DOJ Seeking Additional Time On Arm Brace Ruling

Nine months after the Second Amendment Foundation sued the Department of Justice and Bureau of Alcohol, Tobacco, Firearms and Explosives in federal court over ATF’s flip on how it regulates stabilizing braces on pistols, the DOJ and SAF jointly asked for a continuation of a stay in the legal action to allow processing of more than 211,000 public comments on a proposed rule on “Factoring Criteria for Firearms with Attached Stabilizing Braces.”

The process is expected to require more than four months.

According to a Joint Status Report filed with the court, it will take more than 120 days for the DOJ to process all the responses. All parties agreed to the delay, according to SAF and have requested that they be allowed to file another Joint Status Report on or before Jan. 19, 2022.

Oh, absolutely, make your voice heard, but also remember this…

It doesn’t matter what laws, directives, legislation, etc the ATF puts out, if they infringe on RKBA, then that faux law is illegal and not only do we all have the right to ignore it, but I’d argue, we have a duty to exercise the exact blood bought freedom that is contrary to such a bogus “law”.

My comments included how bad they looked the last time Obama/Biden used them as a political tool in operation Fast and Furious.

I am certain they did not learn from killing hundreds of Mexicans, several Americans and at least one Fed LEO Border Patrol agent.

In order to downsize all departments without actually "firing" anyone,

I'd setup offices in antarctica, and notify the undesirables their offices had moved. They would have 2 months to move, or their absence would be considered voluntary resignations.

This ruling is not only anti 2A, it is discriminatory against the handicapped and elderly who would need it to properly and safely protect themselves using a weapon.

Example: Sue Aikens of "Life Below Zero" fame needed to use one while recovering from surgery. While most people don't have to protect themselves from man eating grizzlies and wolverines it makes the point.

I gave Trump a chance. I’ve come to believe he is no different than any other president. There’s nothing he did, that we are still able to enjoy today.

Easy....declare the ATF UNCONSTITUTIONAL disband them and take their funding and use it elsewhere....like for instance the CMP (Civilian Marksmanship Program). Take back all the various arms we gave/lend-leased/sold to other countries around the world. Re-arsenal them and put them to good use by US citizens against communists and socialists. WIN-WIN!

Just think how much taxpayer dollars could be saved/gained by selling off all their buildings, vehicles, equipment and firearms!!

If I were president, I would dissolve the BATF on my first day in office.

Actually easier thing would be to make life hell for those working for agencies with clever policies. Work on killing pensions and insurance and bonding. Make it miserable fiscally and the agencies become vacant and then do away with.

New ATF Document Reveals Gun Owners Who Own 'Pistol Braces' Could Be Forced To Register​

Readers know the Biden administration has weaponized the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) to wage war on law-abiding gun owners and manufacturers.

AmmoLand News reported the latest move by the ATF could force law-abiding gun owners who own pistol braces to register them with the federal government.



The plan (or request) for a registry of pistol braces was buried within a document about a budget justification from the ATF to the Office of Management and Budget (OMB). Here's what the document says:

"Due to the upcoming Amnesty Registration of Pistol Brace weapons, photos of the weapon being registered will be required to prove the weapon does utilize a pistol brace in its configuration and would qualify for an amnesty registration."

"Our ATF inside sources have told AmmoLand News that the ATF was planning for an amnesty period where gun owners would be able to register their braced pistols as short-barreled rifles (SBR) and that it is expected they will receive a free tax stamp," AmmoLand's John Crump said.

Ammoland believes there are roughly four million pistol braces in the US, while gun blog website Silencer Central has the figure between three and seven million.

The Biden administration has requested the ATF to redefine the definition of a firearm and change rules surrounding pistol braces.

Democrats have rushed to try and ban anything guns or gun components. Democratic Rhode Island congressman David Cicilline told members of a House Judiciary Committee this summer that pistol braces turn "weapons into automatic weapons" and said, "it becomes a bump stock."

Republican congressman Thomas Massie responded to Cicilline's ridiculous claims, indicating braces are neither a bump stock nor make the weapon fire faster. Instead, it's to shoot more accurately for stabilization purposes.

Here's the full exchange between the Democrat and Republican lawmaker. It just shows how uninformed Democrats are about guns.

"The final pistol stabilizing device rule has not been unveiled. Based on this budget request and information from our sources, it seems to include a registry," Crump concluded, adding the new rule could be unveiled by December of this year, which would mean millions of law-abiding gun owners who own braces would have to file sometime next year.

Remember, we've told readers the ATF has a secret database of "nearly a billion gun records." The purpose of any registry on a long enough timeline is confiscation.

Sue Akins, of Life Below Zero fame, used one after her snowmobile accident messed up her shoulder. So disallowing these braces or limiting their availability, in many cases might be easily viewed as a failure to make an accommodation for a handicap, even if the handicap is temporary. The Americans with Disabilities Act (ADA) protects the rights of people with disabilities. For the elderly, infirm and disabled isn't a brace a reasonable accommodation?

If this gets passed it would be easy to foresee numerous law suites.

I don't own a brace nor feel they're beneficial. What I'm hoping is someone posts the plans to "3d print" them. For all the world to use.

It may have already happened. I wouldn't know the difference in a 3d printer and a bread machine.

I have an awesome 3d print file that I drew for a brace. I have it on many of my guns. They cost about $3.00 each to make on my 3d printer. PM if you want me to email it to you. Below is it on several pistol builds plus the one (brown) SD Tactical Brace.
