LOS ANGELES (AP) — “That ’70s Show” actor Danny Masterson was charged with the rapes of three women in the early 2000s, Los Angeles prosecutors said Wednesday, the culmination of a three-year investigation that resulted in a rare arrest of a famous Hollywood figure in the #MeToo era.

The three counts of rape by force or fear against Masterson were filed Tuesday, and an arrest warrant isssued. Masterson, 44, was arrested late Wednesday morning, jail records showed. He was released a few hours later after posting bond and is scheduled to be arraigned Sept. 18.

Masterson’s attorney Tom Mesereau said his client is innocent, and “we’re confident that he will be exonerated when all the evidence finally comes to light and witnesses have the opportunity to testify.”


Prosecutors allege that Masterson raped a 23-year-old woman sometime in 2001, a 28-year-old woman in April of 2003, and a 23-year-old woman he had invited to his Hollywood Hills home between October and December of 2003.

If convicted, he could face up to 45 years in prison.

Prosecutors declined to file charges in two other Masterson cases that police had investigated, one because of insufficient evidence and the other because the statute of limitations had expired.

Masterson has been married to actor and model Bijou Phillips since 2011.

“Obviously, Mr. Masterson and his wife are in complete shock considering that these nearly 20-year old allegations are suddenly resulting in charges being filed, but they and their family are comforted knowing that ultimately the truth will come out,” said Mesereau, who has previously represented Michael Jackson and Bill Cosby in their trials for sexual crimes.

“The people who know Mr. Masterson know his character and know the allegations to be false.”

The women, whose names were not made public, issued a statement through their attorneys saying they have suffered “harassment, embarrassment and re-victimization” since they began cooperating with authorities.

“We are thankful that the Los Angeles County District Attorney’s office is finally seeking criminal justice against Masterson,” the statement said. “We are confident that the truth will be known and hope that the charges filed today are the first steps in this long journey of healing, justice, and holding those that victimized us accountable.”

The alleged rapes came at the height of Masterson’s fame as he starred on the retro sitcom “That ’70s Show” alongside Ashton Kutcher, Mila Kunis and Topher Grace. The series ran on Fox TV from 1998 to 2006 and has had a long afterlife in reruns.

He had reunited with Kutcher on the Netflix western sitcom “The Ranch” when the LAPD investigation of him was revealed in March 2017. The news did not have immediate career repercussions for Masterson, but later in the year, after allegations against Harvey Weinstein shook Hollywood’s culture, he was written off the show.

Masterson decried the Hollywood atmosphere that led to his losing the job, and also suggested at the time that his high-profile membership in the Church of Scientology was leading to his persecution.

He said in a 2017 statement that “in the current climate, it seems as if you are presumed guilty the moment you are accused.”

Because police were already investigating him, Masterson’s case was not among those taken up by a task force formed by Los Angeles County District Attorney Jackie Lacey to investigate sexual misconduct in the entertainment industry. That task force has declined to file charges in more than 20 cases in the two years of its existence, charging only Weinstein himself.

Los Angeles prosecutors have begun efforts to bring Weinstein to California to face charges of rape and sexual assault. He is being held in a New York prison after being convicted of similar charges earlier this year.

Masterson’s case still stands out as just the second set of charges Los Angeles prosecutors have filed against a famous Hollywood figure in the #MeToo era.

Masterson worked steadily starting in the early 1990s, largely in TV sitcoms including “Cybill” and “Men at Work” along with “That ’70s Show” and “The Ranch.”

His film credits include the 2008 Jim Carrey comedy “Yes Man,” “The Bridge to Nowhere” in 2009, in which he starred with his future wife Phillips, and 2011’s “The Chicago 8,” in which he played 1960s antiwar activist Jerry Rubin.

I've heard of this before so I don't think it was just reported. I don't know why it took this long to prefer charges.

i have heard that there have been many women that have been trying to get this to actually stick for a long time, but because he is a scientologist, and works in tv and movies and makes big donations (cough cough) to the "church", they have been trying to hide it and make it go away. sometimes, they are very....persuasive (and i don't mean with money) in how they try to make it go away. i have heard that he did something to annoy or tick off someone higher up in the "church", and they have taken away the protection. we shall see what happens

no, he is married to another scientologist, and she has had some health problems. but....i think PART of the issue is that he seems to think he can do ANYTHING, and the "church" will help him get out of any trouble. that is what i have heard in the rumblings. along with a few other issues with him. with the current environment in the last year or so, he might have gotten too hot to handle anymore. not sure.

you have to remember that not only is scientology extremely intent on making sure that they and anyone associated with it looks clean and good, but they are VERY powerful in hollywood and the industry.

and the police and courts in that area and state.

the laws there are nuts (they are nuts anyway, but in regards to anything like this, they are even more so).

so many things have happened there that never sees the light of day because they want it that way. the fact that this is going forward, and at the level and coverage it is, it really makes me think that he has had some protections lifted.

