Durham probe: Ex-FBI lawyer to plead guilty in first criminal case arising from review, sources say

Former FBI lawyer Kevin Clinesmith will plead guilty to making a false statement in the first criminal case arising from U.S. Attorney John Durham's review of the investigation into links between Russia and the 2016 Trump campaign, two sources close to the matter tell Fox News.

Clinesmith was referred for potential prosecution by the Justice Department's inspector general's office, which conducted its own review of the Russia investigation.

Specifically, the inspector general accused Clinesmith, though not by name, of altering an email about former Trump campaign adviser Carter Page to say that he was "not a source" for another government agency. Page has said he was a source for the CIA. The DOJ relied on that assertion as it submitted a third and final renewal application in 2017 to eavesdrop on Page under the Foreign Intelligence Surveillance Act.

BARR TEASES 'DEVELOPMENTS' IN DURHAM PROBE, SAYS INVESTIGATION WON'T BE 'DICTATED' BY ELECTION

Clinesmith is being charged in federal court in Washington and is expected to plead guilty to one count of making a false statement, his attorney Justin Shur told The Associated Press.

Durham was appointed by Attorney General Bill Barr last year to investigate the origins of the FBI’s original Russia probe, shortly after former Special Counsel Robert Mueller completed his years-long investigation into whether his campaign colluded with the Russians to influence the 2016 presidential election.

Durham’s timeline was focused on July 2016, when the FBI’s original Russia probe began, through the appointment of Mueller in May 2017.

Mueller’s investigation yielded no evidence of criminal conspiracy or coordination between the Trump campaign and Russian officials during the 2016 election, though the question of whether Trump obstructed justice was left open in the final report.

TRUMP LAYS DOWN GAUNTLET FOR BARR IN DURHAM PROBE: EITHER 'GREATEST ATTORNEY GENERAL' OR 'AVERAGE GUY'

The development Friday comes amid much speculation, and even a tip-off by Barr, who said on Fox News’ “Hannity” that there would be a “development” in the investigation, teasing that it wouldn’t be “earth-shattering,” but would be “an indication that things are moving along at the proper pace as dictated by the facts in this investigation.”

“There are two different things going on,” Barr said. “I said the American people need to know what actually happened, we need to get the story of what happened in 2016 and ’17 out. That will be done.”

Barr also said that “if people crossed the line, if people involved in that activity violated criminal law, they will be charged.”

Barr touted Durham as an “independent” and “highly experienced” man, and said his investigation is “pursuing apace,” despite delays he blamed in part on the coronavirus pandemic.

SOURCE SAYS FBI AGENT USED 2016 BRIEFING ON ELECTION INTERFERENCE AS 'COVER' TO QUESTION TRUMP TEAM

Meanwhile, last month, Fox News reported that a declassified document revealed that the FBI agent who delivered a defensive briefing on election interference to the Trump campaign in August 2016 “actively listened” for certain topics – using it as a “cover” to monitor then-candidate Donald Trump and Michael Flynn, a source familiar with the document said.

The agent delivering the briefing was Joe Pientka. Pientka's notes followed an Aug. 17, 2016 briefing to then-candidate Trump, Michael Flynn and Chris Christie, "in support of ODNI briefings provided to U.S. Presidential candidates and two of their advisors."

The document was dated Aug. 30, 2016, and filed under “Crossfire Hurricane,” the FBI’s code name for its investigation into whether the Trump campaign was colluding with the Russians to influence the 2016 election; “Crossfire Razor,” the FBI’s code name for the investigation into Michael Flynn; "Russia Sensitive Investigative Matter," and FARA, the Foreign Agents Registration Act.

The document stated that Clinesmith and FBI official Peter Strzok "approved" Pientka's notes.

The Associated Press contributed to this report.

This is almost analogous to getting one of Capone's bookkeepers to take a plea and potentially flip.

This weekend was already primed to be "interesting", but now all the more so.....

Deep State Lawyer Kevin Clinesmith Texted 'Viva la Resistance'
Charlie Spiering
2-2 minutes

Former FBI lawyer Kevin Clinesmith, who plans to plead guilty for falsifying documents in the investigation of President Donald Trump’s campaign, was found to have sent several anti-Trump texts after Trump was elected.

“Viva le resistance,” he texted an FBI colleague in November 2016 after Trump won when he was asked if he would serve in the Trump administration.

