ECON Pay IRS penalties in the last 3 years? Want it back?

I thought I would do this just because.

Question, ever file late, fail to pay, forget a 1099 and get a letter from the IRS? There is a rather simple way to get the penalty waived or returned.

Yeah it is rather simple, but there are a couple of criteria you must meet.

1) Are you current in filing all your taxes?
2) Have you paid all taxes due or have a payment plan?
3) Have you asked or had asked for you, for a penalty abatement in the last 3 years?

If YES, YES and NO, then you can ask for a penalty abatement.

There are two ways to do this. The hard way....... call the IRS and ask for a "1st time penalty abatement for tax year XX". I say the hard way as they will never answer the phone and if they do, will be difficult.

The easy way is to file form IRS Form 843

What you need:

1) The CP2000 you got telling you that you still owed and how much.
2) Access to a computer so you can fill the form out on line and then print it. ( you will have to mail it )

What to do:

1) Fill out the names and address that were on the CP2000. If you and your wife, then both. Be sure to fill out the entire section as it applies.

2) State the year in part 1. It will be on the CP2000. So if it was for 2019, the range will be 2019 to 2019

3) Part 3 will be checked as income tax.

4) Part 4 Type of penalty will be noted on the CP2000, which usually is something like IRC6662(b)

5) Part 5a check reasonable cause and the date or best estimate of when you last paid

6) Part 6 check "1040"

7) This is important and is critical to get correct......

" we respectfully request that the "list they type of penalty per CP2000" penalty be abated based upon the irs's first time abatement administrative waiver procedures as discussed in IRM 20.1.1.3

8 ) Be sure to sign and date.

9) Make a copy for yourself

10) Mail it. It will take 6-12 months, but it does work.

I just got one back for a person who paid their taxes from 2013 off in 2020. Saved them $1,100.

Again if you paid a penalty, try it.

Good luck. It will likely take 6-12 months before the mail is even opened. Seriously. If there is any way to file online I would highly encourage that.

To bad I just can't get paid (even minimum wage) for all of the hours I've worked and have paid out to be or stay compliant, and sent those taxes and fees to the Treasury and the mandated insurances.

Over 17 years as a employer and over another 17+ years as a independent individual.

Have been late and fined several times over the years, including for 2021, so if I'm not late next year for this year, I might get my penalty back? Try to remember to ask our CPA next year.

Thank you so much!!! We finished paying off our 2015 in June and I went back to our IRS account to look at the transcripts and found that they'd been charging me a $400/month late payment. Not because I was late - but because two years earlier I had gone through their website and changed the monthly installment payment amount. Because it wasn't the original amount, and because I hadn't called their office - their system decided to charge me a late fee. Did they ever let me know about the late fees? Nope! Did they agree to the new installment and even send me a letter with that agreement? Yes! So, I just filed an 843 for a refund. Thank you so much!!!! If you hadn't started this thread, I never would have looked!!!!

It only works on penalties

The IRS representative told me to file 843 because they were penalties. ETA: I see that I called them fees - they called them penalties.
Also look at the letter they sent. It will provide the correct information. If a penalty, you are good to go.

The IRS rep should have taken them out for you. They have the authority to do so. You have to ask.

Good to know! I once was fined about $5000 but got out of it by writing a letter as my CPA suggested. Something along the lines of "I made a dumb mistake". Filed 1099's a bit late for about 100 clients and vendors.

They never sent a letter. I was looking back at my online transcripts because of your post. Then I saw my monthly payment of $400 and then a charge of $400 starting in October of 2021 all the way through until June. I'd been paying $400 for at least a year prior - and no charge, no letters, nothing. He told me that it was because of COVID that I hadn't been billed the late fee earlier. I said that although I got approved through the website for a new payment amount and received a letter stating my new payment and start date - I shouldn't have done that. So, it was my fault. I did ask him if the penalties could be removed and he told me to file 843. Should I call back and hope that I get a more helpful rep? Thank you for all of your help.

You can. IRS people are hit and miss for sure. I have had them driving their cars down the road with children in the back ( I can hear it all ) and they lie and tell me the system is down.

If you have the data from your transcripts, then you can file the 843, else try calling them again.
