President Trump’s campaign is seeking public records in Clark County, Nevada, as part of the president’s greater legal challenges regarding election integrity in battleground states.

In a Friday letter to the Clark County Election Department, a firm representing Donald J. Trump for President, Inc. requested a trove of election data as part of his campaign’s overall legal challenges related to election integrity.

The letter contains requests for records, documents, and communications on the number of mail-in ballots received by the department after 7 p.m. PST on Election Day, as well as how many votes were cast after that time “by those voting in person at the polls.”

Per the letter, the campaign is also requesting:
  • All records, documents, and communications indicating how many votes were cast by individuals who were not in line to vote at the time the polls were closed at the precinct in which the vote was cast.
  • All records, documents, and communications indicating how many ballots have been received without a postmark.
  • All records, documents, and communications showing all efforts taken by the Clark County Department of Elections to verify the Nevada residency of individuals who were mailed a ballot in the 2020 primary election and whose ballot was returned to the Department of Elections by the United States Postal Service. Include any records showing efforts taken to verify such residency in advance of any such voter being sent a ballot during the 2020 general election.
  • All records, documents, and communications evidencing coordination between the Clark County Department of Elections and the Nevada Department of Motor Vehicles taken to ensure those individuals needing to obtain an identification to cure their provisional ballot can obtain one.
  • Each ballot designated spoiled and not counted for that reason.
  • All mail in ballot envelopes from voters who are also recorded as having voted in person.
  • All in-person voter sign-in forms reflecting appearances at polling places by voters from whom a mail-in ballot was also received.
The department had five days to respond from the time of the letter, per the Nevada Open Records Act. The firm stressed that the information requested is in the public interest and will “contribute significantly to the public’s understanding of the local processes and procedures in Clark County and further ensure the right of the citizens of Nevada to a free and fair election.”

The firm also requested that, in the event of the department denying the request, it provides a justification for refusing to release the requested information.

While the mainstream media has called Nevada and the election for Joe Biden (D), President Trump’s campaign insists that the race is not over and litigation is just beginning.

A Sunday update from the New York Times showed Biden leading Trump in the Silver State by just over 31,000 votes. The same data showed Biden leading Trump in Clark County, specifically, by just over 86,000 votes.

On Saturday, a whistleblower in Nevada who processed mail-in ballots swore an affidavit proclaiming that he witnessed “illegitimate processing of ballots as an election worker.” Specifically, he claimed he witnessed individuals counting mail-in ballots without verifying signatures.

“He says he was also told to ignore discrepancies with addresses. That worker has sworn out an affidavit which has been sent to the Department of Justice here in Washington,” Fox News’s John Roberts reported.

“A Trump campaign attorney says of that, quote, ‘The affidavit makes clear that we’re not dealing with oversights or sloppiness. This was intentional criminal conduct,'” he said:

Clark County Registrar of Voters Joe Gloria said they have received reports of voter fraud, but will not investigate them until the election is completed.

“We do have some reports that have come in that we’re logging for reporting. But we’re definitely going to do an investigation, and we’ll deal with them once the canvass is finished,” Gloria said Saturday.

“The votes are in the system at this point, so we’ll have to after the election, post-election, go after anything that’s been reported at this time,” he added:
.@ClarkCountyNV asked for proof. We have presented proof.
But, they won’t get around to investigating until after the election… Nevada's Clark County elections chief has reports of voter fraud, won’t investigate until counting complete

On Saturday, Georgia Secretary of State Brad Raffensperger (R) announced that investigators are being dispatched in Fulton County following the discovery of an issue related to reporting. The investigators are to “thoroughly secure the vote and protect all legal votes.”

Brendan Keefe of Atlanta’s WXIA said the issue “*may* significantly affect the current Biden lead in Georgia.”

Watch Live: Trump Campaign Press Conference After Giuliani Warns Of Election-Changing Evidence In PA

Sun, 11/08/2020 - 17:24

Following earlier comments by Rudy Giuliani that the Trump campaign has evidence that may change the results of the presidential electoral map, the Trump campaign is holding a press conference from the Clark County Elections Department in Nevada.
Here’s another look at the crowd. They are chanting “stop the steal.” Important to note: @NVSOS says there is NO evidence of widespread voter fraud in #Nevada, & @ClarkCountyNV Registrar of Voters Joe Gloria told us he has heard no reports of illegitimate ballots. @8NewsNow #8NN pic.twitter.com/HlEkIP7ZCg

Those in attendance include former Nevada Attorney General Adam Laxalt and Chairman of the American Conservative Union Matt Schlapp.

Trump supporters are holding a prayer vigil.

The campaign press conference is due to start at 1430ET:

As PJMedia's Matt Margolis reports, in an interview with Maria Bartiromo on Fox Business, Giuliani said as many as 900,000 invalid ballots were cast in Pennsylvania, and that the Trump campaign will reveal this evidence in court.
"These are facts of fraud," Giuliani told Bartiromo.
Bartiromo asked Giuliani if the Trump campaign believes it has enough evidence that it could alter the apparent results of the election.
“Well, I think we have enough to change Pennsylvania. The Pennsylvania election was a disaster,” Giuliani replied.
“We have people that observed people being pushed out of the polling place. We have people who were suggested to vote the other way and shown how to do it. I’m giving you the big picture.”
President Trump has insisted that the media has called the race for Biden prematurely.
“Joe Biden has not been certified as the winner of any states, let alone any of the highly contested states headed for mandatory recounts, or states where our campaign has valid and legitimate legal challenges that could determine the ultimate victor,” President Trump said in a statement on Saturday.
Additionally, Trump tweeted this afternoon:

Trump Campaign To Challenge Mail-In Ballots Counted In Absence Of GOP Observers In Battlefield States

Sat, 11/07/2020 - 21:15

Authored by Allen Zhong via The Epoch Times,

President Donald Trump’s reelection campaign will launch a lawsuit in Pennsylvania to challenge the mail-in ballots that have been counted without Republican poll watchers onsite.

Rudy Giuliani, Trump’s attorney announced Saturday the lawsuit during a press conference in Philadelphia, Pennsylvania, with several Republican poll watchers who were prevented from entering the poll sites or the rights of poll-watching were blocked.

A federal lawsuit will be filed on Monday in Pennsylvania and more expected in other states.
“We’re going to file a federal lawsuit that will cover here [Philadelphia] and Pittsburgh, and we will have as many witnesses as the court needs. Right now, it could be as many as 90 witnesses,” Giuliani said.
Several witnesses joined Giuliani during the press conference, all are local Philadelphia residents.
Lisette Tarragano, one of the witnesses, said she was never allowed to enter the polling site along with other five to six Republican poll watchers.

“I was never brought in. Actually, I never got past the first identification stage, they kept saying that mine as well as five or six other Republicans, their names hadn’t been entered into the system,” she said.
Two other poll watchers, Darrell Brooks and Matt Silver said they were kept 15 to 20 feet away from the ballots.

Silver also alleged that some unusual ballot boxes were witnessed inside the polling site.
“There seem to be at least certain boxes seem to be in the same unusual pen, and seem to have very similar handwriting. Some boxes were normal, some boxes were like that,” he said.
The Biden campaign, the Office of Philadelphia City Commissioners, the election division of Allegheny county government, and the Pennsylvania Department of State didn’t immediately respond to requests for comment from The Epoch Times.

It was reported that a Republican poll watcher was temporarily blocked on Election Day in Philadelphia.

