Ammon Bundy's bodyguard, Brian Cavalier, pleaded guilty Wednesday to conspiring to impede federal workers at the Malheur National Wildlife Refuge and carrying guns in offices, sleeping quarters and other buildings there.

Assistant U.S. Attorney Craig Gabriel said the government will recommend a prison sentence ranging from one year and three months to one year and nine months for Cavalier, the first defendant in Bundy's inner circle to accept a plea deal.

The negotiated sentence falls far below the maximum penalties for the two federal charges -- six years in prison for the conspiracy offense and five years for possessing firearms in a federal facility.

Cavalier also is the first of the 26 defendants indicted in the conspiracy case to plead guilty to the firearms charge. Five others had the gun charge dismissed after they pleaded guilty to the single charge of conspiring to impede employees for the U.S. Fish & Wildlife Service and the U.S. Bureau of Land Management from doing their work at the eastern Oregon refuge during the 41-day armed occupation.

"These are the times that try men's souls, and Mr. Cavalier did what he felt is best for his case,'' Cavalier's attorney, Todd Bofferding, said in a statement after the hearing. "Mr. Cavalier still loves America no matter what.''

Sentencing is set for Sept. 30.

Whatever sentence Cavalier, 45, of Bunkerville, Nevada, receives could run consecutively with a sentence imposed in Nevada if Cavalier is convicted there on a federal indictment pending against him in the 2014 standoff with federal officers near the Bundy ranch.

Cavalier identified himself as the personal bodyguard of Ammon Bundy and Bundy's parents Cliven and Carol, on a video posted on the internet Sept. 9, federal prosecutors have said. Cavalier did work as a ranch hand for Cliven Bundy in exchange for room and board for several years, according to his attorney.

Cavalier, dressed in striped gray jail scrubs, told the court he accepted responsibility for the offenses and said he was "fully aware'' of the conditions of the agreements reached with the U.S. Attorney's Office in Oregon.

Cavalier attended a protest in Burns on Jan. 2 to demonstrate against the return to federal prison of two Harney County ranchers. From the parking lot of a Burns Safeway, he traveled with others to occupy the Malheur National Wildlife Refuge that day and spent the first five days as Ammon Bundy's "armed personal security detail,'' Gabriel said.

Cavalier left Oregon for more than a week but returned to the refuge later in January to continue his security role. On Jan. 26, he was riding in a Jeep with Ammon Bundy and other takeover leaders when FBI agents and state police stopped them along rural U.S. 395 as they were driving to a community meeting in John Day.

When Cavalier was arrested, he wasn't armed, Gabriel said. During the second part of his stay at the refuge, the government also doesn't have evidence that he was armed, Gabriel noted.

"I was a body guard for Ammon Bundy which could have led to intimidation for any employee,'' Cavalier told the court. Cavalier, a broad-shouldered, sturdy man who has tattoos running from his neck down both arms to his fingers, goes by the nickname "Booda.''

The judge asked the prosecutor if Cavalier's statement was a sufficient acknowledgement of his offenses.

Gabriel pressed for more, saying he'd like Cavalier to admit that one of the purposes of the conspiracy was to intimidate federal officers from working at the refuge, even if the occupiers also had other purposes. He further asked that Cavalier acknowledge he was part of a conspiracy involving at least one other person.

"Yes, your honor, I did agree with somebody to impede,'' Cavalier said, his hands clasped behind his back.

Ammon Bundy and other defendants are scheduled to go to trial Sept. 7.

Oregon U.S. Attorney Billy Williams attended the plea hearing. He declined comment afterward.

Which is it, guilty or not guilty? Cavalier is a fool for doing a plea, but it's his choice. And yes, Vinicum is still dead and no charges against the scum who murdered him in a planned ambush.
 
Was this an example of "jury nullification"? In other words, the judge gave them instructions that should have led to a guilty verdict, and they said FU?

*A federal jury on Thursday found Ammon Bundy, his brother Ryan Bundy and five co-defendants not guilty of conspiring to prevent federal employees from doing their jobs through intimidation, threat or force during the 41-day occupation of the Malheur National Wildlife Refuge.

