BREAKING: DeCarlos Brown Jr., the felon charged with murdering Iryna Zarutska on the Charlotte, NC light rail, has been found “incapable to proceed” with his trial following a mental health evaluation, according to a motion filed in court yesterday.

According to that motion, Decarlos Brown Jr. was evaluated on Dec 29th at Central Regional Hospital and a subsequent report found Brown “incapable to proceed”.

Brown’s lawyers are now asking the court to push back a scheduled April 30th hearing for another six months, which would significantly delay the case.

I would have more sympathy for a once nice dog that gets rabies than for this animal. Both would need destroyed without remorse.

The "insanity" defense should *maybe* stop someone from getting the death penalty if found "not guilty by reason of insanity".
But aside from that, they should be tried and their sentence should be the same as it would be if they were sane. If he's eligible for life without parole, he gets life in a secure mental facility. NO early release because some idiotic psychiatrist decides he's "cured". Also, no "field trips" or "weekend passes"!

Years ago, there was a guy who was found not guilty by reason of insanity for (IIRC) murdering women and drinking their blood. After a few years in a mental hospital, the docs declared him "cured", and a judge let him out.

Only after he got caught having again killed a woman and drinking her blood, did the legal authorities actually look at his records. He had been observed *multiple times* catching Robins and other small birds on the hospital grounds, tearing their heads off, and drinking their blood. That, apparently, wasn't considered a problem!

The teen who admitted to killing three students and injuring three others inside Chardon High school pleads not guilty by reason of insanity. What happens if he wins the case and then is declared sane. Could he be let go? It's happened before.

In 1979 Michael Levine and another man kidnapped supermarket boss Julius Kravitz and his wife. They demanded $1.5 million in ransom. However, for some reason Levine fired a gun on Old Mill Road in Gates Mills, killing Kravitz and wounding Kravitz' wife.

Levine's attorneys said he was crazy and like TJ Lane's lawyers entered a plea of not guilty by reason of insanity. At trial his psychiatrists said he was insane, the county's said he was sane. Judge John Angelotta ruled him insane and not guilty. He was sent to a state hospital, where treatment not punishment is the mission.

Within a few years Levine began asking to be released because he was cured. The hospital agreed. He was brought back to Cuyahoga County for a release hearing every two years.

"He should not be released at anytime in the foreseeable future," said former Attorney General, Lee Fisher.

Every two years there was a successful effort to keep him locked up. But, in 1993 he was released and ordered not to live in Cleveland. But was back in court after he was seen partying in the Flats. That set off a public outcry. The outcry, along with Mrs. Kravitz' efforts won a change in the law.

"The law changed and the jurisdiction was returned back to the trial court," said Henry Hilow, former prosecutor.

Hilow who fought to keep Levine locked up says in criminal court punishment not just a cure can be monitored better than in civil court.

The Death Penalty is on the books in N Carolina but there have been no Death Sentances imposed since early 2000s. I seem to remember there was a slew of appeals from the usual quarters about discrimination and unbalanced race-based prosecutions. That last is self imposed of course. If more blue-eyed people commit more Capital Murder, it follows more blue-eyed peole will be found guilty and wind up on Death Row (exactly where they belong).

Chalk this crap up to the SJW-Progressive Democrat crowd.

I'm betting this scumbag gets time and not a date w/ the executioner. And of course as this will probably be a State-level prosecution, sentencing may be actually lenient in relationship to the heinious nature of the murder.

Worse news is I think he was found incompetant to stand trial so I'm sort of curious how this will wash out.

There should be a category of "no doubt about it, and death is the sentence". Crimes like this should be put in front of a selected group of people who look at the evidence, in this case a video beyond doubt, sane or not, and then be put to death within the week. Call it the FAFO sentence. No real dollars spent, no need to. It's beyond logic for these folks to get a trial when the evidence is way past "alleged".

So let me get this right. Brown has 14 prior arrests, was diagnosed with schizophrenia and was known well by the PD for making fake 911 calls. Yet NO ONE thought there was enough of a problem that he should be locked up? If just one of those "great robed ones" sitting on the judicial bench had enough guts to decree things differently, a beautiful young lady would be alive today.

No more insanity pleas. Give him a trial and if found guilty, then lock him up for life. No more roaming the streets and becoming a threat to someone else. Ms. Zarutska and her family deserve justice.
