

This requires immersion with Western barbarians to assimilate technological developments. It is humiliating for the Mandarin. This point needs to be emphasized. We are the inferior help that needs to be controlled in the view of the Chinese government. They believe that the scum we have in the government represents our best citizens. Why shouldn’t they? The DC group is easily purchased help.

Our accelerating self-destruction is an interesting situation. While it is understandable that the banking class wishes to expand their power as always, it appears that their usual alliance and financial support programs will backfire.

The Chinese do not need help long-term and are logically operating along the margins to further their own programs. It is difficult to believe that this is not obvious on Wall Street.

The Belt and Road program is expanding into the Balkans and other eastern European lands. This is agenda approaching the heart of the old international financial system. The EU acceptance mystifies me.

The last battle zone is the U.S. Congress. For generations, buying D.C. influence has been the program. Initially it was just another source of income for the members. However the international socialists began to enter the White House directly under Woody Wilson. This changed the dynamic as true believers came to the fore and were able to push the debt based Federal Reserve system through. We have been suffering ever since.

Now with the Chinese money battling for a piece of the action, the equation has changed. The new international situation requires extensive intellectual abilities to adapt to the accelerating deterioration schedules we are experiencing.

Unfortunately, we have vague intellectual requirements for positions in these areas. How many students transfer from political science to the physics department?

The global disruption of the ultimate world currency, food, always involves unforeseen reactions. It is easy to determine the stage of unrest. After three days without food, I am quite irritable and hungry, and I am less interested in diversity and racial oppression than I am in a peanut butter and jelly sandwich.

Quite a few countries have had food riots in the past few weeks.

Who is going to provide the stabilizing hand on the tiller to right the global ship? I hope the US Navy Chief of Staff does not have one of his lady friends’ hand on the wheel. We have seen diversity killing sailors already. This little lady was screaming “my career” as she was led from the bridge.

They’ve Done This Before: Five Past Cases of FBI Incitement
June 21, 2021 (note 1 month ago)

2021.06.22-12.01-revolvernews-60d1286bb6d06.jpg

Last week, Revolver highlighted the disturbing number of key figures in the January 6 Capitol incident who have gone unnamed and unindicted even as the number of criminal cases federal officials have brought spirals into the hundreds. Read it here if you’ve been living under a rock.

By now, it is a distinct possibility that many participants in the January 6 “riot” were associated with the government in some manner, be it as informants or full-blown agents.

America’s regime media is deeply committed to the narrative of January 6 as a planned “insurrection,” so they have flailed desperately to debunk reporting by Revolver as well as Fox’s “Tucker Carlson Tonight.” Twitter’s “neutral” “aggregators” made a cringeworthy clarification that only further bolstered Revolver’s claims.

Revolver will continue to report out the story of the Capitol incident and the federal government’s potential role in instigating it. But there is another reason to suspect federal involvement in January 6: The federal government has a decades-long history of this exact behavior. Revolver has already reported extensively on the phony “plot” against Gretchen Whitmer in Michigan, where five out of eighteen core plotters were actually connected to the federal government. But there are countless additional incidents, all over the country, stretching all the way back to the 1950s.

Long article, read the rest here: They've Done This Before: Five Past Cases of FBI Incitement - Revolver

The FBI Is Out of Control, The Light of Truth Will Destroy This Darkness

By Larry Johnson
Published July 22, 2021 at 9:11pm
944907EA-49DA-4253-8963-6FA8A071F418.jpeg

I used to respect the FBI. When I worked at the State Department’s Office of Counter Terrorism, I was one of two officers who handled liaison with the FBI on its investigation of the 1988 terrorist bombing of Pan Am 103. My supervisor and I sent out the cables to our Embassies requesting permission for FBI Agents to go to those countries to collect evidence and pursue leads. Ambassador Morris Busby, who headed up the Office of the Coordinator for Counter Terrorism (it is now known as the Bureau for Counter Terrorism) in 1990 put me in charge of advertising the Terrorism Rewards Program and I developed the public service ads, with the help of Diplomatic Security, that launched “Are You the Next Hero?”

