Doubt there will be any "illegal" immigration soon. New executive action to allow unlimited workers to flood American jobs. Great news for ppl wanting to come work in the USA. Not good news for Americans looking for or wanting to keep their jobs.

Even just a few hours old and this has made many in commentaries realize this administration is not about protecting or helping Americans.

I have a friend who will be coming here soon from Europe in a high level medical related job. I'm very happy for her. Wondering how this all will play out, and how long it will last. Cannot imagine Americans putting up with this much longer.

However the current prez got voted in twice so one has to question the intelligence of the average joe.

New Year’s Surprise: Obama Regulation To Give Work-Permits To Foreign College-Graduates


As the nation prepares to ring in the New Year, President Barack Obama is preparing a colossal new executive action that could print-up work permits for a huge number of foreign white-collar graduates every year, above and beyond the levels set by Congress.

This executive action, which directly bypasses Congressional lawmakers, is likely to reverberate across the presidential race, as GOP voters look to choose a nominee they believe will most effectively roll back the President’s still-expanding agenda. And it will certainly raise new security concerns as it covers categories of immigration utilized by migrants from the Middle East and nearby regions.

President Barack Obama’s Department of Homeland Security plans to publish the proposed rule tomorrow, the last day of 2015.

The 181-page rule focuses primarily on giving work-permits to foreign college-grads who will compete against Americans for white collar jobs, despite the large number of American graduates now stuck in lower-wage positions and struggling to pay off college debts. The rule will also make each foreign graduate much cheaper for U.S. employers to hire than many U.S.-born college grads.

“Obama has gone the Full Monty to bust the immigration system,” says immigration lawyer John Miano. “What is going on is he is effectively giving Green Cards to people on H-1B visas who are unable to get Green Cards due to the [annual] quotas… it could be over 100,000.”

The new rules to aid foreign college-graduates are an extension of his earlier efforts to bypass popular laws against illegal immigration, said Miano, the co-author of a new book about the painful impact of the white-collar guest-worker programs, titled “Sold Out.”

This executive action could have been prevented, however, had the bipartisan 2016 omnibus funding included language proposed by Immigration Subcommittee Chairman Sen. Jeff Sessions (R-AL)80%

In April, Sessions proposed language to reduce and cap the number of work-permits — dubbed “Employment Authorization Documents” — that could be distributed to foreign workers each year. Sessions’ recommendation was rejected by GOP and Democratic leaders in Congress, and so House Speaker Rep. Paul Ryan (R-WI) 56%
’s December omnibus is enabling the president’s new executive action.

In 2012, Obama bypassed laws against illegal immigration by awarding two-year work-permits to at least 800,000 younger foreign migrants who were brought here by their illegal immigrant parents. In 2015, the courts blocked his November 2014 amnesty plan to award work-permits to roughly 5 million resident migrants who have U.S.-born children. From 2009 to 2015, Obama also allowed at least 250,000 Central American migrants into the United States to request asylum or refugee status. In 2013, Obama added roughly 2 million extra foreign workers to the economy, while roughly 4 million young Americans began looking for work.

“The objective here is to strip American workers of their protections from foreign labor embodied in the Green Card quotas” that are set by Congress, not the White House, Miano said.

The annual award of Green Cards — and vital preliminary work-permits — is limited by quotas that mostly impact the many Indian and Chinese graduates who come to the United States as H-1B guest-workers, or who first arrive as students and later start working in the United States via the Optional Practical Training and H-1B programs.

Roughly 650,000 foreign graduates are working in the United States for roughly 5 years each under the H-1B program. Roughly 120,000 foreign graduates of U.S. colleges are working in the United States for two years each via the OPT program, often called the ‘mini-H-1B program.’ Without this new regulation, most of those foreign graduates will return home after several years, forcing companies to hire U.S. graduates in their place.

The foreign graduates typically get entry-level jobs that would otherwise go to new U.S. business graduates, designers, doctors, programmers, engineers and scientists. Also, the foreign graduates are used to replace mid-level American professionals once they seek mid-career pay-raises to help pay for mortgages and child-rearing.

According to the pending regulation, “many of these changes are primarily aimed at improving the ability of U.S. employers to hire and retain [foreign] high-skilled workers who are beneficiaries of approved employment-based immigrant visa petitions and are waiting to become lawful permanent residents (LPRs), while increasing the ability of such [foreign] workers to seek promotions, accept lateral positions with current employers, change employers, or pursue other employment options.”

