Harley to pay $15 million to settle with EPA

Harley-Davidson Inc. has agreed to spend $15 million to settle a U.S. Environmental Protection Agency complaint over engine devices the EPA said caused excessive pollution.

The settlement calls for Harley to pay a $12 million civil penalty plus $3 million to mitigate air pollution through an EPA project of replacing woodstoves with cleaner-burning stoves.

Also, the company has agreed to buy back and destroy thousands of engine devices, known as “super tuners,” that were the subject of the EPA complaint.

The agency said Milwaukee-based Harley manufactured and sold approximately 340,000 of the devices that, once installed, caused motorcycles to emit higher amounts of certain air pollutants than what the company certified with regulators.

Harley-Davidson also manufactured and sold more than 12,000 motorcycles that were not covered by a certification that ensures a vehicle meets federal clean air standards, according to the EPA.

“This settlement immediately stops the sale of illegal aftermarket defeat devices used on public roads that threaten the air we breathe,” Cynthia Giles, assistant administrator for EPA’s Office of Enforcement and Compliance Assurance, said in a news release. “Harley-Davidson is taking important steps to buy back the ‘super tuners’ from their dealers and destroy them, while funding projects to mitigate the pollution they caused.”

“Given Harley-Davidson’s prominence in the industry, this is a very significant step toward our goal of stopping the sale of illegal aftermarket defeat devices that cause harmful pollution on our roads and in our communities,” Assistant Attorney General John Cruden, head of the Justice Department’s Environment and Natural Resources Division, said in the release.

Since January 2008, Harley has sold two types of engine tuners which allow users to modify the emissions control system of a bike, according to the EPA.

“These modified settings increase power and performance, but also increase the motorcycles’ emissions of hydrocarbons and nitrogen oxides (NOx),” the agency said.

The Clean Air Act requires motor vehicle manufacturers to certify to the EPA that their vehicles will meet applicable federal emissions standards to control air pollution.

As part of its complaint, the EPA alleged that Harley-Davidson made and sold more than 12,000 motorcycles -- from model years 2006, 2007 and 2008 -- that were not covered by an EPA certificate of conformity.

In agreeing to the settlement, Harley did not admit any wrongdoing.

“This settlement is not an admission of liability but instead represents a good faith compromise with the EPA on areas of law we interpret differently, particularly EPA’s assertion that it is illegal for anyone to modify a certified vehicle even if it will be used solely for off-road/closed-course competition,” Ed Moreland, Harley-Davidson’s government affairs director, said in a statement.

“For more than two decades, we have sold this product under an accepted regulatory approach that permitted the sale of competition-only parts. In our view, it is and was legal to use in race conditions in the U.S.," Moreland said.

Harley-Davidson said it has safeguards in place to educate dealers and customers on the implications of installing Harley performance products on their motorcycles.

"This includes clear product labeling of competition-only products and detail on what performance enhancements are considered street legal and for competition-use only, the legal consequences of tampering with emission controls and components, and what enhancements would void the vehicle warranty," the company said.

“Concern for our U.S. customers and dealers weighed heavily in reaching this compromise with the EPA. By settling this matter, we can focus our future attention and resources on product innovation rather than a prolonged legal battle with the EPA," Moreland said.

The EPA said it discovered the violations through a routine inspection and subsequent information from Harley.

The settlement comes on the heels of other issues that Harley-Davidson has faced with regulators, including a government investigation of complaints from Harley owners who said their motorcycle brakes failed without warning.

The National Highway Traffic Safety Administration said the investigation, announced earlier this summer, covered 430,000 motorcycles with model-years from 2008 through 2011. It stemmed from bikes with an anti-lock braking system, according to NHTSA.

In 2015, Harley recalled 185,000 motorcycles in the United States because the saddlebags could come loose and fall off, increasing the risk of a crash.

Harley said it found the problem through warranty claims. In documents filed with safety regulators, the company said dealers would replace the hardware that caused the problems, free of charge.

The only thing the dealer tells them is the price for the tuner. Many dealers will tell you where to buy an aftermarket tuner online.

IMO, if you don't install the kit & remove the cat, it's too hot on the legs to ride. The EPA is gonna ruin Harley engines, as they're presently constructed.

They are using false/junk science to push this "global warming/climate change" garbage. The facts dispute their wild claims. Killing the economy and putting the FUSA in ruins are their main goals.

From what I read local or state governments have to apply for the funding and it is dispersed at that level. However, I know that in years past, if someone purchased a new stove there was some sort of income tax credit.

There is a group that is pushing for more advanced stoves to minimize pollution. They do come across as environmentalist, but they claim they enjoy being able to burn wood when it comes to in-home wood stoves (Many people don't like the outdoor heaters). They fear that if old stoves aren't changed out, it is likely many areas will ban burning any and all wood stoves. Most of the modern designs means there is zero smoke coming from the chimney. You can only tell the stove is burning during initial start-up and then after it gets going, but seeing the light rays bend in the heat from the chimney. Here is a great list of stoves to consider. I was considering three stoves for the new house, and I picked on that was in the middle of the three emissions wise. If you really burn a lot with wood, I would highly suggest one of the Blaze King models. I almost got the Ashford with its 0.8 emissions rating.

I stand with my convictions.

Where is that? Is that fog? It looks like fog to me.

But, if it is a place like Beijing, then they need to tighten up regs. a bit. I realize that there are places where too much pollution is happening because of carelessness and no common sense where there is a lot of population density.

The earth and the way it is designed with plants and trees, volcanoes, bodies of water, etc. is made to process/absorb CO2. There are cycles of weather that happen repeatedly, and the earth temperature is not rising.

Oh sure, John Kerry will tell you different- such a trustworthy, upstanding guy.

Air pollution is not even the biggest issue facing this planet.

And Global Warming is junk science.