Kevin Feeley, a spokesman for the Philadelphia City Commissioners, admitted that the one poll watcher was prevented from entering the polling site on Nov. 3.
“The mistake was corrected, and the guy was admitted,” he said, claiming it was an isolated incident.

During the election night, Trump led when the ballot canvassing started in several swing states including Pennsylvania. But the lead was diluted by the lately-counted mail-in ballots. In Pennsylvania, Democratic party presidential candidate Joe Biden took a slight lead after the mail-in ballots were counted.

Because the results are very close and several lawsuits are ongoing over the election outcome in several battlefield states, it’s more and more clear that this election will be settled through the judicial system.

The expected lawsuit by the Trump campaign will start another battle line over the outcome of the election in some swing states: mail-in ballots counted without Republican observers.

Over the past few days, Trump has been vocal over the need to protect the sanctity of the ballot box while claiming that Democrats are trying to “steal” the election from him due to efforts to count late-arriving ballots, which he alleges are “illegal.” He and his legal teams have been arguing that mail-in ballots postmarked by Nov. 3 but received after election day should not be counted and that votes that were counted without Republican observers present in the ballot-counting centers should also be considered “illegal votes.”

The U.S. Supreme Court Justice Samuel Alito late Friday ordered Pennsylvania election officials to segregate ballots that arrived after Election Day.

I hadn't seen anything like this up yet - if it's a dup or if it belongs elsewhere, that's fine.

I just thought it'd be a good idea to have a thread to track ACTUAL legal challenges to the election, court rulings, recounts, etc. I think the President’s team indicated it would all start today.

Note, this is separate from any reports or rumors not connected with an actual proceeding. For instance, someone may claim they know a million ballots were fraudulent in MI, but if that's not part of a lawsuit or being proven by a recount or other official act, this wouldn't be the thread for that report.

These are the "official" (AP, etc) latest numbers in the contested states. Not saying I believe them, but this is in all likelihood what the Trump team is up against and would need to prove wrong:

Nevada - called for Biden, 94% reporting, Biden ahead almost 15K

Arizona - some called for Biden, 98% in, Biden ahead about 17K

Wisconsin - called for Biden, up 20K, likely recount

Michigan - called for Biden, up 146K

Pennsylvania - Called for Biden, up about 46K

North Carolina - Not called, Trump ahead 75K

Georgia - Not called, Biden ahead 10K, likely recount

Alaska - Not called, Trump ahead 55K with half reporting. I don't expect this to be contested - will go Trump.

Daniel Cameron joins Republican AGs in challenging Pennsylvania mail-in ballots

3-4 minutes

Two days after former Vice President Joe Biden was declared the winner of the 2020 presidential election, Kentucky's attorney general will join other Republican AGs Monday in taking "major legal action" in the case challenging Pennsylvania's mail-in ballots.

A Sunday media advisory, which mentioned Daniel Cameron's involvement, did not specify what action is being taken. But it's presumed a lawsuit will be filed related to the mail-in ballots in the state that gave Biden the electoral college win over President Donald Trump.

The Philadelphia Inquirer Sunday evening reported Trump’s legal team will contest Biden's win, starting with a federal suit to be filed Monday alleging that the commonwealth's two largest cities — Philadelphia and Pittsburgh — were awash in vote fraud.

Cameron, a political protege of Senate Majority Leader Mitch McConnell, was elected as Kentucky's top law enforcement officer in November 2019. He and attorneys general of Louisiana, Georgia and Missouri, will hold a virtual press conference at 2:30 p.m. Monday to announce their plans.

"The Republican AGs are already stepping up to the frontlines as 'America's insurance policy' against the possibility of a Biden-Harris Administration and their liberal extremist agenda," the advisory stated.

Pennsylvania is one of a few states which did not begin processing and counting absentee ballots until Election Day morning. The U.S. Supreme Court ruled in October election officials in Pennsylvania can count absentee ballots received as late as three days after Election Day as long as they were postmarked by Nov. 3.

Likewise, Kentucky's general election rules allow absentee ballots postmarked by Election Day to be counted as long as they are received within the next three days. Cameron has not challenged Kentucky's rules.

On Friday night, Supreme Court Justice Samuel Alito, who handles emergency appeals from Pennsylvania, ordered the state's county elections officials to keep separate mail-in ballots that arrived after Election Day.

Before Alito's decision, the state’s top elections official had ordered those ballots be kept apart. But Alito acted after the state Republican Party said they couldn't be sure election officials are complying with guidance, which was issued by Pennsylvania Secretary of State Kathy Boockvar, a Democrat.

The order is related to an ongoing Republican appeal to the Supreme Court to try to keep ballots received in the mail after Election Day from being counted. The state’s top court granted a three-day extension, and the Supreme Court refused to block it.

READ: The Letter 39 GOPers Sent to AG Barr Over Alleged Voter Fraud

A coalition of 39 House Republicans on Saturday sent a letter to Attorney General William Barr, asking the Department of Justice to investigate allegations of potential voter fraud. According to the members, it's important for Americans to have "the utmost confidence" in the outcome of the 2020 presidential election.

Below is the full letter:
Dear Attorney General Barr,

While each state runs its own election process, the United States Department of Justice is ultimately responsible for the integrity of federal elections. The American people must have the utmost confidence that the outcome of the presidential election is legitimate.

With widespread reports of irregularities, particularly in the vote counting process, it is time for you to use the resources of the Department to ensure that the process is conducted in a manner that is fully consistent with state and federal law. And, it is also important that the process be completely transparent, so that the American people will have full confidence in the result.

The Justice Department's Civil Rights Division Voting Section's responsibility to ensure that the right to vote is sacred. This not only means access to the ballot box, but it also means ensuring that no one's vote is devalued by any means of voter fraud.

The U.S. Marshals Service is also available to ensure that judicial orders are carried out. When it comes to a federal election, it should not matter whether those judicial orders come from a state or federal court. For example, if a state court orders that observers can watch ballot counting in a federal election, no local election official should be able to defy that order.

With that in mind, we request an immediate response to the following questions. What are you doing to ensure the integrity of the voting and counting process right now? Will you commit to using all the resources at your disposal to ensure that only legal votes are being counted and being counted in a fully transparent and manner immediately?

Thank you for your prompt reply.

Signatories include: Michael Cloud (TX) , Andy Biggs (AZ), Greg Steube (FL), Bob Gibbs (OH), Bill Posey (FL), Ralph Norman (VA), Morgan Griffith (VA), Jeff Duncan (SC), Ted Budd (NC), Mark Green (TN), Andy Harris (MD), Scott DesJarlais (TN), Dan Bishop (NC), Jody Hice (GA), Mike Kelly (PA), Randy Weber (TX), Brian Babin (TX), Chip Roy (TX), Robert Latta (OH), Ben Cline (VA), James Comer (KY), Guy Reschenthaler (PA), Warren Davidson (OH), Scott Perry (PA), Jim Banks (IN), Rick Allen (GA), Roger Marshall (KS), Doug LaMalfa (CA), Bill Flores (TX), Bill Johnson (OH), Michael Conaway (TX), Kevin Hern (OK), Glen Grothman (WI), Tom Emmer (MN), John Joyce (PA), John Rose (TN), Lance Gooden (TX), Jodey Arrington (TX), and Dan Crenshaw (TX).

Other elected officials, including Sen. Ted Cruz (R-TX) and Gov. Kristi Noem (R-SD), have said the court process needs play out before a definitive winner of the presidential election can be determined.