The new policy also creates a large economic incentive for U.S. employers to hire foreign college-grads instead of new American college-grads.

That’s because the policy will allow U.S. employers to hire foreign college graduates at very low salaries. The foreign graduates will gladly take those low-wage white-collar jobs because the new policy allows them to get deferred payments from the federal government — valuable permanent work-permits that are the first step on the golden pathway to Green Cards and citizenship.

In contrast, employers can’t pay American graduates with this combination of low-salaries plus the federal promise of citizenship — because the Americans already have citizenship.

That means employers must pay more money to hire American college-grads than they would to hire foreign college-grads. That puts a huge disadvantage on American graduates because they need higher salaries to pay off their expensive U.S. college debt.

Miano slammed the new regulations, and said they reflect Obama’s preference for foreigners over Americans.

“Notice that when foreign workers are going to lose their jobs, Obama has DHS make protecting their jobs the agency’s highest priority,” chiefly by minimizing enforcement of immigration laws, he told Breitbart News. But “when American workers lose their jobs to foreign workers, Obama does absolutely nothing,” he said.

“We have a president with a very warped sense of priorities,” he added.

The public can object to the new regulations, according to the DHS document.

Obama administration quietly moves to give work permits to an estimated 100,000 foreign college grads

The rule would unchain foreign workers from the employers who sponsored their visas and give them worker permits

As long as they have a job in a similar field, they'll be allowed them to stay in the U.S. until they finish the green card application process

The Department of Homeland Security put the proposed changes to the H-1B visa system in a 181-page document it released on New Year's Eve


President Barack Obama's administration quietly released a proposed rule today that would unchain foreign workers from the employers who sponsored their visas and give them permits allowing them to stay in the U.S. until they finish the green card application process.

Based on the current backlog, the rule would give an estimated 100,000 high-skilled immigrant workers currently in the country on H-1B visas who have applied for green cards but not yet received them the ability to remain in the U.S. indefinitely.

The Department of Homeland Security says the proposed amendments, which the public has 60 days to formally comment on, implements two acts passed more than a decade ago that deal with American Competitiveness and 'clarifies and improves upon longstanding policies.'

But John Miano, a fellow at the Center for Immigration Studies, says that's a ruse.

Before the administration was acting 'under the covers,' Miano said. With this planned change to the immigration system, 'it's right in your face saying, we can do whatever we want.'

'This should be really upsetting,' he said.

Lawmakers on both sides of the aisle worry that by increasing the number of foreigners approved to work in the U.S., the federal government is undercutting Americans' employment opportunities at home.

Alabama Sen. Jeff Sessions, a leading advocate of visa limitations, aggressively fought against a provision in the massive government spending bill passed by Congress and signed into the president earlier this month that increased the number of visas for low-wage foreigners.

'If Congress wants to get serious about representing its voters, and winning their trust, it should be begin by moving legislation next year to both end illegal immigration and reduce immigration visas,' he said at the time.

Sessions said, 'Congress should defend the citizens of this country with the same passion as the President defends the citizens of other countries.'

Miano likewise said of the Obama administration, 'American workers lose a job, and they do absolutely nothing. Very warped sense of priorities here.'

The way the system currently works, he explained, foreign college grads who enter the country on H-1B worker visas sponsored by their employer. From there, they can apply for green cards that will allow them to independently and legally live and work in the country for an indefinite period of time.

The visa program creates a pathway to legal residency for foreigners wishing to relocate to America. Current limitations on the number of workers from each country who can apply has created long waiting lines for applicants of some nationalities, specifically India.

By Miano's count, which he admits is open to critique because DHS makes it impossible to ascertain the exact number visa holders and green card applicants, roughly 10,000 Indian workers a year who apply for green cards don't make the cut.

After 10 years, 'if you're in the queue you would go home,' he said.

The proposed rule changes all of that.

The 181-page document, first brought to light by Breitbart News, says the changes would improve 'the ability of U.S. employers to hire and retain high-skilled workers' on the employment-based immigrant visas who 'are waiting to become lawful permanent residents (LPRs), while increasing the ability of such workers to seek promotions, accept lateral positions with current employers, change employers, or pursue other employment options.'