In the process of developing these ads I coordinated closely with the FBI, including the Deputy Director of the FBI. The advertising campaign, which launched in August 1990, played an important role in leading to the capture of the terrorist who planned and executed the bombing of the World Trade Center in 1993 (Diplomatic Security officers Brad Smith and Mike Parks provided critical assistance in implementing this program).

I participated in the training of the Foreign Emergency Support Team (aka FEST), which put me in regular contact with the FBI members of that team. The men and women I worked with were apolitical patriots. That was then.

Today’s FBI is a nightmare. They have turned the FBI into a political force akin to the East German Stasi and the Nazi’s Gestapo. Instead of protecting American citizens they are spying on patriots and launching groundless cases, such as the bullshit charges brought against DEA Agent Mark Ibrahim:
Drug Enforcement Administration Special Agent Mark Ibrahim became the first member of federal law enforcement to be charged in connection with the insurrection at the Capitol on Jan. 6.
Ibrahim, of Orange County, California, is facing felony charges of entering a restricted building and area with a weapon, carrying a firearm on the grounds of the Capitol and lying to investigators from the Office of the Inspector General.

While the affidavit states Ibrahim didn’t actually enter the Capitol building, the affidavit includes a photo of Ibrahim inside the first set of fencing and barricades that surrounded the Capitol before the crowd broke through and alleges Ibrahim was on Capitol grounds that day.
Not only did Ibrahim not enter the Capitol, he was there with his brother, who is an FBI Agent. But he also was there with a “friend” who, it turns out, was an FBI informant. That FBI informant was encouraging Ibrahim to go inside. Ibrahim did not. But the fact that he did not incite violence or engage in any act of violence is ignored by the ironically named U.S. Department of Justice. They want to make an example of him.

Tucker Carlson interviewed Ibrahim and his attorney on tonight’s show (July 22). The video is not yet posted but it is worth your time.

Ibrahim is not alone, as most readers of The Gateway Pundit know. There are hundreds of Americans that have been unjustly arrested and jailed for the act of walking into the Capitol. They attacked no officers. They destroyed no property. They carried no weapons. But they were infiltrated by FBI informants who were inciting people who were angry, legitimately so, over a stolen election and the failure of our pathetic justice system to hold Antifa and Black Lives Matter terrorists to account.

Most thoughtful Americans recognize the appalling double standard that is being applied. If we look back through history, however, this is not the first time that the FBI has tried to subvert a patriot. Just look back at what they tried to do to Martin Luther King. They tried to paint him as an agent of the Soviets. But Martin Luther King was not trying to destroy America. Notwithstanding his shortcomings as a man, he was fundamentally committed to peacefully challenging a system of racial oppression put in place by Democrat politicians.

His profound insights still resonate to this day–he wanted a country that would judge people according to the content of their character rather than the color of their skin.

I will make this very simple. Do not trust the FBI. Do not help the FBI. Do not cooperate with the FBI. If you must talk with someone from the FBI only do so with an attorney present.

There are still some good men and women in the FBI who are patriots. But the leadership is corrupt. If you are involved in organizing to peacefully resist this oppression be cautious of any member of your group who is encouraging you to act unlawfully.

What happened in the alleged plot to kidnap Michigan’s lame Governor is not an aberration. The majority involved in that scheme were FBI assets who took an active role in encouraging and planning the kidnapping.

FBI Agent Richard Trask is the new poster boy for FBI miscreants:
FBI Special Agent Richard Trask, 39, of Kalamazoo, was charged Monday with assault with intent to do great bodily harm, less than murder following an incident Sunday. (Instagram)

An FBI agent at the center of the investigation into the plot to kidnap and kill Gov. Gretchen Whitmer is accused of smashing his wife’s head against a nightstand and choking her after a dispute stemming from their attendance at a swingers’ party, according to court records.

