Warren introduces nationwide eviction moratorium bill
The coronavirus is exposing America’s housing crisis. Democrats in Congress are proposing a nationwide eviction moratorium.

Colorado, like many other states and cities, implemented a temporary eviction moratorium in March, to prevent people from losing their homes during the coronavirus pandemic.
But the state’s moratorium expired on June 13, though Gov. Jared Polis issued a last-minute emergency order that required landlords to give tenants more notice about any evictions, effectively delaying many evictions for another 30 days. It was a reprieve, but a temporary and incomplete one.
Oregon's Governor Brown has extended it to September 30th as have other states, but it will eventually run out and then what?

I have been saying that the original rental, and house "fore bearance payment" laws were Trojan Horses that were meant to not defer bills due, but to forgive them. And lo and behold here we have the Senator form Massachusetts, Elizabeth Warren now introducing a Senate Bill that will impose a NATIONWIDE BAN ON ALL EVICTIONS. Stop and ponder this for a moment. She wants to make it ILLEGAL to evict anybody, for any reason, anywhere in the entire CONUS.

It just doesn't get any more MARXIST THAN THAT. At any rate, the next step, and the only logical step is for a PERMANENT forebearance bill. After all, if you give rent and mortgage payment relief, extend it for additional months, and then make it ILLEGAL to evict anybody for any reason, well then come September/ November why not just make it all permanent, and evict nobody, pay everybody's rent or house payment, and then go to the UBI and be done with it.

The where the money comes from, or who pays the rent and home payments for TENS OF MILLIONS OF LONG TERM PERMANENT UNEMPLOYED. Again, the ancient Romans had words for this: Roman Mob, Bread and Circus, and the like. Warren didn't even wait till the end of June to start paying rent etc for the next six months. We all know that once this gets locked in, all hell will break loose.

We should all factor in the simple fact the Yelp site estimates that some 40% of restaurants are already PERMANENTLY CLOSED and will NEVER REOPEN, along with all the employees and support people that entails. So, where do they get the money to pay the rent, or buy food when the unemployment runs out, or the food stamps, and hitting close to home for me on that one. A permanent class of unemployed and that is all there is to it.

It is perfectly legal for a landlord to get a permit for repairs. Removing all windows and doors generally leads to abandonment of the premises - in normal times. Now tenants may throw cardboard over the holes and stand watch.

I've seen a many as five RV units parked around rural houses and up to three parked in a city yard. A lot of people are banding together.

Um. Removal of property without due process? I.e. a condemnation action, eminent domain, or legal judgment against a property owner?

Government can't simply "deprive one of use" and take one's property and "give" it to another.

Well, Drug seizure laws not included. These are wrong in their face - I just don't think they have been adequately tested by the seizees.

A temporary ban MIGHT fly in the basis of a declared National Emergency, but so far CoVid has not reached that plateau has it?

Only different in that after 30 years of paying "rent" to the bank, you own it. A "rent to own" if you will.

A true rental in the same period of time you own only the "receipts" from your monthly toll.

Its called "return on equity" - and it doesn't matter if a bank gets it (i.e. minus bank toll the depositors get it as interest) or the property owners (who have to pay the property taxes, insure the property, maintain the property, and THEN take their profit.)

Except for the comparison between "Usery laws" for Banks and the continuing overheads AND renter protection laws for the property owner, the risk/return is similar.

Nothing has changed yet. This bill would have to pass through Congress and Trump would have to sign it. I don't think any of that will happen.
But things might look very different by the end of the year and then all bets are off because anything might happen.

Who cares who "owns" it if I can live there and pay nothing. Oh.. the landlord is still responsible for upkeep and repairs. If this were to pass I would just walk away from the property.

I turned my rental house on my property into my woman cave when CA allowed any amount of people to live in a house and impossible to evict if kids were involved. And also the cops told me one night when I called them I wasnt allowed in the rental's yard. The money wasn't worth the hassle.