Miano said, 'The objective is to get people who wold go home to stay.'

'These are people who would otherwise leave the job market.'

Supposing the back log of applications goes back a decade, and Miano says it actually goes back longer and he's giving a conservative estimate to account for other factors, 100,000 workers from India alone will now be 'unleashed into the job market.'

And that's just from India, which Miano said accounts for roughly three-quarters of the waiting list.

Of course, DHS' vague reporting means the green card line could also be shorter than that, he acknowledged.

Yet he added, 'Would they go through all this trouble to implement a rule like this to only do 2,000 people?' I don't think so.'

No longer will green card applicants have to stay with the employer who sponsored their entry into the country until they're approved to avoid being sent home.

A legal analysis of the rule produced by Hunton &Williams LLP determined that H-1B visa holders will be granted an unlimited number of three year extensions on their permits until their green card application is either approved or denied.

The law firm's review of the rule also revealed a grace period of 60 days for visa holders to find new jobs if their employment is terminated before they're served papers.
DHS did not return DailyMail.com's request for comment on the matter.

As far as the green card process is concerned, Hunton & Williams says DHS' is proposing 'continuing to allow workers to “port” pending green card processes to new employers' if they meet certain requirement, including one that mandates they must be moving to jobs in the 'same or similar' occupation.

Miano said DHS is trying to make it sound like what its doing is a continuation of a previously established policy. It is to the extent that agencies within it have been taking actions like this for years, 'but they've been trying to keep them under the radar,' he said.

Before the department would make exceptions to immigration rules and say 'it's necessary for us to exercise our authority,' Miano said. It then began creating provisions that its now using as justification to work around a myriad of immigration statutes.
'And now we have this regulation, and it allows huge classes of aliens to work,' he said.
DHS moved to issue worker permits because the green card process is 'choked up,' said Miano. And the new rule 'just makes more of a mess of the immigration system.'
'We're getting all these patches that are making a bigger and bigger mess,' the immigration lawyer said.

New Obama Action Could Increase Permanent Work Permits to Foreign Workers Above Congressionally-Approved Levels

President Obama issued a new executive action that would grant work permits to foreign workers who are in the country on temporary work visas and have applied for employment-based green cards if implemented. The action would also extend the length of work permits for foreign STEM students who participate in the Optional Training Program (OPT).

The President issued the proposed 181-page executive action just before the New Year's holiday in an attempt to avoid public pushback.

The proposed action would override current visa caps established in the Immigration and Nationality Act (INA) of 1952.

The executive action would offer extensions to high-skilled foreign H-1B workers, providing more time to be approved for a permanent employment-based green card.

The INA states that no country may receive more than 7 percent of the total number of green cards available in a given year. The executive action would bypass the INA per-country caps for H-1B workers, essentially providing them with a fast track to U.S. citizenship.

The H-1B visas are the visas that companies like Disney and Toys R’ Us used to replace American workers. The American workers were forced to train their replacements in order to receive their severance pay.

"The objective here is to strip American workers of their protections from foreign labor embodied in the Green Card quotas, that are set by Congress, not the White House," Miano said.

The executive action would also offer a 180-day extension to any foreign student participating in the OPT program. The OPT program is often called the “mini H-1B program” since many of the students are hired on the H-1B visa once their OPT work permit expires. This extension would give more time for foreign students to stay and work in the country until issued a H-1B visa.

The new policy would also allow companies to hire these foreign student graduates at lower salaries than American graduates since they will also have the ability to receive a permanent work permit. This would create a huge competition barrier for American graduates who also seek employment and relied on the higher wages to pay off student loan debt.

This action comes after the 17-month OPT extension for STEM students is set to expire in February unless the federal courts provide DHS with a 3-month extension of the program in order to complete the process to replace the rule.

The new DHS rule will be published in the Federal Register on Thursday with a public comment period running through the end of February. At that time, DHS must respond to every comment submitted before finalizing and implementing the rule.

Obama Floods The U.S. Job Market With Foreign Competition

Skirting Congress once again, President Obama seeks to admit another 100,000 foreigners to work here when jobs are few and labor-market participation is low. Whatever this is, it's not in the interest of U.S. workers.

This time, the president isn't seeking to flood the country with tens of thousands of indigent, border-surging migrants in search of bigger benefits packages.

