Many observers — both on the left and on the right — are incensed over President Donald Trump's controversial photo op Monday at St. John's Episcopal Church and are calling the clearing of protesters to make way for Trump and his entourage "cowardly," "dangerous," and "shameful."

But the American Civil Liberties Union took it a step further Tuesday demanding investigation into whether Trump broke international law by allegedly calling for the use of tear gas to disperse the crowd.

"This appears to be grossly unjustified use of a chemical weapon on protesters and raises serious human rights concerns under international law," the ACLU said. "Elected officials, including Congress, must investigate this politically-motivated, life-threatening use of indiscriminate weapons."

What are the details?
The alleged use of tear gas to clear demonstrators who were protesting George Floyd's death in Lafayette Square has been widely disseminated in online reports and on social media since Monday night, as people on the ground recalled feeling a stinging sensation in their lungs.

The Washington Post reported with apparent certainty that tear gas, flash-bang shells, and rubber bullets were used by the National Guard to clear the path. Attorney General William Barr visited the scene at 6:30 p.m., the Post reported, and shortly thereafter, "chaos ensued":

Roughly 30 minutes later, after the president finished his remarks in the Rose Garden, he and a small company of top advisers made their way through the streets to the church, Bible in hand.

What are the conflicting reports?
But a definitive statement has yet to be made regarding the use of tear gas by any of the law enforcement and military agencies involved, which includes the Park Police, the D.C. police, the Secret Service, and the National Guard.

WTOP-TV reporter Neal Augenstein is pushing back against reports that Park Police deployed tear gas, suggesting that a source from the agency told him that smoke canisters, without uncomfortable irritant, were used instead.

He added that his source said the Park Police were not even aware that the president would be moving through the area, but rather deployed the canisters after protesters began heaving water bottles at them.

When Augenstein asked the Secret Service and the D.C. police, both agencies declined to comment one way or another on the use of munitions. Of course, the Post article indicates that it was the National Guard in concert with other law enforcement that deployed the tear gas.

While Augenstein notes that something was assuredly fired since several reporters on the ground took notice of an irritating munition, it is simply not confirmed that the munition was tear gas as is being widely reported.

WHO CARES if it was tear gas??? So freakin what? There were violent mobs outside the White House trying to breach the perimeter and set buildings on fire for the previous 48 hours. If the president needs to create a net of safety to address the nation and demonstrate his power and authority over the gangs of thugs, so be it!

Central FL update: Spikes Tactical (based in Apopka FL) looted last night. MANY AR's stolen. They are hiring a private security force of former operators since they did not penetrate one of the large holding areas and there is still a bunch left to steal.

There is another large group of former SWAT, special forces, military and other trained people who joined up to form a little militia with significant arms who are going to be standing in the area, out of sight, ready if things turn to looting. This is not going down here like in other places.

An "Organizer" of the "Event" tonight was just at Walmart buying up all of the bottles of water, but wanted the nice throwable 8 oz size convenient for throwing.

Several of my former co workers are gearing up to baby sit some downtown businesses for the planned riots tonight and tomorrow. I have substantial armor, 6 radios, and "Enough" ammo. Since you can never have to much ammo, "Enough" is the goal.

The cops are just now being told to show up tonight, no plan, no gear, no riot control training, nothing. My son is a detective and was told to show up in uniform, he is bring his own armor, AR and gas mask but he will be the only one. I will be close to him and he will have a radio to talk to mine so I can come take care of things if he gets over run.

Many have their head on straight. Make sure your face is hidden too if any shooting starts. At some point people tired of this shit will return fire on the attackers.