Despite multiple members of the press saying they need more "evidence" of what's taking place, these instances are being ignored. The same thing goes for United States Postal Service whistleblowers who have stepped forward to say postmasters are backdating the dates ballots were received.

There have been a string of USPS whistleblower cases that Project Veritas has made public. Project Veritas released their first video of a United States Postal Service worker in Traverse City, Michigan, coming forward to expose their supervisor, Johnathan Clarke, potentially engaging in voter fraud. The second video released Thursday afternoon allegedly shows a USPS worker in Las Vegas, Nevada, talking about handing over a "handful" of ballots to an undercover journalist. The blank ballots were collected because they were allegedly sent to the wrong address.
The third video was Hopkins' original report. Video number four was of a USPS whistleblower in Coraopolis, Pennsylvania who claimed supervisors and other higher-ups are ordering carriers to backdate ballots received after Election Day.

Voter fraud is such a concern that the Michigan State Legislature convened a rare Saturday session to address it. One of the main focuses was a software glitch that caused 6,000 votes in Antrim County to be incorrectly counted for Joe Biden. Once the a hand-count had taken place, those 6,000 votes went to President Trump. The Michigan Secretary of State, however, has said that this was "human error," not a "software glitch."

Umm---NOTHING some "news media outlet" makes this the OFFICIAL vote count.

If memory serves, it is CONGRESS that RATIFIES the results of an election--NOT the media.

And if there is a question, then it goes to court---which it is.

So I give these "figures" about as much credence as I do Santa Claus---not even AS much, for that matter....

A claim, but by Giuliani, who I expect to be a major player in the legal fight:

Rudy Giuliani: Trump campaign has enough evidence to change Pennsylvania election results

President Trump's attorney Rudy Giuliani said he has evidence that may change the results of the presidential electoral map.

In a Sunday interview with Fox News host Maria Bartiromo, Giuliani said the lawsuits being filed by the Trump campaign might reveal that up to 900,000 invalid ballots were cast in the state of Pennsylvania, a key election swing state several news outlets projected presumptive President-elect Joe Biden would win. "Do you believe that you have enough to actually change the fate of the election?" Bartiromo asked.

"Well, I think we have enough to change Pennsylvania. The Pennsylvania election was a disaster," Giuliani said. "We have people that observed people being pushed out of the polling place. We have people who were suggested to vote the other way and shown how to do it. I'm giving you the big picture."

Giuliani described details of its investigation in Pennsylvania, which may translate to new lawsuits this week, as early as Monday. He alleged Republican observers in Pittsburgh, Pennsylvania, were "kept out of the room or kept away from the room" for 24-hours where mail-in ballots were counted, adding that 135,000 ballots were counted during that time period.

"Even though we went to court, and we were allowed to move 6 feet closer, the Democrat-machine people moved the counting place six feet further away. This is documented on videotape. There are upwards of 50 witnesses," Giuliani said, which would be the subject of a Monday civil rights lawsuit on Monday.

Giuliani said the Trump team was also looking into whether ballots were cast in the name of people who are already dead and if ballots were "back-dated."

"We have evidence now, from not only the Post Office but from others, that there was back-dating. I can only tell you right now that that amounts to about 2,000 or 3,000 votes," Giuliani said.

In any event, I only present them as a possible starting point for what any legal proceeding would be challenging as to validity.

Arizona: Trump Lawsuit Alleges ‘Incorrectly Rejected Votes’ After Cutting Biden Lead To Nearly Half A Point

The Trump campaign has sued Arizona’s Maricopa County alleging that poll workers may have disenfranchised thousands of in-person voters on election day by incorrectly handling some ballots.

The campaign announced its lawsuit in a press release on Saturday, claiming that some ballots cast on election day were marked as “overvotes” by the machines processing them, meaning the machine found that more votes were marked on the ballot than is allowed. Many overvote ballots were then canceled instead of being taken by a poll worker and counted by hand, the lawsuit says.

“When a machine detects an overvote on a ballot, poll workers should inform in-person voters of the error and give them an opportunity to correct the issue. Instead, poll workers in Maricopa County pressed, and told voters to press, a green button to override the error,” the press release said.

“As a result, the machines disregarded the voter’s choices in the overvoted races. The campaign has collected declarations from voters who witnessed the problem and alleges that the problem occurred on a large scale in Maricopa County.”

Trump campaign general counsel Matt Morgan issued a statement blaming poll workers for improperly directing voters on how to use new voting machines.

“Poll workers struggled to operate the new voting machines in Maricopa County, and improperly pressed and told voters to press a green button to override significant errors,” Morgan. “The result is that the voting machines disregarded votes cast by voters in person on Election Day in Maricopa County.”

As outstanding ballots in the state continue to be tabulated after election day, with thousands left in Maricopa County, Trump continues to cut into Biden’s lead in the state. Biden now leads Trump in the state by just over half a point at .56%. Data Orbital, a Phoenix-based data analytics and survey research firm, projected Trump winning the state early last week based on outstanding votes still to be counted.

“There are ~108k ballots left, of which ~45k are provisional. Current statewide margin for Biden is 18,610 and .56%. We expect the margin to continue to tighten as additional ballots are counted. We expect Maricopa this afternoon and others likely, as well,” Data Orbital posted on Twitter late Sunday morning.

News outlets called the presidential race for former Vice President Joe Biden on Saturday, most after projecting that the Democratic presidential nominee would win Pennsylvania, a key battleground state. The calls may be premature, however, as the Trump campaign pursues legal action against allegations of fraud and improper access to vote canvassing operations across several battleground states, including Arizona.

The Trump campaign issued a statement on Saturday after most outlets called the race for Biden refusing to concede the election while its lawsuits were being litigated through the courts.

“The simple fact is this election is far from over,” the statement said. “Joe Biden has not been certified as the winner of any states, let alone any of the highly contested states headed for mandatory recounts, or states where our campaign has valid and legitimate legal challenges that could determine the ultimate victor.”

I think we should expect a counter lawsuit from the dark side challenging those states that have been called for Trump. I'm sure I am not the only one who remembers the first line in Vector7's signature:

I will pull pleadings from PACER once the suits are filed and can post the pdfs here. I just need to know the court and name of the plaintiff (Trump, Trump Campaign, Republican Party, etc.). Already did some searching but didn't see anything yet.

The Nevada Republican Party has sent a criminal referral to the Department of Justice and Attorney General William Barr claiming to have found thousands of examples of voter fraud.

According to a report from the Daily Wire, the Nevada Republican Party released a confirmation revealing that it has officially had lawyers send a special request to Barr regarding at least 3,062 instances of voter fraud.

The Nevada Republican Party sent a criminal referral to the Department of Justice on Thursday alleging thousands of examples of voter fraud.

“Our lawyers just sent a criminal referral to AG Barr regarding at least 3,062 instances of voter fraud,” the Nevada Republican Party said in a statement. “We expect that number to grow substantially. Thousands of individuals have been identified who appear to have violated the law by casting ballots after they moved from NV.”

Fox News reported that a Justice Department spokesperson confirmed to the network that the criminal referral was received and that “attorneys will follow the standard practice of investigating.”

CBS News correspondent Catherine Herridge tweeted out a photo of the letter that the party’s legal team sent to Attorney General William Barr.

“This firm, in conjunction with Harvey & Binnall, PLLC, represents Donald J. Trump for President, Inc. We write to bring to your attention criminal voter fraud in the state of Nevada in the 2020 general election,” the letter states. “Specifically, we have initially identified 3,062 individuals who appear to have improperly cast mail ballots in the election.”