Special Agent Richard Trask, 39, of Kalamazoo, was charged Monday with assault with intent to do great bodily harm, less than murder following the alleged incident Sunday.

An affidavit filed by the Kalamazoo County Sheriff’s Office in Kalamazoo County District Court said Trask’s wife had bloody lacerations to the right side of her head and “blood all over chest, clothing arms and hand,” as well as “severe” bruising to her neck and throat.

She told police she and her husband had several drinks at a swingers’ party held at a hotel in the 2700 block of S. 11 Street in Oshtemo Township, just west of Kalamazoo, according to the affidavit. She added that she did not like the party and they argued about it on the way home.
Think about this–an FBI Agent beat his wife up because she didn’t want to have sex with other men. To my friends who are retired from the FBI I know you are heartsick about what happened to an organization you once loved and respected. It is up to you to reach out to your friends and sons and daughters who have followed in your footsteps. Whistleblowers need to step forward. The only want to destroy this darkness is with the power of light.

  • SharpieGate resurfaces with a historical review of archived posts from the Maricopa County Recorder. On October 26, 2020, guidance for the use of Sharpies changed, and voters were instructed to use Sharpie markers to fill out their ballots.
  • Voting machines and ballots were changed for the Democratic Presidential Preference Election in March 2020. The equipment and ballots were used in all ensuing elections. The equipment and ballots were changed, in part, so that voters could use Sharpies that are “fast drying.” YET, the guidance discouraging the use of Sharpies stayed in place until October 26.
  • SB1135 was put in place in February of 2020 to authorize new tabulating equipment and to set guidance for ballot duplication procedures.
  • Kelly Dixon wrote an email to staff on October 22, 2020, instructing them to have voters use “ballpoint pens instead of markers between 10/23 and 11/2. In that same email, Dixon told clerks and voters that they NEED to use Sharpies on Election Day.
Much has resurfaced about the use of Sharpies pens in Arizona’s Maricopa County November election. Research into various archived pages on the Maricopa County Recorder website shows different versions of guidance on the use of Sharpies on ballots. Also resurfacing are the changes in the paper ballots and machines that were installed in March of 2020 for the Democratic Presidential Preference Election.

A deep dive into archived links on the Maricopa County Recorder website has exposed a bigger story concerning Sharpie-Gate, especially in the context of the July 15, Arizona Senate Forensic Audit Hearing.

UncoverDC has put together a timeline to clarify and organize the available information relating to guidance on Sharpies. Official statements and emails by Maricopa County officials from October of 2018 well into 2021 concerning the paper used and recommended writing implements for marking the ballots are all reviewed in order of their occurrence.

Timeline:
October 22, 2018
  • Maricopa County Recorder, Adrian Fontes, was made aware of issues with Sharpies and his 5-page letter to the Board of Supervisors in 2018 mentioned the issue. A hand count of 100,000 ballots was initiated due to the use of Sharpies. Excerpt below:
Screen-Shot-2021-07-20-at-12.35.12.png

Adrian Fontes October 22, 2018 letter

April 8, 2019
  • Adrian Fontes continues to talk about the need to fill out ballots with a black or blue ink pen. “Do not use marker or Sharpie as they tend to bleed through and will damage your ballot.
February 3, 2020
  • SB1135 elections and electronic adjudication bill passed Feb. 3, 2020, and signed by Governor Ducey, “if the emergency clause is enacted.”
The reason emergency clause is put in bills is that key legislators deem it to be that important” per UncoverDC’s discussion on Tuesday with Arizona Rep. Mark Finchem. He summarizes the significance of the emergency clause below:

“There are 60 members in the house total and 30 members in the Senate total. In order for the emergency clause to apply 45, members of the House and 20 members of the Senate must vote in the affirmative for the bill. Otherwise, the bill can pass, with a simple majority but not take effect until 90 days after sine die. If it passes both chambers, the emergency clause prevails, taking effect immediately upon signature of Governor. If only simple majority passes bill, it takes effect 90 days after sine die.”

