Wisconsin Supreme Court Temporarily Suspends Judge Hannah Dugan’s Judicial Powers After Helping Illegal Immigrant Evade Arrest

The Wisconsin Supreme Court has taken the extraordinary step of temporarily suspending Milwaukee County Circuit Judge Hannah Dugan from the bench after she was arrested and charged with two federal crimes for helping an illegal immigrant avoid arrest by federal immigration agents.

According to the federal indictment, Judge Dugan illegally escorted Eduardo Flores-Ruiz and his taxpayer-funded public defender through a side door in her courtroom after learning ICE agents were waiting in the hallway to arrest him following a court appearance on April 18.

This blatant attempt to subvert justice was thwarted when federal agents apprehended Flores-Ruiz after a brief foot chase outside the Milwaukee County Courthouse.

On April 25, Judge Dugan was arrested by the FBI inside the courthouse in full view of staff and attorneys. She made a brief initial appearance in federal court before being released pending trial.

FBI Director Kash Patel posted a photo of the arrest of Wisconsin Judge Hannah Dugan by FBI agents for helping an illegal alien with a domestic violence case in her courtroom evade arrest by ICE agents.

Patel captioned the photo, “No one is above the law.”

Judge Dugan faces two federal counts:

One felony count of obstructing a U.S. agency
One misdemeanor count of harboring or concealing an alien to prevent arrest
If convicted, she faces up to six years in federal prison and $350,000 in fines.

In response to the serious criminal charges, the Wisconsin Supreme Court issued a scathing two-paragraph order stating Judge Dugan is suspended from all judicial duties effective April 29, citing the need to maintain public trust in the integrity of the judiciary.

“In the exercise of that constitutional authority and in order to uphold the public confidence in the court of this state during the pendency of the criminal proceeding against Judge Dugan, we conclude on our own motion that it is the public interest that she be temporarily be relieved of her official duty,” said the two-paragraph order on Tuesday.

Milwaukee’s Chief Judge Carl Ashley announced her docket will be reassigned to a reserve judge, effectively stripping Dugan of any authority while the case proceeds.

BREAKING: A federal grand jury indicted Milwaukee County Judge Hannah Dugan on Tuesday after she allegedly helped an illegal immigrant evade ICE capture in her courtroom in April.

Federal officials showed up at Dugan’s courtroom on April 18 looking to arrest Mexican national Eduardo Flores-Ruiz, who was in court that day for three counts of battery and domestic ab*se.

After being informed of the agents’ presence by her courtroom deputy, the judge “became visibly angry, commented that the situation was ‘absurd,’ left the bench, and entered chambers.”

Dugan confronted the plainclothed federal agents in the hallway and demanded that they leave.

Multiple witnesses then watched as the Milwaukee County judge directed Flores-Ruiz and his attorney to leave through a “jury door,” which leads to a nonpublic area of the courthouse.

Agents were able to chase down and apprehend the illegal immigrant.

Judge Dugan was arrested and charged with two federal charges: obstruction of a federal agency, which is a felony; and concealing a person to help them avoid arrest, a misdemeanor.

Federal Grand Jury Indicts Milwaukee Judge Hannah Dugan For Obstructing ICE Arrest

A federal grand jury on Tuesday indicted Milwaukee County judge Hannah Dugan for obstructing an ICE arrest last month.

Last month Judge Hannah Dugan was charged with two felonies, however, the charges in the grand jury indictment were not immediately clear.

The Milwaukee Journal Sentinel reported:

A federal grand jury indicted Milwaukee County Judge Hannah Dugan on May 13 after a daylong hearing on charges that she tried to assist an undocumented immigrant escape arrest from her courtroom last month.

Dugan, 66, was previously charged with obstructing a U.S. agency and concealing an individual to prevent an arrest. The two charges carry a maximum penalty of six years in prison and a $350,000 fine, but sentences in cases involving nonviolent offenses typically are much shorter.)

It wasn’t immediately clear what charges were contained in the grand jury indictment.