“We verified this by cross-referencing the names and addresses of voters with the National Change/of Address database,” the letter continued. “Enclosed, please find a letter sent to Joseph Gloria, the Clark County Registrar, outlining our findings.”

“We also anticipate that the final list of fraudulent ballots will grow substantially and we will update you as we learn more,” the letter continued. “Of course, voter fraud is a serious federal felony, one that cuts to the heart of our representative democracy. We understand that these are serious allegations and we don’t take them lightly.”

A press release this afternoon from Nevada Secretary of State Barbara Cegavske stated:

After this morning’s vote tally update, approximately 190,150 ballots statewide remain to be counted. Of this total, 123,554 are ballots that were either returned by mail or dropped of in person at a ballot drop-off location. The remaining 66,596 are ballots that were cast in person at a polling place, either during early voting or on Election Day, by voters who took advantage of Nevada’s new same-day voter registration law. Of the total ballots remaining to be counted, 90 percent are in Clark County.

Under Nevada law, mail ballots postmarked on or before Election Day and received no later than 5:00 pm on November 10 will be counted. This means there is an unknown number of ballots currently in the U.S. Postal Service mail stream that contain a postmark dated November 3 or earlier that will ultimately be counted if they arrive by 5:00 pm on November 10. We cannot estimate with any degree of accuracy how many ballots might fall into this category.

In addition to the approximately 190,650 ballots remaining to be counted, there are two categories of ballots that are uncounted and will remain uncounted unless the voter takes the required action necessary for the ballot to be counted. First, there are approximately 2,500 provisional ballots that were cast under the requirements of the Help America Vote Act (HAVA). These ballots will only be counted if the voter satisfies the required conditions by 5:00 pm on November 6. Second, there are approximately 3,500 mail ballots that require a signature cure. A signature cure is needed if the voter forgets to sign their ballot return envelope or if the signature on their ballot return envelope does not match the signature on file for the voter. Voters have until 5:00 pm on November 12 to successfully cure their signature.

Under state law, all ballots must be counted by the end of the day on November 12. This means complete unofficial election results will not be available until the morning of November 13. Election results do not become official until after certification. Certification must occur on or before November 16. For more information about the post-election processes in Nevada, see the FAQs posted on the Secretary of State’s website.

The coding is what is interesting. My son is an Engineer and does coding. And said it is so easy to manipulate election results with using computer equipment. I have known this for years.

My state of Pa. brought in the paper ballots as backups this year and they have that dam Dominion system. We use to be just electronic voting. But the manipulation can still happen with code verse ballots. Especially in high density populations where you can increase fake votes to achieve a winning result.

If Michigan saw issues with software count and the tape count I do believe this issue is not just in one area.
You have an issue with the code. Trump needs people to go and do forensics on the code. It may be to late- it may have been wiped clean or it it could be still there. But code can manipulate totals, twist votes for another party, increase or decrease votes with algorithms.

I too can not understand how an old basement dweller whom can not get 10 people to come out to see him in their cars wins over a man who can fill stadiums with 52 thousand people.

This just tells me a coup was implemented.

They wanted him out. I am sure Washington were scared Trump was going to expose even more money laundering and treason against our Country by the Venomous Raptors.

A Hierarchy that is self served and lives as Kings and Queens and petitions the lower class to follow the rules they write.
This no longer feels or sounds like America- But More like what our Founders fled (Old England).

Trump Campaign Files First Election Fraud Lawsuit; Ohio AG Asks Supreme Court To Overturn PA Ballot Ruling

Mon, 11/09/2020 - 18:09
  • Trump campaign files lawsuit in Pennsylvania
  • Ohio Attorney General has joined a bid to ask the US Supreme Court to toss the Pennsylvania Supreme Court's late-October ruling allowing late ballots to be counted.
  • Two Georgia GOP Senators call on Republican Secretary of State, Brad Raffensperger to resign over failure 'to deliver honest and transparent elections.'
  • Pennsylvania Supreme Court agrees to hear GOP challenge over dozens observers who claim they were 'corralled' and unable to view count, which may invalidate up to 800,000 ballots.
  • Nevada poll worker attests to outright fraud.
Update 1810ET: The Trump campaign has filed a 105-page lawsuit in the US District Court in Pennsylvania alleging that the state operated an illegal 'two-tiered' voting system for the 2020 general election, and has sought to block the state from certifying the count.

As LawandCrime.com reports, Pennsylvania Secretary of State Kathy Boockvar, a Democrat, and seven Keystone State county boards of elections are listed as defendants. These boards come from Allegheny, Centre, Chester, Delaware, Montgomery, Northampton, and Philadelphia counties.

The case has been assigned to U.S. District Judge Matthew Brann, a Barack Obama appointee.

Update 1635ET: Monday just keeps getting more and more interesting. As claims of fraud and invalidated ballots pile up, Senate Majority Leader Mitch McConnell (R-KY) and Sen. Lindsey Graham (R-SC) threw their support behind election challenges (implying there's a 'there' there).

For starters, Ohio Attorney General Dave Yost has filed a 'friend of the court' brief with the Supreme Court in support of Pennsylvania Republicans, who want the USSC to overturn the Pennsylvania Supreme Court's late October ruling allowing absentee ballots which arrived up to three days after election day.
"The States need an answer to that question, which is certain to arise again in future elections. And it is important to provide that answer now because, without a ruling from this Court, doubts will continue to linger about whether the vote count in Pennsylvania was performed in conformity with the Constitution," reads the filing by Yost, which was also signed by Ohio Solicitor General Benjamin Flowers and Chief Deputy Solicitor General Michael Hendershot. Next, two GOP Senators from Georgia have called on the state's Republican Secretary of State to resign over his alleged failure 'to deliver honest and transparent elections.'

And as we noted earlier:

The Pennsylvania Supreme Court has agreed to consider a GOP challenge claiming that Republican observers were unable to oversee ballot counting, thereby invalidating hundreds of thousands of votes, according to Reuters.
The decision to hear the case is separate from a challenge to the PA Supreme Court's ruling regarding ballots received after election day.

The news comes as Rudy Giuliani says at least 50 GOP witnesses say they were 'corralled' by Philadelphia election officials on election day and 'weren't able to see a single ballot' counted behind closed doors. He claims that the roughly 800,000 votes counted after that 'are invalid.'

Giuliani detailed the claims in an interview with Newsmax - where he announced that the first of five lawsuits will be filed on Monday in Pennsylvania 'challenging the entire vote on a number of grounds.'
Pennsylvania prevented us from watching much of the Ballot count. Unthinkable and illegal in this country.
— Donald J. Trump (@realDonaldTrump) November 9, 2020
"In this lawsuit we have over 50 witnesses who will say that the vote count, particularly once the election ended that night and President Trump was ahead by 800,000 votes in Pennsylvania, the count thereafter was unlawful," said Giuliani, adding: "It was counted behind closed doors. Republicans were not given an opportunity to see any of the mail-in ballots as required by Pennsylvania law. Pennsylvania law requires that for a ballot to be valid, a mail ballot to be valid, it has to be observed by both sides."
"We have 55 Republicans ready to testify that they were uniformly corralled and weren't able to see a single ballot. They saw a lot of activity, but no ballot. Every one of those ballots that was cast that was not examined, is now an illegal ballot - an unlawful vote. -Rudy Giuliani
Giuliani continued: "Not just in Philadelphia, however, precisely the same thing was done in Pittsburgh. The only difference is - when a court intervened in Philadelphia they didn't follow the court order, and our people were threatened with arrest if we tried to look at the ballots. Whereas in Pittsburgh, halfway through, they allowed some observation. So the numbers of unlawful ballots in Philadelphia are about twice the number in Pittsburgh."
“In this lawsuit we have over 50 witnesses who will say that the vote count was over 800,000 in Pennsylvania and the count was unlawful,” @RudyGiuliani tells Newsmax TV.