The bill provides specific guidelines for the electronic vote adjudication feature in the tabulation of ballots. It also provides specific procedures for duplication of ballots in the adjudication process, requiring serialization, logging of the ballots, and sound retention policies for both the original and the digital duplicate of the ballot:

Fontes Says Cross Out Mistakes

Crossing out mistakes is a chain-of-custody issue. When a voter crosses out a mistake instead of destroying the ballot and obtaining a new one, it leaves open the possibility of another person marking the ballot later, for example, during adjudication.

Voters were allowed to cross out mistakes in the August election, according to AZCentral.

“Do I need a special pen to mark my ballot?”
A standard black or blue ballpoint pen is sufficient. Do not use red ink or permanent marker. This may result in a false read by our ballot tabulation machines.”

September 19, 2020
  • Adrian Fontes is still arguing to cross out mistakes, saying it is “perfectly legal.”
  • In early September, “the Supreme Court ruled the county must not issue any instructions on how to correct a ballot. Instead, they must point voters to pick up a new ballot,” abc15 reported.
  • Fontes pushes back:
“If you do make a mistake on your ballot, and you send it to our office, we know how to deal with it. We have instructions not only in law but in the procedures manual on how to deal with it. I was ordered to give a different instruction, but that doesn’t change the fact that what I just said it’s perfectly legal.”
  • As Alexander Kolodin, the attorney representing The Public Integrity Alliance who filed the “cease and desist” against crossing out mistakes, said:
“[Fontes] wasn’t telling people the consequences of following his instruction, was that the ballot would be spit out and counted by humans instead of by machine…The law says that the instructions that the reporter must get is that is somebody who is on the early voting list messes up their ballot, they have to get a new ballot.”

“Legitimacy is important in [the] election, and the longer it takes to get a count, the more people are going to question the legitimacy of the election, we cannot afford that this year.”

Do Not Use Sharpies/September 2020

October 17, 2020
  • The Maricopa Recorder talks about a device that “prints out a durable paper copy of the voter’s ballot that is fed through tabulator at every polling location.” These are the new machines referenced as having changed starting in the March election due to the passing of SB1135.

October 18, 2020
  • Maricopa County Recorder website reiterates that “a standard black or blue ballpoint pen is sufficient. Do not use red ink or permanent marker. This may result in a false read by our ballot tabulation machines.”
If the equipment was changed and Sharpies could be used without worry because of the changes in ballots and equipment, why are Sharpies still discouraged on October 18? The same guidance held on October 21, the last date before the guidance changed—at least with the available, archived website information.

October 22, 2020
  • In an email, Kelly Dixon wrote: “Starting tomorrow, 10/23, and through 11/2, we are asking that Clerks hand voters BALLPOINT PENS rather than markers. We NEED to use Markers on Election Day, but for now and through 11/2, hand voters a Ballpoint Pen.”

October 26, 2020
  • The Maricopa County Elections Department posted a Tweet and a video about the use of Sharpies. Guidance to actually USE Sharpies was now public.
  • The same was reflected on the archived version of the Maricopa County Recorder’s website. The wording from their website is below, as well as the tweet sent on the same day:
“Voters at home may use ballpoint pen in black or blue ink or a Sharpie. Vote Centers use fine tip Sharpies as they have the fastest drying ink, therefore preventing smudges when put through the Vote Center Tabulation equipment. This is one of the upgrades of our new equipment and new ballots. Do not use red or red adjacent ink.” They also posted a tweet on October 26.

