In October 2016, shortly before the presidential election, Donald Trump's personal lawyer Michael Cohen paid Daniels $130,000 in hush money to deny that she had an affair with Trump a decade earlier in 2006.[51][52][53] Trump's spokespeople have denied the affair and accused Daniels of lying.[54][55] On behalf of his client, Cohen denied the existence of an affair between Trump and Daniels,[56] but he later stated: "In a private transaction in 2016, I used my own personal funds to facilitate a payment of $130,000 to Ms. Stephanie Clifford."[57]

On March 6, 2018, Daniels filed a lawsuit against Trump. She said that the non-disclosure agreement that she had signed in reference to the alleged affair was invalid because Trump had never personally signed it. The suit also alleges that Trump's attorney had been trying to intimidate Daniels and "scare her into not talking". A day later, Cohen initiated an ex parte arbitration process which resulted in an order that barred Daniels from disclosing "confidential information" related to the non-disclosure agreement. The order itself, which Daniels' lawyers called bogus, was supposed to remain confidential.[58]

In a March 25, 2018, interview with 60 Minutes, Daniels said that she and Trump had sex once, and that later she had been threatened in front of her infant daughter and felt pressured to later sign a non-disclosure agreement.[59][60]

On April 9, 2018, FBI agents raided Cohen's office and seized emails, tax documents and business records relating to several matters, including payments to Daniels.[61]

On April 30, 2018, Daniels filed a lawsuit against Trump on libel charges because he called her statements "fraud". It related to Trump's statements on Twitter saying that Daniels had invented the story of the man who threatened her after she decided to tell journalists about their affair.[62] In October 2018, the suit was dismissed on First Amendment grounds,[63] and Daniels lost her appeal in August 2020.[64]

In August 2018, Cohen reached a plea deal with prosecutors, saying he paid off Daniels "at the direction of the ... candidate" and "for the principal purpose of influencing the election".[5] In September 2018, Cohen offered to invalidate the non-disclosure agreement with Daniels if she would refund the $130,000 Cohen's company paid to her.[65][66] Lawyers for Trump have declared that Trump will neither enforce the non-disclosure agreement nor contest Daniels' claim that it is invalid.[67]

Former President Donald Trump said he expects to be arrested Tuesday in Manhattan — and urged his followers to protest his looming indictment.

“THE FAR & AWAY LEADING REPUBLICAN CANDIDATE & FORMER PRESIDENT OF THE UNITED STATES OF AMERICA, WILL BE ARRESTED ON TUESDAY OF NEXT WEEK. PROTEST, TAKE OUR NATION BACK!,” he thundered in an all caps missive to his followers on Truth Social Saturday morning.
He slammed Manhattan District Attorney Alvin Bragg’s office as “CORRUPT & HIGHLY POLITICAL” in his post.

Trump again insisted he had committed no crime, and reminded his followers that Bragg’s campaign had been heavily financed by liberal billionaire George Soros.

Similarly, state courts must sometimes decide issues of federal law, but they are not bound by federal courts except the U.S. Supreme Court. The U.S. Supreme Court, a federal court, is mandatory on state courts when it decides an issue of federal law, such as Constitutional interpretation.

It looks like a State Indictment/Trial/Decision is binding EXCEPT if appealed.

And that appears to be the point of anything Manhattan District Attorney throws at this - "Lawfare." Continue to harass and cause Trump to expend resources until he can't continue. Meanwhile giving the MEEDIA fodder to throw at Trump and try to sway public opinion.

Bannon's War Room via Marjorie Taylor Green discussed this and her read on the politics is that "This will only make Trump MORE POPULAR." Mike Davis of the Article 3 Project says "This indictment is dead in the water." And he should know being a former Supreme Court Lawyer.

Truthfully, the whole thing is designed to be a "media circus." Already most online sources say the sum paid to Stormy Daniels is "hush money." As if they somehow know that Ms. Daniel's claims are valid? And MEEDIA takes her claim over his because "After all it's Trump we're talking about and he MUST be guilty." (Of anything/everything/all things.)