— Newsmax (@newsmax) November 9, 2020
Over the weekend, Giuliani told Fox News host Maria Bartiromo "This is documented on videotape. There are upwards of 50 witnesses. And this will be the subject of a lawsuit that we file tomorrow for violating civil rights, for conducting an unfair election, for violating the law of the state, for treating Pittsburgh and Philadelphia different than the rest of the state, which is an equal protection violation, which goes under Bush vs. Gore."

Meanwhile in Nevada, a Clark County poll worker has claimed in a sworn affidavit that proof of residence data was fabricated for illegal voters, among other claims.

The whistleblower claims that they worked 13 out of 14 days during early voting 'from October 17th - 30th,' where they 'had concerns over election polling place intimidation and voter fraud.'

— Sean Davis (@seanmdav) November 9, 2020
Among the whistleblower's claims:
  • Voters without valid ID were told to go to the parking lot and simply 'make an appointment with the DMV' - after which they were allowed to vote.
"We were told by [redacted] (my team leader), and two other assistants to advise people who wanted to register to vote and did not have the proper Nevada ID/Driver's license that they could go out in the parking lot and make an appointment with the DMV to get a Nevada ID/Driver's License, and then bring in proof of their appointment confirmation (either a paper copy or show it on their phone to us) and then they would be registered."
"We were told to add two zeroes ("00") to the DMV confirmation number and put it where the Driver's License/ID number was supposed to go when we filled in the registration form on line."
  • A 'Biden/Harris bus, tent, or table was in the parking lot' with 'speakers, dancers, music and other festivities' and were offering 'food, drink, and political memorabilia to voters.'
"Our team leader [redacted] had to go out several times a day to tell the Biden/Harris team they had to stay 100 feet from the location doors. As they would give folks signs to carry up to the door coming to vote. The Biden/Harris bus and/or van was there 7-8 days out of the 14 days."
  • Unopened ballot envelopes were opened and filled out against the side of the Biden/Harris van.
"I personally witnessed two people handing multiple unopened mail in ballot envelopes to two other people who then opened and filled out the ballots against the side of the Biden/Harris van. The same two people who marked the ballots then put the marked ballots in official pink and white envelopes. These individuals were not poll workers."
...
"By my final walking lap, there were 5 or 6 additional people who formed a human wall, which moved as I walked by, apparently in an attempt to block my view of the four people who were opening envelopes, marking ballots, and placing those ballots in the pink and white return envelopes."
On Saturday, the Clark County Registrar of Voters, Joe Gloria, acknowledged that his office had received reports of potential voter fraud, but that they wouldn't investigate them until after the election is completed.

"We do have some reports that have come in that we're logging for reporting. But we're definitely going to do an investigation, and we'll deal with them once the canvass is finished," said Gloria. "The votes are in the system at this point, so we'll have to after the election, post-election, go after anything that's been reported at this time."

BREAKING: Trump Campaign Set To File Another Election Lawsuit In Michigan

President Trump’s campaign is set to file a lawsuit in federal court alleging voter fraud and errors that may have swayed the outcome of the presidential election in the state.

Trump campaign communications director Tim Murtaugh, general counsel Matt Morgan, and campaign counsel Thor Hearne announced the lawsuit in a press call on Tuesday evening. The campaign plans to file suit in the U.S. District Court for the Western District of Michigan sometime late Tuesday, according to The Washington Examiner.

The lawsuit asserts that Michigan ran an unconstitutional election and seeks to block the Michigan secretary of state from certifying election results. The campaign also wants to audit the ballot count in Wayne County, Michigan, which includes Detroit. The Trump campaign has filed a couple lawsuits in the state already.

“We do not think we’re going to eat the apple in one bite, but a large part of these lawsuits is to gather further information,” Murtaugh said, according to The Daily Caller. “We do ultimately believe that President Trump will win this election.”

According to the Examiner:
The new federal lawsuit claims that many Republican poll watchers in Wayne County, where Detroit is located, were excluded from the absentee ballot counting process and were intimidated and harassed. It also seeks information about the voting technology used across the state after a failure to update software in Antrim County caused a glitch, resulting in 6,000 votes incorrectly being tabulated for Joe Biden rather than Trump.
Last week, a Michigan judge threw out a lawsuit by the Trump campaign on the grounds that the campaign had not produced any evidence to back up its charges of voter fraud and malfeasance.

The Trump campaign is pursuing a number of election lawsuits in battleground states such as Pennsylvania, Arizona, and Nevada, alleging that misconduct and mistakes favoring Biden may have tipped the scale of the election in those states. Though Biden is leading in enough states to win the election, Trump has refused to concede while the litigation is ongoing.

Major media outlets declared that Biden won the election over the weekend, most making the call after declaring that Biden had won the state of Pennsylvania. As The Daily Wire reported:
The Associated Press, ABC News, CNN, and NBC News called the 2020 presidential election for Democratic nominee Joe Biden on Saturday morning after projecting Biden as the winner of Pennsylvania and its 20 votes in the electoral college.

By calling Pennsylvania for Biden, the media outlets joined DecisionDeskHQ in putting the Democratic nominee at 273 votes in the electoral college, where 270 votes are needed to secure the presidency when the electors meet in December.
President Donald Trump issued a statement after the calls asserting that the presidential election was not final pending the outcome of his campaign’s lawsuits.

“The simple fact is this election is far from over. Joe Biden has not been certified as the winner of any states, let alone any of the highly contested states headed for mandatory recounts, or states where our campaign has valid and legitimate legal challenges that could determine the ultimate victor,” Trump said.

Trump Campaign Is Filing Another Election Lawsuit In Michigan — Seeks To Delay Certification Over More Claims Of ‘Unequal Treatment’

The Trump campaign will file yet another election lawsuit in Michigan, communications director Tim Murtaugh announced to reporters on a Tuesday evening phone call.

The suit — which similar to prior attempts in Pennsylvania, Georgia and Nevada — seeks to block the local secretary of state from certifying the results of the election on the grounds that Michigan ran an unconstitutional election. The suit will additionally look to grant campaign officials the opportunity to review counted ballots in Wayne County, Michigan.

Trump 2020 General Counsel Matt Morgan and Counsel to the Campaign Thor Hearne also took part in the call, and like the Pennsylvania suit filed Monday, claim that poll watchers in Democrat-ran counties received “unequal treatment” compared to their counterparts in Republican-ran counties.

President-elect Joe Biden leads President Donald Trump by roughly 148,000 votes in Michigan. Bloomberg News’ Mario Parker asked during the Tuesday call if the suit in question has a serious chance of overturning that deficit, Murtaugh clarified that every suit filed by the campaign is done in “an effort to get us closer to the election.”

“We do not think we’re going to eat the apple in one bite, but a large part of these lawsuits is to gather further information,” he added. “We do ultimately believe that President Trump will win this election.”

Murtaugh confirmed to Daily Caller after the call’s conclusion that the suit has not yet been filed.

