New York Legislation Provides for Indefinite Detention of Unvaccinated at Governor’s Whim

by Kay Smythe

December 18, 2021

On January 5th, 2022, the New York Senate and Assembly will vote on a bill that would, if passed into law, grant permissions to remove and detain cases, contacts, carriers, or anyone suspected of presenting a “significant threat to public health” and remove them from public life on an indefinite basis.

Bill A416 presents a serious risk to the basic liberties of all Americans in the state of New York, including their right to choose whether or not to receive medical treatment and vaccinations related to thus far undetermined contagious diseases.

The bill gives the Governor of New York, his or her delegates – including but not limited to the commissioner and heads of local health departments – the right to remove and detain any individuals or groups of people through issuing a single order.

The orders only have to include the individual’s name(s) or “reasonably specific descriptions of the individuals or groups.”
The department can decide to hold a person or group of people in a medical facility or any other they deem appropriate. The language is purposefully vague.

Though the bill attempts to state that no one shall be held for more than 60 days, the language allows for court orders to waive this maximum detention time. After 60 days, the court is allowed an additional 90 days to consider the detention of an individual, a cycle that can last indefinitely per the opinion of the department.

It goes on to state that the Bill will “require an individual who has been exposed to or infected by a contagious disease to complete an appropriate, prescribed course of treatment, preventive medication or vaccination,” essentially giving the government the right to detain anyone they want and forcibly vaccinate them.

As the language of the bill refers to individuals or groups who “potentially” pose a threat, the bill is a preemptive strike against anyone the the department believes has the capacity to “pose a threat in the future, such as those refusing to receive the COVID-19 vaccination.

There is no explicit reference to what types of contagious diseases qualify a person to be removed from public life, detained in a facility, and forced into medical treatment and vaccination. Anyone can technically be held in isolation until they are deemed non-contagious, which would also raise questions over whether those carrying HIV/AIDS could be released back into society.

The bill has received an overwhelmingly negative response on the NY Senate website. Commenters have stated that, “this is disturbing and sets up a terrible precedent for future law. The governor can basically detain whoever [he/she] likes on the basis of scanty evidence. This is un-American. It reminiscent of the Soviet Union locking up political opponents on the basis that they were “mentally unstable”. We CANNOT allow this in our state.”

“This is a violation of fundamental human rights. The government should be working for the people, not locking them up without cause.”

Others have noted the similarities between this bill and the Australian response to COVID-19. Australia has built a number of COVID “quarantine facilities” that can hold 1000s of people at any given time.

The language of Bill A416 can guarantee that Americans, whether they test positive for COVID or any other diseases, are held indefinitely at such facilities.

On The Level
At the present time is it reasonable for one to assume that if the authorities show up at ones home, work, or vehicle, that one may be detained indefinitely?

This same person (PERRY) has prefiled the same, or a very similar, bill going back to 2015, 2017, 2019, and once again in 2021.

EDIT: This bill has gone nowhere the first 3 times it was introduced.

This stuff is ALREADY ON THE BOOKS for TB patients. "Precedent for future laws?" HAHAHAHAHHAHAHAHAHHAHAHAHAHA They used the precedent on the books already.

lake placid, Saranac Lake, Blue Mountain Lake and damn near every Adirondak lake town that had the wherewithal to build a lodge, built a sanatorium, and booked patients in, so as to "Take the Air" as a TB recuperative.

MANY of those there (depending on which sanatorium) were there NOT under their own choice. In the 1920s at least.

I KNOW this crap because my maternal Grandfather DIED of TB, my aunt was a nurse who after the War worked on taking care of the family.

I spent the first 25 years of my life testing positive for TB. Since the sanatoria had all pretty much closed by then, and they had much better tests, I never had to do more than take a second test and get a Chest X-ray, but the POTENTIAL was there to have to be treated in a local hospital.

All the "Potential incarceration" or "potential forced care" "potential vaccination" is screaming theater. This is NOTHING NEW.

Anyone ever notice that Trump is always silent about things like this? That should creep people out.
Got an email today from the "organization" asking me to buy doormats for $62. What a crock of _hit. That buys me cheap 100rnd 12 gauge 7 1/2 low end Winchester or Federal. Not too hard to make 4 ought buck out of that. Done with the rhetoric from any of them. We are entering the ungovernable stage. Don't need or want their opinion. Detain people? Give it a whirl, you want the purge, you'll get the purge.

Er... I know of NO law that allows for the incarceration of HEALTHY, non-criminal people, for any reason. Sorry.

And any law that allows for ANY forced medical care violates our God Given rights. EVEN IF that treatment might be deemed lifesaving.

(Note... I have no problem with locking someone up who is both provably sick and contagious with a deadly disease. But quite honestly, when they threw away centuries of common sense health rules because of "feelz" in the AIDS epidemic, I no longer feel any need to pay any attention to the public health morons)

Trump is not in a position to be vocal. Go ahead and call for violence publicly and see how fast the JBT’s are on your doorstep. They would love if trump said something.
No one said anything about him calling for violence. And he releases strong vocal statements almost every day. All he needs to do is say how wrong it is.

Am I paranoid but if you extend this power to local LEAs, what happens to Habeas Corpus? Indefinite hold, at the whim of the arresting authority?

They just keep turning up the pressure.

Well I AM surprised at that----wasn't it the NY Legislature that passed---to CHEERING, APPLAUDING crowds---a bill allowing mothers to "abort" even LIVE BABIES JUST BORN if, at that moment, they suddenly "changed their minds"--essentially passing a bill approving infanticide?

You are correct about that. Just like the Jan 6 protestors and the adverse effects and deaths resulting from the bioweapon vax. A deadly vax he cannot stop patting himself on his back for the speedy approval without testing. Not to mention the liability protections for the makers of that bioweapon.

My idea is to force Trump to speak out about it by pointing out that he does not. If everyone noticed then it would get back to him and put pressure on him to do so.

Neither here nor there.
So in a nutshell if one does not get vaccinated then expect to be shuttled off to a concentration camp, where at some point they will decide it's too expensive to keep people in concentration camps, and then the executions will begin. Got it.