I do not support rape (or rapists) in any way, shape or form, but I view with extreme skepticism any claims that come forth ten or twenty years after an alleged attack. Could certain things have happened long ago? Of course - or not - but the accused has rights, too.

The victims of rape, or any other crime, have an obligation to report the violation in a timely fashion. Otherwise, memories, evidence and witnesses tend to degrade over time. This makes successful prosecutions much more difficult and costly.

Can - and do - rape victims suffer various degrees of mental trauma? Of course they do, but there is a certain amount of responsibility on the victim's part, too. If a victim wants to help ensure a successful prosecution, it's incumbent upon them to report the crime in a timely manner. This is not only for their benefit, but for the benefit of other potential victims who may come across the rapist's path.

IOW if a woman is raped and decides to keep that information to herself and then the next week her next door neighbor is raped by the same man, because the neighbor had no idea that the man was a threat, does the first victim bear any guilt or responsibility for the second attack?

So the charges will go away and he will come back into the fold....they probably have him on tape admitting it....they do that...…. but 15+ years...…… forget about it...….

and for the most part, i agree with you. for the most part.

the laws there are just wretched though, and so many try their best to do just what you say, and they just seem to never actually get legally filed with the police. nothing comes of it. if NOTHING else comes of this whole #metoo bs, i hope it shines a big blinding spotlight on those laws there and how the police and "law" in that area are absolutely corrupt. hopefully, it will change.


the women in this (as it has been rumored for years) have tried very hard to make this happen, but kept on getting thwarted.

like i said, we shall see what actually happens here.

and doc, i really do agree with what you have said about not only the accused, and also about coming forward in a timely manner.

this is a very difficult and messy topic. i can understand why women have a hard time coming forward. their lives often times get destroyed a second time. first in the actual attack, and then if they report it.

the false accusations are what get me pissed beyond all comprehension. i say that if someone falsely accuses someone of something, they should bear the fullest extent of what the sentence would be for those they accused.

the accused does have rights as well, because we simply do not know who is in the wrong simply by and accusation. that also gets difficult and messy. it sucks all the way around.

No, she holds no responsibility. If you've never been sexually assaulted you won't understand that answer, ever.

Danny Masterson was found guilty Wednesday in his rape retrial. He was found guilty on two counts. The jury was hung on a third charge.
The former "That '70s Show" actor was on trial for the second time in less than six months after his first ended in a mistrial.

Masterson, 47, initially faced up to 45 years in prison if he was found guilty on three counts of rape by force or fear on alleged sexual assaults, which occurred between 2001 and 2003 at his Hollywood Hills home.
He was arrested in June 2020 and has been free on a $3.3 million bond. Masterson pleaded not guilty to the charges and has maintained his innocence.

A jury of seven men and five women heard closing arguments from Deputy District Attorney Ariel Anson on May 16.
"The defendant drugs his victims to gain control. He does this to take away his victims’ ability to consent," Anson said. "You don’t want to have sex? You don’t have a choice. The defendant makes that choice for these victims. And he does it over and over and over again."
Masterson's attorney, Philip Cohen, argued that inconsistencies in the women's stories were downplayed by the district attorney, and essential for proving reasonable doubt of Masterson's guilt.


"She did a very nice job of ignoring many of them," Cohen said. "What she views as little inconsistencies are at the heart of trying to determine, ‘Is somebody, reliable, credible, believable enough for a criminal conviction?’"
Cohen filed a motion to dismiss the counts in January, citing a retrial would "not differ materially from the prior trial" with little likelihood of a different outcome.
Los Angeles Superior Court Judge Charlaine F. Olmedo declared the mistrial in November after finding jurors "hopelessly deadlocked" in reaching a unanimous decision.

He is/was a scientologist. They circled the wagons for as long as they could. Didn't save him. I guess they had to use those resources to save their head guy because a lot of people want to know where the wife went.

Danny Masterson did his own dirty deeds. Misgavich didn't get to be head of Scientology without doing more than a few dirty deeds himself. He's in hiding because they are losing the ability to cover up a lot of stuff. If you get a chance you should was the Reimi documentary series on Scientology.

I knew about Leah, but I might have been a little scared to watch it. Maybe someday. When I lived in LA, I knew a young sci/fi writer who was nice and he invited me to the castle up on Sunset for dinner once. I felt it was creepy there, and I came home shortly thereafter so I don't know if he would have tried to get me to join Scientology. Ick.