Instead, he plans to award via executive order work permits to 100,000 foreign college grads (including deportable aliens) to compete with U.S. workers for jobs.

Cui bono? Certainly not the U.S. workers he purports to champion.

Obama's Homeland Security rule, published in the Federal Register on Thursday, amounts to yet another illegal power grab by explicitly treading on Congress' constitutional prerogative to set immigration quotas.

It also comes at a time when 94 million U.S. workers have been unemployed so long they're no longer counted in labor-participation statistics. Some New Year's Day present for millions of discouraged Americans.

The move is especially nefarious not just because it stands as another example of executive overreach but also because foreign workers already have U.S. workers at a disadvantage.

For one thing, they're able to work cheaper. Unlike Americans, most have had free tuition rides from their sponsoring countries and carry no student loan debt. This enables them to tolerate lower wages than American grads saddled with high loan costs that can't be shirked even in bankruptcy court.

The foreigners are also exempt from ObamaCare rules that can add as much as $20,000 in costs per domestic worker for employers struggling to compete in the low-growth economy that Obama has overseen.

In short, Obama's move to bring in highly educated foreign labor hurts U.S. white-collar workers as much as the border surge undermined blue-collar workers.

Which raises the question of what the president really has in mind.

It may simply be a failure of strategy, the lack of a capacity to think three steps ahead.

But more likely, it's the result of a European Union-style effort to change the face of America — rendering its cultural norms null amid the left's moral relativism through the import of chaotic newcomers from around the world.

Indeed, Sweden, once known as perhaps the most generous recipient of foreign migrants, has recently found the cost too high. It's rolling up the welcome mat, discouraging further migration and cutting back welfare.

Obama still seems to cling to the EU's illusion and the plan to dilute American culture. It won't work the way he thinks it will. Outsourcing American jobs, even inside the country, is no more attractive than outsourcing them abroad.

Part of the rationale for these new outrageous "rules" are that current petitions for work permits / green cards etc are so backlogged that it takes over 10 years per case and there's 100s of 1000s of cases -- well actually they don't know how many, they have lost count. The whole thing is so out of control that they figure just issuing infinite "permits" will "fix" the backlog. How this will be fixed by a rational thinking person I cannot imagine. It drastically affects the life of each person, employer, co-workers, families, schools etc.

If Trump wants to send them all back to their originating countries -- millions of ppl -- it will cost a lot to find them and deport them. The new "rule" specifically issues work permits even to ppl being deported.

I also wonder what the true reality is. Will America benefit from these workers? Will it infuse new blood and creativity into our country? Or will it end up hurting us more. I wish I had an objective crystal ball and could see the past, present and future.

My friend will be a tremendous asset to America. Nobody else in the world has her combination of pioneering skills. She is coming here because only in the USA is her specialty being developed. Soon it will grow across the world. I don't know where she will end up. It will be the place most advanced in her interest.

I wonder how many skilled educated persons coming to the USA are coming specifically because of unique opportunities in their field or because they just like being in the USA.
 
I could see a RINO President doing the same, if he could not get the authorization in the House. Obummer has set these unconstitutional precedents, and the globalists on the RINO side will gleefully follow.

We are becoming like Ancient Rome, absolutely flooded with unassimilated aliens, prone to Coup and Countercoup.

At some future dates, if these United States survives as a potemkin village, there will be serial palace coups in the WH with bloodletting and such.

It will be one Praetorian Guard after another.

Flooding the country with as many people as possible who have no history of freedom, no knowledge of or care for anything to do with western culture, making sure that the whites will be a permanent minority (and the current minorities have no history of accomodation to others like westerners), he is basically killing us with our own culture. And that's his plan.

Your children and grandchildren will be unwelcome in their own country, we have already seen hints of that with illegals telling us to go back to Europe. One giant Balkanized cesspool of violence against whites and Christians.....

I'm not too sure even Trump can stop the slide downhill, but at least he'll try.

Not saying I approve of this, by any means. But how does 100,000 new permits translate to "millions" or even "unlimited" immigrant workers, as stated in the original post?

OK the answer is to limit immigration by official means to a sustainable and reasonable number as has happened in the past. Potential immigrants should be checked regarding their skills and ability to be able to afford accommodation and self support in the area of their choice. Another given should be the previous allocation before immigration of a sustainable job that will allow them foreseeable income in the future.
