California becomes first 'sanctuary state' for undocumented migrants

Los Angeles (AFP) - California became the first "sanctuary state" for undocumented immigrants Friday, a decision criticized by the Trump administration which believes the move will compromise security.

California's governor, Democrat Jerry Brown, signed the landmark legislation -- Senate Bill 54 (SB54) -- which grants better protections to people who are in the US without permission, including those who have committed crimes.

It also limits cooperation between local police forces and federal authorities in operations to track down undocumented immigrants.

The legislation, which will come into effect on January 1, 2018, is part of a series of laws which protect the almost 3 million undocumented immigrants living in California -- most of whom are from Mexico and Central America.

Brown insisted in his signing statement the measure will not "prevent or prohibit Immigration and Customs Enforcement (ICE) or the Department of Homeland Security from doing their own work in any way" -- but it will stop local authorities from assisting.

"They are free to use their own considerable resources to enforce federal immigration law in California," he wrote, adding that the new legislation will not deny ICE access to prisons.

But in a statement, ICE acting director Tom Homan responded: "The governor is simply wrong."

The law will "undermine public safety and hinder ICE from performing its federally mandated mission," Homan said.

"Ultimately, SB54 (...) creates another magnet for more illegal immigration," he insisted, adding ICE will have "no choice but to conduct at-large arrests in local neighborhoods and at worksites, which will inevitably result in additional collateral arrests."

ICE said it will also likely send immigrants arrested in California to detention centers outside of the state, "far from any family they may have in California."

A number of cities in California, such as Los Angeles and San Francisco, have already banned police officers from collaborating with ICE on operations to capture undocumented immigrants.

Last week, ICE detained 450 undocumented immigrants in the United States -- 101 of whom were in Los Angeles.

The bill signed into law by Brown also includes assistance for students and measures to combat abuse of tenants.

The country's top immigration cop said Friday his agents "will have no choice" but to conduct workplace and neighborhood immigration raids in light of California's new sanctuary law.

Immigration and Customs Enforcement (ICE) Acting Director Thomas Homan said in a statement Friday that California Gov. Jerry Brown's (D) decision to sign the law, SB54, would "undermine public safety and hinder ICE from performing its federally mandated mission."

Under California's new law, state and local police will have major restrictions in how and when they can collaborate with federal agents on immigration investigations and arrests.

One notable provision in the law is it prohibits so-called immigration holds, requests from ICE to local authorities to hold a prisoner or detainee longer than the constitutionally mandated period.

Opponents say a hold, also known as a detainer, constitutes a violation of a detainee's constitutional rights, and their enforcement puts local authorities at risk of liability.

Supporters, chief among them Homan and Attorney General Jeff Sessions, say detainers are necessary so arrests of dangerous immigrants can be made in the confines of jails and prisons.

"ICE will have no choice but to conduct at-large arrests in local neighborhoods and at work sites, which will inevitably result in additional collateral arrests, instead of focusing on arrests at jails and prisons where transfers are safer for ICE officers and the community," Homan warned.

Still, California's new law allows for ICE agents to interview and arrest detainees in local facilities, as long as they have a judicial warrant, in keeping with due process protections in the constitution.

Homan and others in the Trump administration have long argued that judicial warrants are unviable in immigration enforcement and that detainers are "legally defensible."

Homan also warned that under SB54, ICE would "likely have to detain individuals arrested in California in detention facilities outside of the state, far from any family they may have in California."

"Ultimately, SB54 helps shield removable aliens from immigration enforcement and creates another magnet for more illegal immigration, all at the expense of the safety and security of the very people it purports to protect," Homan said.

But pro-immigrant activists said the law was necessary to protect against what they view as excessive enforcement measures.

"The California Values Act is a stinging rebuke to the nativism of President Trump and his drive to deport millions," said Frank Sharry, executive director of America's Voice Education Fund.

"Trump and Sessions are determined to bully state and local jurisdictions into turning immigrants over to ICE even though it diverts law enforcement from protecting the public. With this and other steps, California is declaring that it wants no part in aiding and abetting Trump’s deportation force," he added.

That should put quite a lot of pressure on Gov Brown to stop doing this......when families have no access to those arrested, who might not have committed any crime(other than illegality) start to complain bitterly about no visitation and their spouses sent out of the country, this will stop.

Regarding detainers past the constitutional limits?
Since when do non-citizens have rights under the constitution?
They are already criminals.
Why can't ICE show up within 24 hours?
Show up every day, harvest whatever is there.

The head of the federal deportation agency said Friday his agents will now have to go out into communities in California even more frequently to round up illegal immigrants, now that the state has embraced a full sanctuary policy.

Tom Homan, acting director of U.S. Immigration and Customs Enforcement, made the comments a day after California Gov. Jerry Brown signed SB54 into law, canceling almost all cooperation state and local authorities can give to federal deportation officers.

He said the effect could be even more rank-and-file illegal immigrants snared because federal officers will now have to operate out in the community, rather than focus chiefly on prisons and jails.

“ICE will have no choice but to conduct at-large arrests in local neighborhoods and at worksites, which will inevitably result in additional collateral arrests, instead of focusing on arrests at jails and prisons where transfers are safer for ICE officers and the community,” Mr. Homan warned.

Thanks to the law’s restrictions on the ability of the private prison industry to hold illegal immigrants in California, Mr. Homan said his agency will also have to ship those being detained to facilities outside the state, making it even tougher for their families to visit them.

The new law also voids a specific cooperation agreement ICE had with the Orange County Sheriff’s Office under the 287(g) program, which had allowed local authorities to identify and prepare deportable aliens within their jails to be turned over to ICE.


“These are uncertain times for undocumented Californians and their families, and this bill strikes a balance that will protect public safety, while bringing a measure of comfort to those families who are now living in fear every day,” Mr. Brown said in approving the law.

Immigrant-rights activists also cheered the legislation, with Frank Sharry, executive director of America’s Voice, calling it a “stinging rebuke” to President Trump.

“With this and other steps, California is declaring that it wants no part in aiding and abetting Trump’s deportation force,” Mr. Sharry said.

Mr. Homan’s statement, though, suggests the paradox of sanctuary cities.

The goal is often to thwart immigration enforcement efforts, but that usually means protecting those who have come in contact with prisons or courts — including convicted criminals — that local authorities then refuse to turn over to waiting ICE officers.

Instead, the officers must try to arrest them at their homes or jobs out in the community — where their family or other illegal immigrants around them could also be arrested.


But it also takes more manpower — perhaps a full team of a half-dozen officers — to conduct an arrest in the community.

That means fewer illegal immigrants overall may be arrested, but more of them could be collateral arrests rather than the criminal targets all sides say should be the priority.

Republicans in Washington have called for a pushback against sanctuary cities and states, with a bill clearing the GOP-controlled House earlier this year.

Meanwhile a number of legal challenges — both for and against sanctuary cities — are making their way through the federal courts.

As financially strapped as the state is, one would think people would be complaining about the dams, roads, pensions, etc.

Their elected governor/mayors/city councils/politicians are spending their hard-earned money on illegals - sucking from the system.

Californians must like supporting millions of illegals.

Hope President Trump and DOJ can defund the state every way they can - because California would have plenty of money to take care of it's citizens/state is it didn't dump billions into the illegals. And sending California money would be supporting their extravagant/wasteful spending.

In effect, all the illegal aliens in Cali who voted for Hillary and violated Federal Election laws gave been given an amnesty from the authorities pursuing prosecution.

Part of the currently floated tax proposal does that by eliminating the state tax deduction...