Dugan is expected to enter a plea at a May 15 hearing.

The indictment came after a string of witnesses entered the federal courthouse throughout the day on May 13 to testify before the grand jury.

Last month Milwaukee County judge Hannah Dugan was arrested by the FBI for obstructing an ICE arrest.

According to the FBI, Judge Hannah Dugan obstructed an immigration arrest operation last month. Dugan became angry when she found out that ICE agents were waiting outside of her courtroom last week to arrest Eduardo Flores-Ruiz, an illegal alien involved in a domestic abuse case she was overseeing. She allegedly directed Flores-Ruiz to exit the courthouse through a private jury door to evade arrest.

FBI Director Kash Patel said Judge Dugan “intentionally misdirected federal agents away from the subject to be arrested at her courthouse.”

US Attorney General Pam Bondi said Judge Dugan screamed at immigration officers last week before helping the illegal alien evade arrest.

“The judge learned that ICE was outside … She goes out in the hallway, screams at the immigration officers — she’s furious, visibly shaking, upset — sends them off to talk to the chief judge. She comes back in the courtroom … takes the defendant and the defense attorney back in her chambers, takes them out a private exit and tells them to leave,” Bondi said on Fox News last month.

Judge Dugan did not speak to reporters as she climbed into a vehicle waiting for her after her hearing last month.

NEW: Milwaukee County releases footage showing Judge Hannah Dugan apparently sneaking an illegal immigrant out of the building by deceiving ICE agents.

The footage shows Eduardo Flores-Ruiz being snuck out of the courtroom before he got in a foot race with agents.

Dugan was seen distracting the agents so Flores-Ruiz could escape. Unfortunately for her, another agent was in the hallway observing what was going on.

Once outside, ICE agents chased down and caught Flores-Ruiz who was running from the courthouse.

The judge was arrested a month later.

She has plead not guilty and will appear in federal court on July 9 for her pretrial hearing.

Her trial is set for July 21.

A federal magistrate judge on Monday said Milwaukee County Judge Hannah Dugan is not entitled to dismiss her federal case on a judicial immunity claim.

“Dugan moves to dismiss the indictment under Fed. R. Crim. P. 12(b) on the grounds that she, as a judge, is immune from criminal prosecution for judicial acts, that her prosecution violates the limits of federal power under the Tenth Amendment, and that the indictment could be dismissed under the canon of constitutional avoidance,” magistrate judge Nancy Joseph wrote.

“For the reasons explained below, I recommend that Dugan’s motion to dismiss be denied,” the judge said.

In May, Milwaukee County Judge Hannah Dugan moved to dismiss the case against her one day after a federal grand jury indicted her on two counts for obstructing an ICE arrest this Spring.

Dugan is facing up to six years in prison and $350,000 in fines.

The video shows Hannah Dugan in her robes walking through the courthouse halls and confronting ICE agents dressed in plain clothes.

Later on, the illegal alien, Flores-Ruiz, and his lawyer are seen sneaking out the “jury door” so he could evade arrest.

Federal agents were then seen running into the street and chasing Flores-Ruiz before apprehending him. Judge Dugan put the agents in danger.

Um. A "Judicial Act" is an act resulting from a judicial pronouncement.

As in judge orders so and so to do this and that.

If so and so is "damaged" by the this and that, the judge is not responsible. Judicial pronouncements become not the responsibility of the judge but rather the responsibility of the governing body.

Damaged so and so could sue the state for compensation. The lawsuit will be before another judge and the damaging judge MAY be called to testify - but the compensation is paid for by the state. The damaging judge is not responsible.

If the judge aids a defendant to "escape" execution of the law, that is on the judge - just like it would be for any other citizen.

A month after her arrest, surveillance footage from inside the courthouse showed Dugan seemingly pointing ICE agents in the wrong direction on purpose so that Flores-Ruiz could avoid arrest.

On Dugan’s defense team is former President George W. Bush official Paul Clement and Steve Biskupic, a former United States attorney and a Bush appointee.
