Oregon high court says GOP lawmakers who staged walkout can’t run for re-election​

The 10 state senators staged a record-long walkout last year to stall bills on abortion, transgender health care and gun rights.

SALEM, Ore. — The Oregon Supreme Court said Thursday that 10 Republican state senators who staged a record-long walkout last year to stall bills on abortion, transgender health care and gun rights cannot run for re-election.

The decision upholds the secretary of state’s decision to disqualify the senators from the ballot under a voter-approved measure aimed at stopping such boycotts. Measure 113, passed by voters in 2022, amended the state constitution to bar lawmakers from re-election if they have more than 10 unexcused absences.


Last year’s boycott lasted six weeks — the longest in state history — and paralyzed the legislative session, stalling hundreds of bills.

Five lawmakers sued over the secretary of state’s decision — Sens. Tim Knopp, Daniel Bonham, Suzanne Weber, Dennis Linthicum and Lynn Findley. They were among the 10 GOP senators who racked up more than 10 absences.

During oral arguments before the Oregon Supreme Court in December, attorneys for the senators and the state wrestled over the grammar and syntax of the language that was added to the state constitution after Measure 113 was approved by voters.

The amendment says a lawmaker is not allowed to run “for the term following the election after the member’s current term is completed.” The senators claimed the amendment meant they could seek another term, since a senator’s term ends in January while elections are held the previous November. They argue the penalty doesn’t take effect immediately, but rather, after they’ve served another term.

The two sides also wrestled with the slight differences in wording that appeared on the actual ballot that voters filled out and the text of the measure as included in the voters’ pamphlet.

The ballot said the result of a vote in favor of the measure would disqualify legislators with 10 or more unexcused absences from holding office for the “term following current term of office.” It did not include the word “election,” as the text of the measure that appeared in the pamphlet did. What appeared in the pamphlet was ultimately added to the state constitution.

The state argued that in casting a “yes” vote in support of the measure, voters intended that legislators with that many absences be barred from running after their current term is up.

The senators’ lawsuit was filed against Secretary of State LaVonne Griffin-Valade, who last August said the boycotting senators were disqualified from seeking re-election. She directed her office’s elections division to implement an administrative rule based on her stance.

All parties in the suit had sought clarity on the issue before the March 2024 filing deadline for candidates who want to run in this year’s election.

The 2023 walkout paralyzed the Legislature for weeks and only ended after Republicans forced concessions from Democrats on a sweeping bill related to expanding access to abortion and transgender health care and another measure regarding the manufacture and transfer of undetectable firearms, known as ghost guns.

Oregon voters approved Measure 113 by a wide margin following Republican walkouts in the Legislature in 2019, 2020 and 2021.

Ballot bans have quickly become the Democrats’ central campaign strategy in the upcoming elections this November.

On Thursday, the Oregon Supreme Court upheld a decision by the state’s chief election official to ban 10 Republican state senators from the ballot this fall for walking out of the legislature to protest bills on abortion, guns, and transgenderism.

“Last year’s boycott lasted six weeks — the longest in state history — and paralyzed the legislative session, stalling hundreds of bills,” the Associated Press reported. If enough lawmakers walk out, they can deny the quorum required to legally pass legislation. Through their walkout, Oregon Republicans extracted concessions from Democrats on bills related to firearm transfers and medical procedures for abortion and transgender-identified people.

Voters approved ballot Measure 113 in 2022, which amended the state constitution to boot lawmakers from the ballot for more than 10 unexcused floor absences. Oregon voters passed Ballot Measure 113 after Republican walkouts in 2019, 2020, and 2021.

“We obviously disagree with the Supreme Court’s ruling,” said GOP Senate Minority Leader Tim Knopp, according to the AP. “But more importantly, we are deeply disturbed by the chilling impact this decision will have to crush dissent.”

Democrat lawmakers have also deployed walkouts to block legislation in Texas, Wisconsin, and Indiana. In 2021, Texas House Democrats staged a weeks-long walkout to prevent the passage of a Republican-sponsored election bill. Lawmakers made national headlines for launching the walkout by fleeing the state to Washington D.C., where they met with Vice President Kamala Harris. Democrats in Wisconsin and Indiana also staged legislative walkouts to delay progress on union-busting right-to-work bills.

In the last few months, Democrat U.S. House Rep. Jamal Bowman also received a slap on the wrist for pulling a fire alarm amid Democrats’ attempts to delay a vote on unfunded federal spending.

Stripping Oregon Republicans from ballot access marks the latest episode in a decades-long saga to eradicate the state’s political minority. Conservatives in Oregon have become so disillusioned by the leftist state government that activists are petitioning to redraw the state’s rural eastern counties into Idaho.

Just last year, Oregon Democrats rubber-stamped aggressive laws restricting guns and water use while expanding abortion and transgender interventions. Last year, lawmakers in the Idaho House of Representatives formally approved talks to annex disenchanted neighboring counties from Oregon.

Ballot bans have quickly become Democrats’ central campaign strategy, with former President Donald Trump disqualified as a candidate in Colorado and Maine. Challenges to Trump appearing on ballots have been filed in at least 35 states and remain unresolved in 16. The U.S. Supreme Court will hear oral arguments in an appeal of Colorado’s court-ordered Trump removal next week.

Democrats are also working to keep Robert F. Kennedy Jr. off primary and state ballots, fearing his effect on Joe Biden’s re-election chances.

The Oregon Supreme Court ruled Thursday that 10 GOP state senators cannot run for reelection after they refused to attend Senate sessions for about six weeks out of protest last year in an attempt to stall Democratic-backed bills.

The court ruling upholds a secretary of state decision to keep the lawmakers off 2024 ballots, citing a 2022 referendum that bars lawmakers from seeking reelection if they have more than 10 unexcused absences.

The six-week boycott of the session stopped work and prevented voting, the longest such freeze in the state’s history. The absent lawmakers demanded legislative concessions in exchange for their return.

Republicans control a minority of the state Senate, 12 of the body’s 30 seats. By walking out, the Senate could not reach a quorum and conduct votes.

Five of the lawmakers challenged the secretary of state decision, arguing that the specific wording of the 2022 referendum should allow them one more term before being barred from office.

Court arguments focused on the grammar of the referendum, with each party arguing over when the election ban would take place.

The constitutional amendment says a lawmaker is not allowed to run “for the term following the election after the member’s current term is completed.” The lawmakers argued that would let them run again, as the election is held before the end of their terms, with the secretary of state and ultimately the state Supreme Court disagreeing.

News here had that yesterday, and one of the senators said that if they cannot run for re-election, then nothing might get done this year either, because they'll have another incentive to not attend sessions, or something like that.