In United States military security parlance, force protection condition (FPCON for short) is a counter-terrorist threat system overseen by the United States Department of Defense directive, and describes the number of measures needed to be taken by security agencies in response to various levels of terrorist threats against military facilities, as opposed to DEFCON, which assesses the amount of military forces needed to be deployed in a situation with a certain likelihood of attack against the civilian population. The decision on what level of FPCON to implement is affected by the current threat of terrorism towards military facilities and personnel, the amount of security forces available, and current relationships between the United States and the world, which may affect the chances of an attack. Descriptions of FPCONs[edit]

There are five Force Protection Conditions; the commander of U.S. Northern Command determines what the minimum force protection level will be for every American installation in the continental United States. USNORTHCOM sets the force protection condition level for so many installations because it is the Unified Combatant Command whose geographic area of responsibility is North America. Other combatant commands, such as U.S. European Command and U.S. Southern Command, set the force protection condition levels for American military installations in their areas of responsibility.   • FPCON ALPHA describes a situation where there is a small and general terrorist threat that is not predictable. Evidence of terrorist attack planning may exist, such as terrorist surveillance or reports from local sources. Strong protective measures are required, but the installation must continue its regular mission activities. You can expect rigorous efforts to inspect vehicles and facilities. Military personnel may be required to participate in special guard duties.

  • FPCON DELTA describes a situation when a terrorist attack is taking place or has just occurred in the immediate area. FPCON Delta usually occurs only in the areas that are most vulnerable to or have been attacked. FYI PPD has now blocked off a 5 block area, from 1st ave to 5th ave and 5 blocks north to south WITH FENCING. this includes the justice center etc. Worthless Wheeler has canceled the curfew tonight due to the "peaceful" protests last night, well of you don't count the 100 people with a pistol etc. Downtown is boarded up and the stores that opened up for memorial day have now closed back up WITH BOARDS ON THEM. DOWNTOWN IS KAPUT. I REALLY WISH I COULD POST THE 2 DOZEN OR SO POCTURES I HAVE TAKEN, OF THE DAMAGE, THE ROAMING MOBS ETC.

The announcement came after a night of overwhelmingly peaceful protests. Demonstrators made a slow loop from Revolution Hall to downtown’s Pioneer Courthouse Square and back, as they protested the death of George Floyd, a black man who died after a police officer knelt on his neck for nearly nine minutes in Minneapolis.

The protests saw little if any of the tear gas or vandalism that rocked the end of the previous three nights of protests. Rather, a handful of demonstrators acted as organizers for the night, leading a crowd of thousands across the city and bringing them to their destination outside Revolution Hall around 11:30 p.m. The demonstrators who had taken the lead thanked the crowd for gathering peacefully and told them to go home — a first since the demonstrations began Friday evening.

“Last night marked a significant shift in the tenor of recent demonstrations,” said Wheeler, appreciatively at a Tuesday morning conference. “And that’s worth calling out. Thousands of people filled our streets, and they did so peacefully.”

Of the thousands who demonstrated peacefully, Police Chief Jami Resch said about 100 did not. She said a small group gathered downtown half an hour after the main demonstration ended and began throwing glass bottles and rocks at police. A dozen people were arrested, according to Resch. Police said they seized two guns.

The morning post-protest conference, which has become a daily event since protests took hold in Portland, also served as a chance for both Resch and Wheeler to push back against Gov. Brown’s remarks Monday that the mayor had asked for the National Guard to confront protesters on the front lines.

“I was alarmed last night to see the governor’s mischaracterization of the city’s request for the National Guard,” said Wheeler, adding he had asked for the troops to protect buildings and not to engage with demonstrators.

“The idea I would ask the governor for the National Guard for the purpose of direct confrontation with demonstrators on the same day Donald Trump is saying military should be deployed into states to crush even peaceful demonstrations,” he continued later. “That is potentially incendiary.”
In the absence of a curfew, protesters will be free to fill the streets Tuesday after 8 p.m. — and potentially many more nights to come. Without action from leadership that addresses the concerns of the protesters, Wheeler indicated he sees more nights of demonstrating on the horizon.

“I don’t see how we move out of this current mode of thinking, which is large demonstrations demanding justice. Until we get to the OK, we’ve now heard it, we’ve acknowledged it, so what concrete actions are we taking next, and I want to hear more from the community about what they think we should do.”

The mayor indicated that both he and Resch would be meeting later Tuesday with organizers who have taken the lead during these four nights of protest.
