There are MANY fails of the Jack Smith prosecution.
Not the least of which is the Presidential Records act - which most recently has been revealed was "rescinded" by Biden to give Jack Smith license to go ahead with the raid.
As in - how can ANY president "rescind" a Congressional Edict? (i.e. a "law")
There is this thing of "separation of powers of state" for a reason - and this appears to be one of them.
Now if the Supreme Court finds reason to "rescind" any law - about the only reason to rescind would be if someone's Civil Rights were involved - then MAYBE. And even then the rescind HAS to be "reactive" - as in Congress or the Administrative State pays attention.
And herein you see the limitation of separation of powers of state. ANY one of the three enumerated powers has to have something to "compel" the other power.
In the case of the Congress it has the power of the purse - it can shut off money to a Jack Smith over-reach of established Presidential Record "right." And they may still do this looking ahead to the next election and how their particular "political optics" is.
In this case, the Trump conviction (and there will be a conviction since this is a purely political motivated trial and conviction/sentencing) will be appealed to the Supreme Court - and right now the read is 3 to 6 or 4 to 5 supporting Trump.
But this takes time - and likely Trump will run for President ANYWAY since there is no Constitutional mandate against him running - even if he is in jail.
