According to "The Art of War", the key is to attack an opponent at the weakness of their strength. In "Marketing Warfare", which adapted the "Art of War", the authors used the example of Burger King taking on McDonalds. McDonalds strength was their speed and consistency - so Burger King took them on with the "have it your way" campaign. McDonalds couldn't, at least not then, respond without jeopardizing their strength.

Looking to attack Edwards (and the trial lawyers as a whole), the GOP shouldn't go after the awards given to the 'victims'. That's the strength of Edwards' argument - the poor people who were harmed by the evil system. There's no way the GOP will or should get traction going after a grieving parent.

The GOP should instead go after the money that Edwards himself took out of the pie - which the WSJ reported yesterday was about $27 million dollars over a four year period.

Assuming Edwards put in a solid 40 hour week, each and every week of the year, his 'pay' was in excess of $3,200 per hour. The first line of attack: which of Edwards' 'two Americas' does someone making $3200 per hour belong? Just how hypocritical is Edwards?

The second line of attack: the money Edwards took had a ripple effect on the health care system. The money that went to the client at least was to compensate them for the harm they suffered. But what about the money Edwards took. What happened as a result of Edwards taking that money? If Edwards had taken less money, more money have been in the system for hospitals and doctors to provide more care to the poor and uninsured. How many people without insurance could have been treated for $27 million? How many poor kids could have bought their $10 winter coat with just a portion of that $27 million?

Now multiply this by the many many trial lawyers who have 'enjoyed' similar paydays. Look at the billions taken by Peter Angelos - he gets to buy the Orioles (and screw them up) while the public is denied the benefit of that money. The same with the other trial lawyers - the private planes, the beachfront and mountain resorts... all flowing to people who have taken money out of the system and put it to their own selfish benefit.

Just like a corrupt cashier who skims the register takes money out of the system and creates ripple effects throughout the system (higher prices, lower employment, lower levels of customer service), so too do trial lawyers skim money out of the system and use it for their own selfish interests.

That, GOP, is the way to go after the trial lawyers. Don't attack their clients. Don't attack the juries, who after all are viewed as regular folks just trying to do their civic duty. Attack the profits the trial lawyers themselves are taking out.

I have long maintained that the lawyer's 'take' is their Achilles heel. We shall see if the Stupid Party ever brings it up. They are already screwed in Fla where their prime candidate is..you guessed it...a tort lawyer!

They won't bring it up. They are ALL lawyers themselves. It should be illegal in this country for lawyers to hold ANY elected office....
