The controversial climate bill that is set to be taken up by the Senate on Monday after its passage in the House will legislate home inspections by government regulators who will demand to audit every aspect of your property under the threat of substantial and repeated fines if their visits are denied or their demands not satisfied.

The climate legislation is written in a manner that automatically assumes that global warming is taking place and that it is attributed to rising CO2 levels, despite the fact that this is a highly contentious question and is being rejected by more and more scientists as time goes by.

As Tony Pacheco writes in his excellent article today, the bill will "audit every aspect of your home and life".

The bill states every home owner will receive an energy audit. What is a home energy audit? It is an intrusive visit made by the bureaucrats at the Home Energy Team or a similar group. They will examine and report the way you live your life directly to RESNET (Residential Energy Services Network) . Light fixtures, socket types, spas, hot tubs, windows, appliances, walls and roofs will all be under review. Energy tests will be conducted throughout your house. At the end of the visit you will receive a report and a rating. The report will focus on the changes you need to make and the rating is called a HERS rating (Home Energy Rating System). RESNET will perform the audits through authorized contractors. RESNET has adopted the Mortgage Industry National Home Energy Rating Standards. The standards set the national procedures for home energy ratings.

According to RESNET, an audit consists of:

Comprehensive Home Energy Audit - A level of the RESNET Home Energy Audit process defined by this standard to include the evaluation, diagnosis and proposed treatment of an existing home. The Comprehensive Home Energy Audit may be based on a Home Performance Assessment (“Comprehensive Home Performance Energy Audit”) or Home Energy Rating (“Comprehensive HERS Audit”), in accordance with the criteria established by this Standard. A homeowner may elect to go through this process with or without a prior Home Energy Survey or Diagnostic Home Energy Survey.

Regulations already in place in some cities for non-residential buildings already carry fines of $2000 a time for preventing bureaucrats from carrying out inspections. These will simply be expanded to cover all premises under the new climate bill.

Under the RESNET standards for a home audit, the following procedures will become law under the climate bill.

704.1.2.3 The Home Energy Survey Professional shall request copies of utility bills or written permission to obtain the energy use information from the utility company, and use them to produce an estimate of generalized end-uses (base, heating, and cooling).
704.1.2.5. Minimum Procedures for an In-Home Energy Survey:
704.1.2.5.1.1 R-values of wall/ceiling/floor insulation
704.1.2.5.1.2 Square footage and approximate age of home
704.1.2.5.1.3 Type of windows: glazing type(s) and frame material(s)
704.1.2.5.1.4 Type, model number, and location of heating/cooling system(s)
704.1.2.5.1.5 Type of ductwork, location and R-value of duct insulation, and any indications of previous duct sealing
704.1.2.5.1.6 Type of foundation is crawl, basement, or slab
704.1.2.5.1.7 Checklist of common air-leakage sites indicating likely opportunities for leakage reduction
704.1.2.5.1.8 Estimated age and efficiency of major appliances such as
dishwashers, refrigerators, freezers, washing machines and dryers
704.1.2.5.1.9 Number and type of hardwired light fixtures and screw-in bulbs in portable lamps suitable for energy efficient re-lamping
704.1.2.5.1.10 Visual indications of condensation
704.1.2.5.1.11 Presence and location of exhaust fans, and determination of whether they are vented outdoors
704.1.2.5.1.12 Number and type of water fixtures (e.g. faucets, showerheads)
704.1.2.5.1.13 Presence and type(s) of combustion equipment; identification of visually identifiable evidence of flame rollout, blocked chimney, and corroded or missing vent connector.

As we have warned, the climate bill is nothing more than a feast for bloodthirsty government vampires, who are ready and waiting to suck off the fat hog of the American taxpayer once more.

Ohio Republican Senator George Voinovich says it will take a "miracle" for the Senate to pass the controversial climate bill next week, meaning that the legislation won't be in place before United Nations climate talks in Copenhagen in December.

The Senator told Bloomberg News that the bill contains "a lot of crap" and that cutting CO2 emissions by 17 per cent before 2020 was an unobtainable goal.

Voinovich's prediction that the bill will fail is echoed by Senator James Inhofe of Oklahoma, who said that the “razor-thin vote in the House spells doom in the Senate.”

However, Senator John Kerry claims that the bill will pass the Senate next week but that there won't be enough sway to approve a global treaty that commits other nations to follow the same regulations.

No, I'm serious. They can't enter your domecile without cause. It's guaranteed by the Constitution. (Um, yeah, I know their thoughts on that.)

A magistrate can "allow" search if he is convinced that you're doing something illegal and a search will reveal proof of it. Since when did having a drafty old house become illegal? Mebbe it's the best house you can afford?

I have a 27 year old Maytag Washer & Dryer. It uses a LOT of water. I'm sure it wouldn't get an EnergyStar rating on anything. But they're paid for. And they LAST. And it's cheaper and more forgiving of the environment to use them than it would be to make new ones and dispose of the old.