Remember the seizure of farms and houses by Stalin from the Kulaks' in the Ukraine, or in China, or in Vietnam under Ho Chi Minh? They are F&&^%^&&& Marxists and will take your apartment, house or whatever property they want to once they can. Of course, the 2nd amendment comes into play, which is where the BILLIONS OF AMMO ROUNDS OBAMA BOUGHT COME INTO PLAY. terrible business move. if the landlords dont get rent they cant pay Their bills or taxes and at what point do they have to declare bankruptcy? they cant evict the non payers and get new people in. veyr bad move for business people but excellent news for non payers.

a much better idea is for waren, pelosi, schumer, AOC, omar, all the dems and hollywood and all celeb sports stars kick in and PAY THE RENT OF THE PEOPLE WHO STOPPED PAYING RENT to help them get up to date. have a fund raiser, have willie nelson do a convert, have deniro and reiner, milano, king and all those deeply compassionate multi millionaires do their duty. heck each one of them can sell a mansion, or yacht and not even miss it.

Every time this kind of discussion comes up I am left wondering if we will ever get to the point like in one of the Matt Bracken books where people with extra bedrooms were forced to take in non-paying tenants assigned them by local officials. Back when I read the books, I thought this stuff could never happen. Now it increasingly feels like we are living in a Matt Bracken novel. If the Dems do a clean sweep in Nov., the question is how far will they go & how fast will they do it.

No. The defining question is how many of the Marxist Death Squads we kill off while they are in the process of seizing our property, and raping and murdering us. A Marxist Insurgency begins with bullying and ends in blood. I will repeat this is the first and only time where a Marxist insurgency has tried to seize private property of ARMED CITIZENS, like in Saint Louis. Finally, they will use all the DA's Soros got elected to harass gun owners etc, get hunted down. The real issue isn't the Marxist Death Squads, it will be how long the next in line will tolerate some legal opinion, like the da bitch against the two lawyers. We face not only the guns of the Marxists but the legal system that will crush anybody who resists, at least till that legal system pays the price for treason.

As far as I gather, the banks sell the notes into the derivatives ether. Because banks are always "too big to fail," the Federal government hands them bailouts for the mortgage bundles that are sold for pennies on the devalued dollar. The banks are thereby "made whole," and squatters are no longer their legal problem. The local government is left to deal with (but by that time wont' much care about) people living in squalid conditions, and hazardous Detroit type building wrecks. (Come to think of it, Detroit might make a good case study.)

Anyway, without the tax payments on those properties, the local government bureaucrats will soon run out of money, and will further squeeze the remaining property owners. These petty tyrants will look for creative ways to extort even more cash out of the locals. (Not sure how they will do this w/defunded police, but where there is a will....we are talking about City Hall, after all.) By way of example, a decade-plus ago, I lived in a town in IA that LOVED to spend money, and decided a "temporary" local sales tax of 1% would fit the bill, and they were a shining example of propriety and sobriety compared to the dump that passes for a "village" where I live now. Small towns are EVERY BIT as corrupt as the Feds, they just don't have quite as much of a treasury to steal from.

In short, to answer the question, the squatters don't get evicted, but they will move into tar paper shacks along open sewers when THAT sort of housing is actually more livable than multi story feces infested shambles with no working utilities. As for the folks who own homes, and manage to cover the extortion level property taxes/utility rates, see the other posts. Yes, they will be required to take in *tenants.* After all, People are more important than property rights. Doesn't matter if that 20 year old ghetto thug tortures your dog and rapes your daughter. This is the playbook. It has happened numerous times before.

If it seems like it would have sucked to live through similar in Soviet Russia, just imagine what it will be like in a society blessed with Glorious Diversity! I have no good answers, but the better we are all mentally prepared for what is coming, the better our chances are of dealing with it.

Yes, but I suspect there are executive orders or legislation in place that allow the President to suspend the Constitution under certain national emergency powers. Under the guise of let no crisis go to waste, it would be a national disaster, natural or manmade, that would trigger the necessary state of emergency to trigger this authority. If here today they can preclude landlords from evicting tenants that don't pay the rent, certainly they can carry it a step or two further.

Good thing that this cannot be done as no emergency can suppress or suspend the constitution and them the rules seriously. To suspend the Constitution of the United States of America there will be no constitution of the united states of america that would be a overthrow and take over of our country and best get your rifle ready.

Dobbin, you are much more optimistic than I. It's my view that "the Gubmint" will try or do whatever the bozos driving the train think they can get away with... They don't believe in the Constitution anyhow.

Maybe its the bucolic nature of your pasture and favorable attention of Owner. ;)

Well, under the guise of the WuFlu emergency they forbid people going to church, forced businesses to close, mandated people wear masks, stopped evictions & foreclosures, and more. It doesn't seem the Constitution has been much in effect these past few months.
