Latest: Former Judge Gleeson has filed an appeal of the three-judge panel ruling in the Flynn case. This is the outside lawyer Judge Sullivan brought in to argue against both Flynn and the government! He wants "clarification" and to file a new brief!


From the appeal:

On the other hand, I do not wish to show disrespect for the court of appeals by filing my reply brief in the face of a decision directing this Court to vacate the order appointing me as moot. Accordingly, I seek guidance from theCourt in that regard.

Moot means moot. No clarification is required, it means a reply brief is useless.

Gleeson needs to be hung by the balls.

I have long suspected that Flynn's attorney will file suit personally and individually against all of the conspirators in the FBI and DOJ who arranged this travesty of a circus. Additionally, she may be able to get aroiund various immunities and file suit against both the US Government and FBI. This - in addition to a book deal - could make Flynn a wealthy man.

For those on the board with legal background, is there anyway Flynn can sue for Wrongful Prosecution?

"A wrongful prosecution occurs when someone who is accused of committing a crime is tried based on false information. Any guilty judgment that is based on false prosecution can be appealed, and if the information was provided by the police, the person accused of the crime may be eligible for money damages in a civil rights lawsuit."

Man I sure hope there is and while it is at it, sue the selected individuals for "Color of Law Violations"

In other words, just because something is done with the "color of law" does not mean that the action was lawful."

The man will NEVER be able to clear his name because the demon-crats and their minions will always believe it was all misjustice by Trump and Barr, but he should be able to make himself whole financially because of the wrongful prosecution and illegal acts of the FBI and the Deep State Muller prosecutors wrong doing.

There is a lesson here about PATIENCE and TRUMP WISDOM. DJT KNEW Flynn's treatment in the courts was insupportable and outrageous--a true miscarriage of justice. MANY patriots wanted DJT to summarily pardon Flynn many months ago. He declined, but did say it was possible. He said he wanted to let the system work.

So, Trump did let the system "work" in its painfully slow and unconscionably expensive and distressing fashion for Flynn, so that the General got a better outcome! Bit by bit, Flynn's new attorney Sidney Powell (there's a "super lawyer" if there ever was one) peeled back the layers of FRAUD, PERJURY, CORRUPTION, AND TREASON to not merely "get her client off" [as if on some technicality] but through revealing before a shocked nation just how her client had been mistreated and compelled into an unjust and unsupportable "guilty plea". POWELL GOT FLYNN NOT JUST EXONERATION, BUT A RETURN OF HIS HONOR!

********* And now Flynn can sue his former attorneys (Covington and Burling) not only for the $3.2 million they soaked him for while having a conflict of interest in the case, but Flynn can also go after all the damages and public infamy of the past 3 years. Had Prez. Trump pardoned Gen. Flynn it would have severely undercut this potential lawsuit worth many millions.

After reading my own post, realized it wasn't clear.

Hopefully sooner or later Flynn's legal team - and I've become an admirer of Ms. Powell's tenacity - will slap down the ones who did this to Flynn.

Good point. Wray is simply covering and stalling. But that's to be expected; Mark Levin said that he was Weissman's boss during the Enron prosecution that took down Arthur Andersen.

So get him out of there and let a man who's got honor and integrity try to clean up the mess in the Hoover building.

I'm reading on Freepers that Sullivan is cancelling the July 16th hearing. That sounds like he's going ahead with the dismissal. Let's see what happens...

I sure hope enough historians are writing all this down so at least some of it survives the inevitable historical "corrections" when the dust finally settles enough to where people can take a deep breath and decide how to move forward.

Those who follow need to clearly see the progression as history inevitably repeats itself, should mankind survive what's coming.

I don't have the whole thing, but the timeline would likely be something like this (drastically cut down): casting off absolutes for relative standards accompanied by the feelz of psychology overtaking philosophy and reason (if it feels good, do it), natural growth of the tumor within the sheltered halls of academia, subsequent generations being further pampered and trophies for EVERYBODY leading to safe spaces and the right to not be offended by reality, the growth of suppressing other points of view, my hypothesis is as valid as yours but mine is more because I'm "on the right side of history" and the other side "isn't who we are", persecuting and removing other points of view and inconvenient historical truths and events, criminalizing what had been considered patriotic behaviors, public trials and sentencing done by mobs ..... round and round and down it goes with a big flushing sound.

The next statue to be removed (and streets renamed in every city of note) is Martin Luther King's. And that's not because he was black or because he wanted his work to be nonviolent, it's because his dream of the day when a little colored boy was judged according to his character and not because of the color of his skin. Compare that to the outright blatancy of demanding black-only whatevers.

Like Fred Thompson said in Hunt for Red October: "This thing is going to get out of control ...."

I had a similar thought. In the appeal from Gleeson he said he didn't consult his client... I bet Sullivan grabbed him by the short and curlies and pulled smartly.

As an attorney, I want Covington & Burling to risk eight-figure punitive damages for intentional torts--they are repugnant to the profession of law! OTHERS must also PAY and PAY and PAY--money, reputation, jobs, public ridicule. SIDNEY POWELL MUST UNLEASH THE DOGS OF HELL AGAINST THEM ALL.

Everyone wants DJT to "act immediately" and when he PAUSES and PLANS for better, wiser outcomes, then such [former] supporters as ANN COULTER turn their backs and join America's enemies. [Bolton's treachery was merely a variation on this same theme of impatience and a demand for RASH ACTIONS.]

Judge's move opens door to appeal of decision ordering dismissal of Flynn case

A federal judge late Wednesday halted all proceedings in the case against President Trump’s first national security adviser Michael Flynn.

U.S. District Judge Emmett Sullivan issued a one-page order hours after a federal appeals court ordered him to dismiss the case saying he overstepped his authority by keeping it alive.

The move buys Judge Sullivan some time while he decides whether to appeal the 2-1 decision by the U.S. Court of Appeals for the D.C. Circuit. Judge Sullivan could appeal the case to the en banc appellate court or the U.S. Supreme Court.

It is also possible one of the appellate court judges could request en banc hearing even if Judge Sullivan doesn’t.

“In light of the Opinion and Order issued by the Court of Appeals on Mr. Flynn’s petition for writ of mandamus, the deadlines and hearing date set forth in the Minute Order of May 19, 2020 are hereby stayed,” Judge Sullivan wrote in the order.

Flynn twice pleaded guilty to lying to the FBI about his conversations with the then-Russian ambassador just before the start of the Trump Administration in late 2016. He later professed his innocence, alleging he was set up by the FBI.

The Justice Department last month surprisingly asked to drop the case, but Judge Sullivan did not immediately grant the request. Instead, he appointed a retired federal judge to argue against the Justice Department’s position and weigh whether Flynn should be held in contempt.

The appellate court majority said Judge Sullivan shouldn’t have questioned the Justice Department’s decision.

In this case, the district court’s actions will result in specific harms to the exercise of the Executive Branch’s exclusive prosecutorial power,” the majority wrote.

“If evidence comes to light calling into question the integrity or purpose of an underlying criminal investigation, the Executive Branch must have the authority to decide that further prosecution is not in the interest of justice,” the opinion continued.