Clinesmith’s texts and the decision to alter the email were featured in the report issued by the Department of Justice Inspector General Michael Horowitz.

The New York Times confirmed that Clinesmith was “FBI Attorney 2” in the Horowitz report.

In his texts, Clinesmith also expressed disappointment after the election that “the crazies won finally” and that the Trump administration would be “the tea party on steroids.”

“The GOP is going to be lost, they have to deal with an incumbent in 4 years,” he wrote. “We have to fight this again. Also Pence is stupid.”

From the Horowitz report:

Clinesmith also blamed the FBI for Trump’s victory, saying then-Director James Comey’s letter confirming that investigation of Hillary Clinton’s emails was still open “broke the momentum” of the presidential race.

“I am so stressed about what I could have done differently,” he wrote.

Clinesmith also wrote that he feared Trump’s “systematic disassembly of the progress we made over the last 8 years,” including Obamacare.

He argued to the Inspector General that his texts were personal “commentary” and did not affect his professional work on the investigations.

I was just over to The Conservative Treehouse and apparently this announcement is not related to the big reveal that Sundance said he would have today. In fact from the comments section, this announcement is more in line with trying to toss a bone to the Republican base. So if all is going well with Sundance, there should be more news on this front.

If we were to report on this the way the leftist media reported on the Mueller probe, we might say the walls are closing in.

Hope they really are this time, but we will see.

Playing devil's advocate here. Anyone think President Trump will make a "deal" to make this all go away if the Covid crap is stopped and the economy is allowed to open up?

I'm hoping not. I'm looking forward to the three ring judicial circus. :popcorn1:

I think it might’ve been a bone for Sundance. He’s saying now that he’ll wait until Tuesday.

COVID served MANY purposes.

One of them:

The economy took a significant downturn in August 2019....4 key events took place. I can not remember them all....perhaps someone can help out here.

1. The Treasury bond yield inverted. A sign of panic in the bond market (which is huge in comparison to the equity market), and typically is a sign of impending recession.
2. Germany announced that it would not underwrite the losses of D Bank.....(How could they?)
3. There was some bad employment info.
4. ____________________________

The resultant panic manifested itself publicly in the collapse of the Repo market in Sept. 2019. The Repo market is essentially the pawn shop of lousey investments among banks to raise short term cash (often for 24 hrs.). Essentially, banks would not fund other banks pledging toxic collateral....as they did not trust that they would be repaid 24 hrs later!!!

The bandaid approach was to increase the money supply and throw newly printed money in MASSIVE amounts at the problem. They have been doing so ever since.

Coincidentally, COVID was released from a Wuhan Lab, and served as cover for the bailouts.

The point is.....the economy has been tanking since Lehman in 2008.....escalated in a particular way in Aug-Sept 2019, and was doing the toilet swirley before COVID became a public name.

THE ECONOMY IS NOT GOING TO BE SIMPLY TURNED AROUND REGARDLESS OF WHAT HAPPENS WITH COVID OR THE NEXT PATHOGEN RELEASED INTO THE PUBLIC.

Clinesmith is the beginning of what should build into a crescendo.

Reports are that he ratted out superior(s) to save his hide, and his guilty plea as discussed above is breaking the ice, sending a distinct signal to the Communists....that the fat lady is clearing her throat.

I am very well aware of events today.
Discretion is the better part of valor.

WASHINGTON – A Former FBI attorney will plead guilty to making false statements in documents used to obtain a surveillance warrant against former Trump aide Carter Page, his lawyer told the Associated Press Friday.
The guilty plea from Kevin Clinesmith is the first legal action taken in an investigation led by John Durham, a U.S. attorney looking into the origins of the Trump-Russia probe and other intelligence-gathering activities related to the Trump campaign.
Clinesmith’s lawyer, Justin Shur, told the Associated Press that his client will plead guilty to a single false statements charge as part of a cooperation agreement with the government. (more)
Tuesday.

I’ve also seen reports that Baker is cooperating....he was Clinesmith‘s manager.

I would hope that he'd know that such a deal was worth less than the media it was recorded upon.

Count me amongst those who believe that Trump is going to throw a wide lariat.

I still remember the mystery notes at the funeral of George Ist.....still think that Team Trump put the top crooks on notice, then.