The Bundy brothers and occupiers Jeff Banta and David Fry also were found not guilty of having guns in a federal facility. Kenneth Medenbach was found not guilty of stealing government property, and a hung jury was declared on Ryan Bundy's charge of theft of FBI surveillance cameras.

"Stunning,'' said defense lawyer Lisa Ludwig, who was standby counsel for Ryan Bundy.

"I'm just thrilled,'' said Neil Wampler's attorney Lisa Maxfield.

The jury of nine women and three men returned the verdicts after five hours of deliberations on Thursday in the high-profile case that riveted the state and drew national and international attention to the federal bird sanctuary in rural eastern Oregon.

The coda to the stunning verdict, undoubtedly a significant blow to federal prosecutors, was when Ammon Bundy's lawyer Marcus Mumford argued that his client, dressed in a gray suit and white dress shirt, should be allowed to walk out of the court, a free man.

U.S. District Judge Anna J. Brown told him that there was a U.S. Marshal's hold on him from a pending federal indictment in Nevada.

"If there's a detainer, show me,'' Mumford stood, arguing before U.S. District Judge Anna J. Brown.

Suddenly, a group of about six U.S. Marshals surrounded Mumford at his defense table and grabbed on to him.

"What are you doing?'' Mumford yelled, as he struggled and was taken down to the floor.

As deputy marshals yelled, "Stop resisting,'' the judge demanded, "Everybody out of the courtroom now!''

Mumford was taken into custody, a member of his legal team confirmed.

Ammon Bundy's lawyer J. Morgan Philpot, said afterwards on the courthouse steps that Mumford had been arrested and a taser had been used on him. That could not be independently confirmed.

The five-week trial offered a rare display: Three of the seven defendants chose to represent themselves. Five of them were among the more than 80 people who took the witness stand to testify.

And one of the original 12 jurors was dismissed after a fellow juror raised concerns about his impartiality four days into an initial round of deliberations - what the judge called an "extraordinary circumstance.'' An alternate juror was summoned to begin a new round of deliberations with the remaining 11 jurors Thursday morning.

There was heightened security in and around the courthouse throughout the trial, with security officers ordered to wear bulletproof vests, and metal detectors set up outside the main trial courtroom and an overflow room with a live video feed of the proceedings.

Often, supporters knelt in prayer in the courthouse corridor before the trial began in the mornings, and some kept vigil across the street, with one fellow occupier blowing a ram's horn, or shofar, as the jury deliberated.

The judge was pissed I bet because the jury went against his instructions. So the judge was determined to get somebody's scalp, (or two). That would be my guess.

The Bundy brothers are still under federal indictment for their roles in the 2014 standoff at their father Cliven’s Bunkerville, Nevada ranch.

U.S. Marshals tackled Mumford to the ground and hit him with a stun gun multiple times. He was taken into custody but released shortly thereafter.

Via Sherri Chandler: Mumford (Ammon's Attorney) was standing up for Ammons rights, to be released and said that there is NO paperwork to hold Ammon. NO arrest warrant giving to him for Ammon. Mumford was eventually tackled by six marshals and Tazed him. You could not see Mumford after they swarmed him. The computers were pulled off the desks the six marshals were yelling, "Stop resisting", six times. I could hear Mumford being smashed by these thugs grunting and groaning, more shouting to stop resisting and then they tazed Mumford. I could heard Mumford screaming "ow ow ow! Someone help me!' I was jerked out by the Marshall.

I read it but have a hard time understanding WTF is going on

It was a courtroom temper tantrum after "jury nullification". Mark my words, that is what will be coming out later. The jury no doubt ignored the judge's instructions as to how to decide based on the evidence. Good for them. Good Patriots All.

There is another side story.]
The jury deliberations had gone on for three days when one juror requested that another juror be removed from the panel because he was a retired BLM employee. The tainted juror was removed and the next day, the Not Guilty verdicts were brought in. Per Fox news radio at 7 PM PST.