Now like Massachusetts Title 5 (Septic Environmental conformance) I could see tying you up in transfer of title or getting a mortgage or some other action where you need support of TPTB in order to perform an act, like selling/buying a house with protection of law. But in this case you WANT something from the government and you have to GIVE something in return. Part of the privilege of buying/selling a house, I guess.

But I can't see mandatory inspection without cause. It's been ruled out previously in similar circumstances as "fishing expeditions." And I think of "he uses too much energy" as insufficient cause. I'm paying for the energy, after all. And it may be my only choice.

Or don't we have choice any more? If not then we might as well drink our last chug of the Freedom Cola right now and then go dig out the pitchforks.

This is yet another prime example of just how out of touch with reality politicians are.............

Much as I adore vintage structures, much as both my better half I put into restoring structures, I would never again do so, if it meant having to bring a structure from the 1700's, 1800's or the better part of the 1900's, into 'eco-terrorism' compliance standards.

Firstly it would prohibitatively costly and just doing a proper, historic restoration, ain't cheap. Trust me, even doing all the work oneself, it doens't come cheap. Secondly if money were no object, to bring a vintage structure into compliance would likely mean compromising its architectural and historic integrity. I've seen the horrors done in the name of bringing vintage structures into ADA compliance. While it can be done without altering the design; too often it's done in a manner that is not consistant or sensitive to the orginal lines of the structure.

Also ..... Consider this: WHile there's huge potential for municipalities (or the feds) to turn this whole 'inspection' thing, into a cash cow ....... There's also a huge potential for it to become a real political power grab ....... Imagine the average homeowner trying to sell their home in thei market now being burdened with having to sink money into it to make it compliant AND to pay for inspecting, too. Think that there won't be those who try to line their pockets in the process?

So........ How's the bozo in charge and his cronies going to respond to the masses who can't sell their otherwise decent and safe homes, because they either can't afford to retrofit it OR because the structure CANNOT be retrofitted.

When we built our home in CA we were under more intense scrutiny than most because my better half was a chief building inspector. Back then new homes had to meet a certain energy efficienty rating to get past plan check .. No problem; we'd designed and built our home to far exceed the minimum threshold ....... We had to pass a very thorough design review because we were building in a 'historically significant' neighborhood; no problem, we designed a house that errily looked like the one which had been our our lot from the 1880's but burned down in the 1970's ..... (didn't know that till after we moved in) ....... All the plan checks and building inspections were done by second parties so there couldn't be any question of our being treated to different standards.

In MN we restored a 120 year old house that had been, for decades, trashed by the locals who had gutted it and turned a single family home into three nasty apartments and nary a penny spent on little things like wiring to code or plumbing or anything. That home, while a perfect restoration and also brought up to current code with all new romex wiring (though knob & tube is safe, per se; the wire itself is no way capable of handling todays' electrical usage), copper plumbing, roof, rebuilding all the old 'wavy glass' double hung windows ......... But there's no way we could have brought that house up to the energy efficiency standards that cap & trade will require..........

Need to stop now ... The more I think about this, the more disgust I find myself feeling, for all those responsible for the current pack of traitors, buffons, bozos and bast@rds in the government.......

We are building a new home and so I'm not all that worried as everything on the list is covered, but we live in an area of a lot of low income and retired folks that I know their houses won't pass a test like this.

I wonder (if passed) what the govt will do about people that just can't afford to revamp their houses. Kick them out? Have a govt program, like they used to when they came out and insulated peoples houses and fix them up?

And if you are in a rental....and the landlord gets slammed with a huge 'fixup' bill. Your rent will skyrocket.

Now do think that this will be the beginning of the opening of a can of worms.
How many people will not go along with this that what will the government do
when people refuse for their homes to be audited. And what will be the local
law enforcement's position be on this? Will they end up taking the side of
the Feds or will the local sheriffs and police take the side of their local
residents? And what will happen once some Inspectors get shot? And what
happens if a place is audited but the resident refuses to make the changes
that the Fed. Home Inspectors want? One cannot get blood out of a turnip.
Could it be the start of Civil War version II? It would not take much now to
set it off bigtime.

I personally do not own a home but just rent a place during the winter. How
much during the summer am up in the wilds. Right now back in town for just a
couple of days then back into the wilds to be with the ggrizzlies again. And
out there in the wilds, I don't expect some Inspectors coming by my tent to
take a look at things. In fact as regards to most of the local rangers where I
hang out .... we get along great!

Personally all of this Cap and Trade which is really the Feds controlling and
inventoring every aspect of our lives along with this mandatory health care
crap. Do think that this Cap - Trade - and Tax will be the undoing of so many
of these Environmental Organizations. Once people are being taxed bigtime
for their CO2 emissions and Global Cooling really begins in earnest, you will begin
to see the people revolt bigtime . It will be Bye Bye Sierra Club and every other
Environmental Group and their socialist agenda and controlling people agendas
which is how much a part of this NWO crowd. If one looks closely how many are
already starting to rebel against these Insane Environmental Nitwits.
