4 blue states sue Washington over GOP tax overhaul

ALBANY, N.Y. (AP) — New York, New Jersey, Connecticut and Maryland sued the federal government over the Republican-led tax overhaul Tuesday, alleging the new law championed by President Donald Trump unfairly singles out high-tax blue states.

The lawsuit, filed in the Southern District of New York, was dismissed as a long-shot political stunt by supporters of the new tax code, but New York Gov. Andrew Cuomo said it is a practical act of self-defense against an adversarial federal government. The challenge alleges that lawmakers crafted the new tax code to target left-leaning states and interferes with their constitutionally granted taxing authority.

"This is their political attempt to hurt Democratic states," said Cuomo, a Democrat who is considered a possible White House contender in 2020. "It's totally repugnant."

The tax law passed by Congressional Republicans and signed into law last year by Trump caps a deduction for state and local taxes at $10,000. The deduction was especially popular in high-tax, Democratic states, where many homeowners will see big increases in their federal tax bill. New York estimates that taxpayers will pay $14 billion more in 2018.

The suit seeks to block the cap on deductions for state and local taxes, known as SALT. It names the Internal Revenue Service and the U.S. Treasury Department as defendants. Cuomo first announced plans to sue seven months ago and was quickly joined by leaders from the other states.

More than 500,000 Maryland residents will see their taxes increase under the new law, according to that state's attorney general, Democrat Brian Frosh.

"Eliminating the SALT deduction will jack up taxes for more than half a million Marylanders," he said. "It is an attack on state sovereignty. It will reduce funding for local law enforcement and for construction of infrastructure statewide, and it will cripple our ability to educate our kids."

Critics dismissed the lawsuit as a political ploy that's not likely to prevail in the courts.

When it comes to taxing Americans, "Congress can really do what it wants," said Tax Foundation executive vice president Joseph Bishop-Henchman. "It's really not much of a case."

Republicans said the plaintiff states should focus on reducing the cost of state taxes instead of taking on Washington.

"New York cannot sue its way out of high taxes," said New York state Senate Leader John Flanagan, R-Long Island.

This part of the new tax law removes a subsidy for people in high tax states.

Functionally, we've been paying for their confiscatory state taxes.

They get a pass on paying federal taxes because they pay high state taxes...OOPS, not anymore.


Maybe, they will consider this in future local elections. (probably not, but we can hope)

It doesn't unfairly single out any state. It applies equally to all states. Libtard states may continue to tax people egregiously if they wish but don't expect the other states to subsidize you anymore.

Wait a minute. IMO 10,000 is a lot of state tax. Anyone paying more than that must have a pretty good stash of assets. Aren't the dems the ones that say to tax the rich, and the rich shouldn't get any tax relief? Wouldn't the average family's tax burden fall below that ten grand point? Oh wait, that will hit the ones like Bernie and Lurch who have multiple mansions.

Very discriminatory, indeed. But, they can still get their under the table kickbacks tax free.

Let me get this straight. Tax legislation was passed by both houses and signed into law. Now these morons are trying to sue the IRS and treasury? They’re only charged with enacting the legislation. The states need to sue the legislature. Stupid morons.

Exactly. The rich need to pay their fair share. If they can afford $10k+ in state taxes alone (that is more money than many people earn all year) then is seems they are rich and should be paying their fair share.

So is the constant demand from the democraps for higher taxes and for rich people to pay higher percentages all just bovine excrement? Seems to me the wealthy democrap blue staters have an opportunity to put their money where their mouth is but instead choose to sue someone rather than ante up and pay their fair share.