The Maricopa County Recorder sent a 3-page letter answering questions about Sharpies. It was sent to Michael Catlett, Deputy Solicitor General to Brnovich, the AZ Attorney General. The letter says Sharpies don’t bleed through. CyberNinjas, in the course of their forensic ballot analysis, found they did. The letter says that staggering (offset) prevents false votes. However, given the calibration issues also discovered, the bleed-through of the Sharpies did cause issues. CyberNinjas documented that the alignment of ballots was off by 3200 percent in some cases. A summary of the excerpt is below:

Why We Are Talking About Sharpies Again: The July 15 Hearing
At the A Tweet and video from , Cyber Ninja’s CEO, Doug Logan testified that it looks as though four different types of paper were used in the election, mentioning Vote Secure paper. Per reporting by UncoverDC, Logan explained:

“Maricopa County specifically had indicated that they were using “Vote Secure” paper. As previously mentioned, the special paper is designed to prevent problems with calibration and bleed-through. Logan explained, “This is an indication of problems that could cause an overvote situation or cause votes to be cast for a different candidate than intended.” As a reminder, Petersen remarked that “Sharpie-gate” happened in Maricopa and “the Maricopa elections people came back and said that bleed-through ‘would not have affected other votes’.”

The paper is important because Vote Secure paper is a specified thickness and it is a coated paper that discourages bleed through. Per above, the archived link from the Maricopa County Recorder website on October 17 shows specific language referencing “a durable paper copy of the voter’s ballot” as what is being fed through tabulators at the polling location. The county seems to claim it is using the proper paper Logan alluded to in his testimony.

The Arizona Senate hearing on July 15 also revealed calibration and offset issues with paper ballots and a suspected use of paper that did not meet specifications.

Two excerpts from the July 15 UncoverDC article are found below. The information pertains to the markers and ballot paper, as explained by Cyber Ninjas, Doug Logan.

“There were ballot offsets in 168,000 on-demand, election day ballots due to poorly aligned printing issues. Logan stated that more work needs to be done to find out what printers caused those offsets and where those ballots were printed. Ballots were calibrated so poorly, in some cases they were 3200 percent off the mark.”

Because Sharpies were used in many cases in the November 2020 election, Logan’s testimony may be significant if not critical to understanding the high adjudication rate of 11.27 percent in Maricopa County—one that is normally 2 percent. Some of the paper may not have been Vote Secure coated paper. Many ballots may have been affected by the use of Sharpies. Offsets that didn’t meet specifications may have caused ballots to be kicked out in adjudication.

The UncoverDC article continues:

“Notably, there was also a discussion of the ballot paper which should not allow bleed-through. A “Just the Facts” flier was sent out in June of 2021 by the Maricopa Elections Department. The flier showed details on the ballots used, the paper used, the importance of ballot alignment and other critical details of elections to reassure the voters of Arizona about the security of their election.”

“The auditors noticed significant differences in the thickness of the paper in many instances. Vote Secure paper is usually used in elections and has a certain coating and characteristic thickness. Bleed-through is an incredibly important kinematic artifact because it can skew votes (ballot offsets), resulting in voters not voting for their intended candidate.”

Arizona Informer Thread on Chain of Custody and Election Changes For Pandemic

Finally, a thread by the Arizona Informer points out several significant election-related issues in August of 2020.

Many election procedures were changed due to the pandemic. Mail-in ballots were used to a much greater degree.

Polling centers were used instead of precinct voting. So the votes were not as “local” and allowed voters to go to any polling center—which put tremendous pressure on workers in those centers to process ballots. You can watch this Senate hearing on signature verification degradation by clicking here.

Remedies and Questions Remain
As Logan indicated, “More work needs to be done to find out what printers caused those offsets and where those ballots were printed.” If, indeed, the wrong paper was used in some cases, what is the impact of that given Sharpies were used?

If the calibration on the ballots was off by unacceptable amounts in many cases, as indicated by Logan, what was the impact on the vote given the fact that even the new machines had standards of calibration that were not met? The calibration issues could have been one of the reasons for the high adjudication rates, which could result in the disenfranchisement of voters.

Why was the guidance on Sharpies a moving target almost all the way up to Election Day—with Dixon giving such specific guidelines for using ballpoint pens from 10/23 to 11/2 and then instructing the “NEED” to use Sharpies on November 3?

For further discussion, UncoverDC’s Dark To Light Podcast explores the timeline and these issues on Monday with Arizona Senate Whip Sonny Borrelli.