Trump launches barrage of legal challenges in fight to keep White House
  • BY MELISSA QUINN
UPDATED ON: NOVEMBER 5, 2020 / 10:58 PM / CBS NEWS

Washington — President Trump has shifted his efforts to keep the White House from the ballot box to the courts, with his campaign filing a barrage of lawsuits in several battleground states as part of his quest to secure the 270 electoral votes he needs to win reelection.

Officials nationwide are continuing to count mail-in and in-person ballots, with Joe Biden maintaining an electoral edge, but Mr. Trump's reelection campaign has announced legal battles in four key battleground states: Michigan, Georgia, Nevada and Pennsylvania. It has also joined a lawsuit in Arizona over allegations ballots marked with Sharpie pen in Maricopa County were not counted. The Trump campaign has also said it would request a recount in Wisconsin "immediately," and Georgia Secretary of State Brad Raffensperger said he expects a recount there, as well.

The president's attorneys have made an attempt to bring the presidential race to the Supreme Court, as Mr. Trump threatened early Wednesday, asking to intervene in an existing case over the mail-in ballot deadline in Pennsylvania. At issue in that dispute is a ruling from the Pennsylvania Supreme Court to allow mail-in ballots postmarked by Election Day and received by Friday to be accepted and counted. A hitch in the president's plan, however, is if Biden ends up leading in Pennsylvania by more votes than are received between November 4 and November 6.

Pennsylvania officials continue to count the more than 3.1 million mail-in ballots cast, but are segregating those received after Election Day. The state remained a toss-up under CBS News' estimates as of Thursday, but recent results showed Biden cutting into the president's lead.

Mr. Trump and the Republican Party have not been shy about attempting to wield the judiciary as a weapon in their battle for the White House, filing dozens of lawsuits in state and federal courts in the run-up to the election that sought to block changes to election rules that made it easier to vote during the coronavirus pandemic.

But the lawsuits in Pennsylvania, Georgia, Nevada and Michigan are the first his campaign has filed either on or directly after Election Day, as Mr. Trump follows through on his previewed strategy of contesting the outcome of the election in the courts with hopes rulings in his favor will catapult him to victory.

Bob Bauer, a Biden campaign adviser, dismissed the lawsuits filed by Trump campaign in a briefing on Thursday, saying they're an attempt to "disrupt the vote count" and are "doomed to fail."

In addition to Pennsylvania, CBS News estimates Georgia is a toss-up, and Nevada is likely for Biden. The former vice president, meanwhile, is the projected winner of Michigan and Wisconsin.

Michigan

Filed in the Michigan Court of Claims, the lawsuit was brought by the Trump campaign and Eric Ostergren, an election "challenger" who allegedly was excluded from watching the absentee ballot review process. Michigan law allows "challengers" to monitor the absentee ballot process and challenge ballots that may not comply with state voting procedures.

The Trump campaign claims that Michigan is not complying with state law, as its absentee voter counting boards are being conducted without inspectors from each party being present. The also allege the state is violating the state constitution and election law by allowing absentee ballots to be processed and counted without letting challengers observe video of ballot boxes where the ballots are placed.

The campaign and Ostergren asked the court to order Michigan Secretary of State Jocelyn Benson to halt the counting and processing of absentee ballots until an election inspector from each party is present at each absentee voter counting board, and until video is made available to election challengers.

In response to the lawsuit, Benson told CBSN that the suit does not have merit and the state is confident in the process of counting all votes. Michigan Attorney General Dana Nessel said "every legally cast ballot will be counted in accordance with the law."

Following a hearing Thursday afternoon, Judge Cynthia Stephens rejected the Trump campaign's request for the vote counting to be halted, noting in part that its lawsuit was filed late Wednesday afternoon, at which point vote counting had largely proceeded. The "essence of the count is completed," she said.

Stephens also said Benson had already issued a directive to ensure compliance with state laws, which included instructions for providing access for poll-watchers.

CBS News projected Biden will win Michigan, where he leads Mr. Trump by 146,896 votes.

Georgia

Together with the Georgia Republican Party, the Trump campaign filed a lawsuit in the Superior Court of Chatham County, Georgia, alleging the proper chain of custody for absentee ballots was not followed.

According to the suit, a poll-watcher with the Georgia GOP "witnessed absentee ballots that had not been properly processed apparently mixed into a pile of absentee ballots that was already set to be tabulated." The Trump campaign alleges 53 late absentee ballots were added to the stack of on-time absentee ballots.

The Trump campaign and GOP claim it's unknown whether the absentee ballots were received by the Chatham County Board of Elections before the polls closed on Election Day or whether they were stored in compliance with state law.

The Republicans asked the court to order the Chatham County Board of Elections to collect and store all absentee ballots received after the Election Day deadline and provide an accounting of those ballots.

Following a hearing Thursday morning, Judge James Bass, Jr., dismissed the challenge, saying "the court finds that there is no evidence that the ballots referenced in the petition were received after 7:00 p.m. on election day, thereby making those ballots invalid." Bass also wrote in a one-page order there is no evidence either the board of elections or the Chatham County Board of Registrars failed to comply with the law.

Biden now holds the lead in Georgia, overtaking Mr. Trump in votes early Friday morning. The former vice president is ahead 1,560 votes.

Pennsylvania

Mr. Trump and his campaign charged forward with several legal battles in Pennsylvania, a state that is crucial for the president to win if he wants a second term in the White House, in addition to the dispute over the mail-in ballot deadline that ended up before the Supreme Court.

First, the Trump campaign and Republican National Committee filed a lawsuit in state court against Secretary of State Kathy Boockvar and the commonwealth's 67 county boards of elections, claiming Boockvar violated the state election code by extending the deadline for absentee and mail-in voters to provide missing proof of identification.

The deadline for voters to provide such identification under Pennsylvania's election code is "the sixth day following the election." In guidance issued to counties regarding mail-in ballots received after 8 p.m. on Election Day and before 5 p.m. Friday — which are being segregated due to the existing legal challenge — Boockvar said voters have until November 12 to provide proof of identification.

The campaign asked the court to prohibit the counties from giving absentee and mail-in voters the chance to provide missing proof of identification after November 8. They also want the court to prohibit counties from counting absentee and mail-in ballots from voters whose proof of identification wasn't received and verified by November 9.

Mr. Trump also appealed an order from the Court of Common Pleas for Philadelphia County on Election Day over the closer observation of the canvassing of ballots. A poll-watcher for the Trump campaign at the Philadelphia Convention Center reported he was at least 20 feet from a table where ballots were being handled, making it difficult to see the markings on secrecy envelopes and whether they were completed correctly.

On Thursday, the Trump campaign declared victory in the battle, as a judge for the Commonwealth Court of Pennsylvania issued a one-page order requiring that poll watchers, candidates or candidate representatives be permitted to watch all aspects of the canvassing process within 6 feet. The Philadelphia Board of Elections has appealed to the Pennsylvania Supreme Court.

The president's campaign has taken the issue of poll-watchers to the federal courts, as well. On Thursday, his campaign asked the judge to halt counting in Philadelphia while Republican observers are not present. Mr. Trump's lawyers claimed the Philadelphia County Board of Elections refused representatives and poll-watchers for the GOP and Trump campaign access to observe ballot counting.

Judge Paul Diamond denied the Trump campaign's request, citing an agreement between the two parties.

Biden has taken the lead in Pennsylvania and is ahead of Mr. Trump by 9,746 votes. It's likely, however, that the state is still receiving mail-in ballots due to the extended deadline to receive and count them.

