The Walgreens customer who killed a would-be-robber Monday night has been cited for carrying a concealed weapon but won't face a charge in the shooting.

Harry J. McCullough III, 32, had a permit to carry a loaded handgun in plain view — typically in a holster — but did not have a concealed weapons permit, said Omaha Police Officer Jacob Bettin.

McCullough pulled his handgun from the waistband of his pants when he shot and killed Marquail Thomas, a shotgun-wielding 18-year-old and would-be-robber at the Walgreens in Benson Monday night, Bettin said.

McCullough was not arrested in connection with Thomas' death, and Douglas County Attorney Don Kleine said Tuesday afternoon that he would not file charges in connection with the shooting.

Bettin said two masked men had entered the Walgreens at 6101 Northwest Radial shortly before 9 p.m.

He said one of the men pointed the shotgun in the direction of the cash register, where several customers were standing in line.

McCullough fired several shots as the shotgun-wielding suspect pointed his weapon at customers. Thomas was hit several times. He fled from the store but collapsed outside.

McCullough then grabbed a second masked man and held him until police arrived, Bettin said.

Thomas was taken to Creighton University Medical Center, where he was pronounced dead, police said.

The second suspect, who authorities identified as 17-year-old Angelo Douglas, was booked into the Douglas County Youth Center on suspicion of robbery and use of a weapon to commit a felony.

Nebraska law allows individuals to use force when their life or another person's life is threatened.

The Walgreens store was open for business Tuesday, with several customers shopping. A few chatted about the crime.

Store employees said they were not allowed to comment. Calls to Walgreens' corporate offices were not returned.

If this happened more often, I think potential young criminals might start figuring out that there are safer and better ways to earn a living.

edit: just watched the video on the link. Why do they have a very unflattering photo of the good guy but never show the faces of the suspect? Anti gun sentiments and anti-self-defense sentiments in the media perhaps? Naaawww!

Concealed carry without a permit in Nebraska is a misdemeanor. The first time. The second time it is a felony. Felons can't legally *own* a gun.

Whatever sort of permit you have for carrying a gun, adhere to the specifics of it religiously. Don't carry concealed if you have an open-carry permit, and don't carry openly if you have a concealed-carry permit. Don't give the a**hole anti-gunners any ammo against our rights.

Sounds to me, like what you are describing is a 'privelege'...not a right.

Folks in Alaska and Vermont and just last week, Arizona...now have a 'right' to carry a gun. No permits are necessary in these 3 states.

Here in Tennessee, I have a handgun 'carry permit'. It makes no distinction whether my weapon is carried openly, or concealed. But it is still a hoop I have to jump through, in order to enjoy the 'privilege' of carrying a gun, without fear of being arrested.

The difference? Privileges can be taken away...and in this case are preceded by having to ask permission, take a class, get a background check, have my fingerprints taken and pay a hefty fee/tax.

One's 'rights'..on the other hand, can be freely enjoyed, without such hindrances...

What I'm describing is a right that is under assault from many quarters. Every time a lawful citizen does something stupid it gives those who would take away our rights more ammunition to do so.

Right or wrong, that's reality.

In a perfect world - "BrutusWorld" for example - it would be perfectly fine for you to carry whenever, wherever, and however you wanted. You could also own a machine gun with no nefarious taxes imposed or special permits required. Alas, those who make the laws aren't as enlightened as me.

Another example: If you think marijuana should be legal (that would be fine with me, eventhough I don't partake anymore), do you protest it's illegality by walking around town smoking it in public?

I noticed that this 'lawbreaker' wasn't even considered to being arrested.

The cop had to ticket him because that is the law. But if the prosecutor has an ounce of sense in this case he will not press charges for the CCW charge. If he does I hope the citizens in his town raise holy hannah!!

It says he is charged with a crime Arrested or not he will still go to court and have it on his permanent record forever and depending on the State loose his right to carry a firearm .Because it was a CRIME with a firearm. State laws do not care what that crime was.

It was a misdemeanor. No reason that he would not be legal to carry in the future.
My point of posting was to point out to all the cop haters here that his head wasn't bashed in by the JBT that some here like to cry about.

This wasn't the first time events occurred like this in the USA.

Glad he was carrying and not worried about "getting involved". Doesn't sound like he really has anything legally to worry about. Maybe the gun was in his front waistband,so wasn't really "concealed". Story doesn't say, and even if he had a holster on, it could be concealed, if wearing a long shirt/jacket.

IL has terrible gun laws, which makes me want to move far from here. About the only thing we do right is "grow" crooked politicians!

I live a couple of blocks away from this store, so let me give you some background on the area.
Benson was a small town that Omaha annexed early 1900"s. Very diverse and it still has a small town feel. This walgreens happens to be in the slum part of Benson. So bad I won't go into the store during the day let alone at night. These people can steal the whole store, and nothing happens to them. One of the downfalls of our area, the criminals have more rights than anyone else.

I think this guys' actions REALLY deserve a reward, not a ticket. I hope the local DA has some common sense and uses it.

What stood out is that he eliminated the threat, and *didn't shoot the other kid*... great presence of mind which maybe sounds like it's an obvious "duh", but once the adrenalin is pumping, it takes considerable self control to not overreact.

Good shoot, and really GOOD job.