It is not unusual for persons of Trump's $tature to "pay off" those who make claims against him. Sometimes a paid claim is cheaper than a successful defense.

That is, if the recipient of the claim adheres to the terms of the agreement. Ms. Daniels (whatever her name of the day is) did not and apparently is rolling the dice for a bigger return.

And the Democrats are more than willing to help.

NEW YORK — Donald Trump said in a social media post that he expects to be arrested Tuesday as a New York prosecutor is eyeing charges in a case examining hush money paid to women who alleged sexual encounters with the former president. Trump provided no evidence that suggested he was directly informed of a pending arrest and did not say how he knew of such plans.

But in a Saturday morning message on his Truth Social network, Trump noted “illegal leaks” from the Manhattan district attorney's office that he said indicate “THE FAR & AWAY LEADING REPUBLICAN CANDIDATE & FORMER PRESIDENT OF THE UNITED STATES OF AMERICA, WILL BE ARRESTED ON TUESDAY OF NEXT WEEK.”

Danielle Filson of the district attorney's office said prosecutors “will decline to confirm or comment” on questions pertaining to Trump’s post, as well as potential charges. A Trump spokesman did not immediately respond to calls for comment.

The indictment of Trump, 76, would be an extraordinary development after years of investigations into his business, political and personal dealings. It is likely to galvanize critics who say Trump, a 2024 presidential candidate, lied and cheated his way to the top and to embolden supporters who feel the Republican is being unfairly targeted by a Democratic prosecutor.

In his social media post, Trump repeated his lies that the 2020 presidential election he lost to Democrat Joe Biden was stolen and he urged his followers to “PROTEST, TAKE OUR NATION BACK!” That language evoked the message from the then-president that preceded the riot at the U.S. Capitol on Jan. 6, 2021 when his supporters broke through doors and windows of that building and left officers beaten and bloodied as they tried to stop the certification of the election.
Law enforcement officials in New York have been making security preparations for the possibility that Trump could be indicted.

There has been no public announcement of any time frame for the grand jury’s secret work in the case, including any potential vote on whether to indict the ex-president.

Trump's posting echoes one made last summer when he broke the news on Truth Social that the FBI was searching his home as part of an investigation into the possible mishandling of classified documents.

The grand jury in Manhattan has been hearing from witnesses, including former Trump lawyer Michael Cohen, who says he orchestrated payments in 2016 to two women to silence them about sexual encounters they said they had with Trump a decade earlier.

Trump denies the encounters occurred, says he did nothing wrong and has cast the investigation as a “witch hunt” by a Democratic prosecutor bent on sabotaging the Republican’s 2024 presidential campaign.

Manhattan District Attorney Alvin Bragg’s office has apparently been examining whether any state laws were broken in connection with the payments or the way Trump’s company compensated Cohen for his work to keep the women’s allegations quiet.

Daniels and at least two former Trump aides — onetime political adviser Kellyanne Conway and former spokesperson Hope Hicks — are among witnesses who have met with prosecutors in recent weeks.

Cohen has said that at Trump’s direction, he arranged payments totaling $280,000 to porn actor Stormy Daniels and Playboy model Karen McDougal. According to Cohen, the payouts were to buy their silence about Trump, who was then in the thick of his first presidential campaign.

Cohen and federal prosecutors said the company paid him $420,000 to reimburse him for the $130,000 payment to Daniels and to cover bonuses and other supposed expenses. The company classified those payments internally as legal expenses. The $150,000 payment to McDougal was made by the then-publisher of the supermarket tabloid National Enquirer, which kept her story from coming to light.

Federal prosecutors agreed not to prosecute the Enquirer’s corporate parent in exchange for its cooperation in a campaign finance investigation that led to charges against Cohen in 2018. Prosecutors said the payments to Daniels and McDougal amounted to impermissible, unrecorded gifts to Trump’s election effort.

Cohen pleaded guilty, served prison time and was disbarred. Federal prosecutors never charged Trump with any crime.