Nevada

Mr. Trump has routinely made claims of voter fraud despite little evidence such widespread fraud exists. When given the opportunity by judges in prior lawsuits to present proof that certain situations would lead to fraud, his campaign and the GOP have failed to do so.

Still, the Trump campaign and Nevada Republicans announced they plan to sue in federal court to force election officials in the state to stop counting "improper votes." The lawsuit, filed Thursday on behalf of a Nevada voter and two congressional candidates, claims there have been "irregularities" in Clark County.

The lawsuit alleges there were "lax procedures for authenticating mail ballots and over 3,000 instances of ineligible individuals casting ballots," that ballots have even been cast on behalf of dead voters, and the public has been kept from observing the processing of mail ballots."

The lawsuit calls for the court to block elections officials from using its signature-verification software system and allow "meaningful access to the ballot counting process."

A federal judge denied the Trump administration's requests following a hearing Friday.

"Public interest is not in favor of disrupting the completion of the processing and counting of the ballots," Judge Andrew Gordon said, adding that there was "an interest in not disenfranchising" potentially hundreds of vote "against one improper ballot."

Biden's lead over Mr. Trump has widened as the state reports more vote totals, to roughly 20,542.

Just my concern.

I know there's fraud. You know there's fraud. Everyone here knows there's fraud. The man in the moon knows there's fraud.

Even this government yutz knows there's fraud.

But is it actually going to CHANGE anything when fraud can even be proven?

I still believe it's possible, but sometimes I doubt it. Even Jesus doubted the plan for a little while.

The point in the statement that Sterling made was that they are admitting that there is widespread fraud - which they accept. They know the investigators are going to find vast quantities of fraud - his point being is that the fraud perpetrated is not enough to overturn the results.

This brazen In-Our-Face admission, just confirms for me that they believe that there is no stopping or undoing what they set in motion - and it is full speed ahead with this coup.

Trump’s Election Lawsuits: A State-By-State Guide

Kevin Daley - NOVEMBER 10, 2020 2:00 PM

President Donald Trump is gearing up for post-election lawfare after a host of media outlets called the presidential race for Joe Biden on Saturday.

The Washington Free Beacon will track Trump's legal efforts state-by-state and update this story as new information becomes available.

Biden leads in critical battlegrounds like Arizona, Georgia, Michigan, and Pennsylvania, and it's not clear how Trump might erase those margins by litigation. An initial wave of lawsuits quickly fizzled last week as vote counters around the country tabulated results, though the campaign may ask for recounts and seek court orders establishing procedures for that process.

Arizona
Donald J. Trump for President v. Hobbs in the Superior Court for the State of Arizona:

In Maricopa County, the Trump campaign sued the Arizona secretary of state and a handful of local election officials on Nov. 7 alleging that "potentially thousands" of votes were wrongly rejected by poll workers who failed to follow proper procedures.

Vote machines in Maricopa County will reject votes that include splotches, stray marks, or multiple marks in the same race. The machine will display an alert and eject ballots if it detects such defects. The lawsuit, which includes affidavits from observers and voters, claims that county poll workers overrode those error messages when they showed up on screen instead of instructing voters on how to cast their ballots correctly, thus ensuring those votes wouldn't count.

The plaintiffs want officials to identify any ballot cast in Maricopa County after an error message appeared. Those ballots should be inspected by canvassing boards and counted provided they are legitimate, the plaintiffs say.

The voter and observer complaints attached to the lawsuit revolve around the use of sharpies to mark ballots. Viral internet claims assert that ballots filled out by sharpie can't be counted in Arizona. Arizona attorney general Mark Brnovich (R.) looked into the matter and said he's satisfied those concerns are false.
Biden is ahead of Trump by about 15,000 votes in Arizona.

Georgia
In re: enforcement of election laws in the Eastern Judicial Circuit of Georgia:
Trump lawyers filed a lawsuit in deep-blue Chatham County on Nov. 4 after Republican election observers raised concerns that a poll worker comingled about 50 tardy mail-in ballots with legitimate votes. Mail-in votes were due at 7:00 p.m. on Election Day in Georgia. The Trump campaign asked a state court judge for an order requiring officials to segregate tardy ballots from all other votes.

At an emergency hearing, a top election official testified that he inspected each of the 50 contested ballots and confirmed they were received on time. The matter was dismissed shortly thereafter.

"The court finds that there is no evidence that the ballots referenced in the petition were received after 7:00 p.m. on Election Day, thereby making those ballots invalid," Superior Court judge James Bass wrote. "Additionally, there is no evidence that the Chatham County Board of Elections or the Chatham County Board of Registrars has failed to comply with the law."

Biden currently leads Trump by about 12,000 votes in Georgia. Gabriel Sterling, a top elections administrator for the state, vigorously defended Georgia's process in a Nov. 9 press conference.

"We are going to find people who tried to illegally vote. Is it 10,353? Unlikely," Sterling said.

Michigan
Donald J. Trump for President Inc. v. Benson in the U.S. District Court for the Western District of Michigan; and Donald J. Trump for President Inc. v. Benson in the Michigan Court of Claims:

The Trump campaign is litigating two challenges in Michigan. The first is in federal court and mostly concerns the procedures for counting votes at a canvassing center in Detroit. The second is in state court and involves similar claims.

The federal complaint alleges that vote-counters failed to follow proper procedures or engaged in personal misconduct like "intimidating" Republican observers. It includes dozens of affidavits from Republican poll challengers who were on hand at the Detroit canvassing center.

One challenger called Andrew Miller said in an affidavit that he was repeatedly blocked from observing a ballot duplication process, in which vote-counters faithfully transcribe the marks on a ballot rejected by a machine onto a fresh ballot. Under Michigan law, this process must be conducted by a bipartisan team. Miller also said poll-workers failed to properly document his challenges.

Another, Kathleen Daavettila, is a pregnant women who voluntarily left the canvassing because the alleged hostility of vote-counters and Democratic observers made her fear for her safety.

The lawsuit asks for an order that delays certification of the results, grants Republicans access to surveillance video of ballot drop boxes, and directs Detroit vote-counters to exclude fraudulent votes, among other things.

The case was assigned to U.S. District Judge Robert Junker.

Immediately after the election, the Trump team also asked a state court in Michigan to stop the tabulation of absentee ballots across the state. In an emergency filing, the campaign alleged that a GOP observer had been kept away from an absentee vote counting site in Oakland County and requested access to surveillance video of so-called ballot drop boxes. They also submitted an affidavit from a Republican attorney who alleged she was told that disqualified ballots were being wrongfully "cured" by canvassers.

Michigan Court of Claims Judge Cynthia Stephens tossed the cases for several reasons. Stephens said the suit had come too late, that the campaign was suing the wrong defendants, and that it lacked sufficient evidence for its claims. Trump lawyers are appealing the decision.

Biden leads Trump by about 150,000 votes in the state.

Update 11/11/20, 3:45 p.m: This section was updated to include the federal complaint.

Nevada
Stokke v. Cegavske in the U.S. District Court for the District of Nevada:
As in other states, GOP lawyers in Nevada raised procedural concerns about observer access and scrutiny of absentee ballots in Clark County, where about 70 percent of Nevada voters reside.

A lawsuit filed in federal court sought to immediately halt the use of an electronic signature-verification software in favor of a manual review of mail-in ballots. The GOP plaintiffs said use of that software is not permitted under state law. They also claimed the Nevada balloting was beset by "irregularities," citing a woman who believes another person voted fraudulently in her place and a Republican observer who was asked to leave the Clark County canvassing center on election night.

U.S. District judge Andrew Gordon denied the GOP request during a hearing on Nov. 6. Gordon noted that the dispute over Clark County's verification software is being litigated at the Supreme Court of Nevada. Though he seemed to think the software was compatible with Nevada's election rules, he said the issue arises under state law and is best resolved in state court.

As to the other issues, the Nevada voter who feared fraud seemed to retreat from her claim by declining opportunities to submit an affidavit and cast a provisional ballot. And election officials stressed that GOP observers were on hand continuously at the Clark County canvass, even if one was asked to leave. The observer who was removed, Fox News commentator Chris Prudhome, violated the rules by using a camera in a part of the canvassing center where filming is not permitted, according to state lawyers.

"The plaintiffs have not come to the court at this point with sufficient legal showing and sufficient evidentiary basis," Gordon said during Friday's hearing.

"We've had answers for every allegation that's been brought forward," Clark County registrar Joseph Gloria said of Republican complaints at a Nov. 9 press conference.

The state Supreme Court asked Nevada Republicans and state officials to file legal papers on the signature-matching controversy by Nov. 9. Further action is forthcoming. Tens of thousands of mail-in votes could be at stake.

Biden is ahead of Trump in Nevada by about 35,000 votes. The deadline to finish the Nevada canvass is Nov. 16.

Pennsylvania
Republican Party of Pennsylvania v. Kathy Boockvar in the Supreme Court; In re: canvassing observation in the Pennsylvania Supreme Court; and Donald J. Trump for President v. Kathy Boockvar in the Commonwealth Court of Pennsylvania:

The Trump campaign is litigating a multi-front effort in the Keystone State.

First, the campaign is seeking to take over a lawsuit in the U.S. Supreme Court involving the validity of mail-in ballots that arrived after Election Day. The state Supreme Court said any mail-in ballot that arrived by Friday Nov. 6 should be counted. The Trump campaign and Pennsylvania Republicans say the deadline set by the state legislature—8 p.m. on Election Day—ought to be the cutoff.

Over the weekend, an order from the High Court provided that ballots arriving after Election Day should be kept separate from all other votes, as they are the subject of ongoing litigation. The next step in that case is for the justices to decide whether the Trump campaign will serve as lead plaintiff. It's possible that the Court will never resolve the lawsuit, as late-arriving mail-in votes may not be decisive to the outcome in Pennsylvania, where Biden currently leads by almost 50,000 votes.

Second, the campaign fought first in state and then in federal court over the rules for observers in the Philadelphia canvassing center. Events in Philadelphia have been at the center of conservative election fraud anxiety, as hundreds of thousands of mail-in ballots from southeastern Pennsylvania flipped the state into the Biden column after Trump prevailed among Election Day voters.

Contrary to the president's claims and the statements of his surrogates, Republican observers have been present continuously at the Philadelphia site. Campaign lawyers say, however, that the configuration of the room and social distancing rules are preventing their vote watchers from carefully monitoring the process.

A Pennsylvania appeals court sided with Trump on Nov. 5, saying election law requires vote counters to give Trump's watchers some "observational leeway to ascertain sufficient details of the canvassing process."

The campaign made a detour to a federal judge several hours later, claiming Philadelphia officials were not complying with the order. During an emergency hearing before U.S. District Court judge Paul Diamond, Trump lawyers admitted that Republican observers have been on hand in the canvassing center since the process began. Diamond dismissed the matter after the Trump campaign and city officials agreed both parties could have 60 observers present.

Back in state court, the Pennsylvania Supreme Court announced Monday afternoon that it will wade into the controversy and decide what degree of access observers must have under state election law. Court officials are setting up an accelerated briefing schedule so the case can be decided quickly.

Third, the campaign sued Pennsylvania secretary of state Kathy Boockvar after she gave voters until Nov. 12 to confirm their identities if mail-in ballots were returned without proper proof of identification. The original deadline was Nov. 9. The judge said she would rule on Boockvar's move later. For now, any voter who returns ID information between Nov. 10 and Nov. 12 will have their vote set aside.

Pennsylvania Republicans are litigating several other controversies with which the president's campaign is not involved.

True the Vote Lawsuit: Illegal Ballots Counted in Four Pennsylvania Counties

The election integrity group True the Vote is suing Pennsylvania Gov. Tom Wolf (D) and Secretary of State Kathryn Boockvar (D), alleging that illegal ballots were counted in four counties across the state in the presidential election.

A lawsuit filed by True the Vote on Tuesday, on behalf of four Pennsylvania voters, alleges that ballots in Philadelphia County, Montgomery County, Delaware County, and Allegheny County were counted in the election despite having been invalid.

The lawsuit asks for ballots from the four counties to be invalidated if it is revealed that a significant number of illegal ballots were counted because such ballots were “mixed in with and cannot be separated from lawful ballots,” according to a True the Vote release.

“The Pennsylvania election process was an embarrassment to our country and an affront to our deep-seated value of protecting Americans’ basic Constitutional right to vote,” True the Vote Founder and President Catherine Engelbrecht said in a statement. Engelbrecht said:
This lawsuit seeks to discover the facts about what happened in Pennsylvania’s presidential election and the truth about illegal ballots that were counted, which could impact the final election results. No matter the outcome, it is our wish to see the law followed, to see voters heard, and to ensure the principle of ‘one vote for one voter’ is upheld.
True the Vote officials said they have gathered evidence in Philadelphia County that accuses election officials of picking and choosing voters to cure their defective ballots as poll watchers were not allowed access to canvassing sites.
In Montgomery County, True the Vote alleges that a poll watcher witnessed election officials advising unregistered voters to return to vote under a name that was registered in the state’s voter rolls. True the Vote also notes that voter turnout was 88.5 percent in Montgomery County, which is 19 percent higher than the statewide turnout of less than 70 percent.

True the Vote alleges that in Allegheny County, home to Pittsburgh, voters were told to fill out provisional ballots after election officials claimed they had been sent mail-in ballots, even though the voters said they had not received mail-in ballots. The lawsuit also claims that poll workers were too close to voters when they were casting their ballots. Turnout in Alleghany County was nearly 75 percent — more than five percent higher than statewide turnout.

In Delaware county, voters that were recorded to have received mail-in ballots were given regular ballots and not required to sign the registration book. Additionally, poll watchers were granted extremely restricted access to a back room counting area, and ballots received on Election Day were not separated from ballots received after 8:00 p.m. that day, as ordered by the U.S. Supreme Court. Finally, voter turnout was 75.87 percent, 6.5 percent higher than statewide turnout.

The lawsuit alleges that voters across Pennsylvania were sent mail-in ballots without requesting them and, sometimes, received multiple mail-in ballots in their name. These voters, the lawsuit claims, were then told to vote provisionally in person on election day or, in some cases, were not allowed to vote.
True the Vote states in the lawsuit that they will be providing further evidence that compares voting records with records from the state voter registration database, the United States Postal Service, Social Security, the Department of Motor Vehicles, and other sources.

Their findings, they said, could reveal double votes, votes cast by ineligible voters, votes cast by felons, votes cast by non-citizens, and votes cast through ballot harvesting. Analysis cited by True the Vote alleges that more than 680,000 ballots in Allegheny County and Philadelphia County were processed without any observation.

The current vote count in Pennsylvania shows Democrat Joe Biden ahead of President Trump by less than 45,000 votes.
