New York Governor Kathy Hochul called a special session of the state legislature after the Supreme Court knocked down their firearm restrictions. The new law, which passed both chambers of democrat-controlled government, takes effect Sept 1st and is unlikely to hold up once challenged in court. The new law is stunningly over the top.

Keep in mind, when writing the majority decision Justice Clarence Thomas concluded there was no historical requirement that law-abiding citizens show the kind of special need for self-defense required by the New York law to carry a gun in public. Indeed, as Thomas wrote, there is “no other constitutional right that an individual may exercise only after demonstrating to government officers some special need.”

The latest effort from the New York assembly is outlined in an Associated Press report which includes:

(Via AP) […] Among other things, the state’s new rules will require people applying for a handgun license to turn over a list of their social media accounts so officials could verify their “character and conduct.”

Applicants will have to show they have “the essential character, temperament and judgment necessary to be entrusted with a weapon and to use it only in a manner that does not endanger oneself and others.” As part of that assessment, applicants have to turn over a list of social media accounts they’ve maintained in the past three years.

[…] The bill approved by lawmakers doesn’t specify whether applicants will be required to provide licensing officers with access to private social media accounts not visible to the general public.

People applying for a license to carry a handgun will also have to provide four character references, take 16 hours of firearms safety training plus two hours of practice at a range, undergo periodic background checks and turn over contact information for their spouse, domestic partner or any other adults living in their household.

[…] Under the new system, the state won’t authorize permits for people with criminal convictions within the past five years for driving while intoxicated, menacing or third-degree assault. People also won’t be allowed to carry firearms at a long list of “sensitive places,” including New York City’s tourist-packed Times Square.

That list also includes schools, universities, government buildings, places where people have gathered for public protests, health care facilities, places of worship, libraries, public playgrounds and parks, day care centers, summer camps, addiction and mental health centers, shelters, public transit, bars, theaters, stadiums, museums, polling places and casinos.

New York will also bar people from bringing guns into any business or workplace unless the owners put up signs saying guns are welcome. People who bring guns into places without such signs could be prosecuted on felony charges.

I'm glad that in Florida things aren't that bad. Here the only thing you need to get a CCW is a clean record (i.e. no felonies, no restraining orders for domestic abuse, things like that.) and proof of firearms safety training. If not a vet, you need to show proof you passed a class. If you are a vet, you just need a copy of your DD-214.

I'm glad that in Florida things aren't that bad. Here in MS we have a couple of levels, or did have. 1) pay the fee, they do a background check, and you get your license in about 6 weeks, if you pass the check. 2) Do the safety class, get an enhanced license 'course pay the extra fee for enhanced and background check and in about 6 weeks get the license.

Now we have is it ....Constitutional Carry, where anyone can carry without a license, but it's only good for in state carry.

The safety class is a really good thing. IF those who offer it, go through with it, and not just pencil whip the document. Which I know several places do.

My safety class was 10 hours, there were 8 of us in the class, and about half didn't know the first thing about a gun. One woman, bless her heart, bought a double action revolver a few days before the class and couldn't even work it in double action, using both hands.

Another example: The class was asked: Who all owned a revolver. Out of those who answered (6) the next question was which way does it turn. Only one knew.

Everybody had semi-auto's but only about half knew if theirs was a single or double action, with a hammer. Or striker fired.

So I think the safety class should be a must. Like hunter safety classes before you can get a hunting license.

This is what I said earlier in another thread. They will "abide" by their definition of the new rules and stretch them to make it all but impossible to get a permit unless you are one of the favored classes.

There is no constitutional requirement for "good character" to carry a weapon. NONE

Add also they have listed as "sensitive" just about every square inch of NY ( cities wise ) and you still can't carry if you have the permit.

Effectively, it is still a no issue state unless you are favored.

I think it would be difficult for the Supreme Court to litigate against someone whose most imflamatory posts were in favor of the Founders of our Republic, The Founding documents, support of the military and LEO, and distaste for communism and all its fellow travelers. I think Justice Thomas would hold such a person in high regard. Perhaps others as well?

More of that hypocricy would have to manifest itself in a big way in order to convict such a person. Kinda negates the reason the Supreme Court was created in the first place?

So what if you do not have any social media accounts to turn over and my self do not have any such accounts?
Do they automatically reject your application for permission to own to have to hold and carry a firearm?
The state is putting all kinds of hoops one must jump threw ahead of the right, I see nothing in the constitution that allows the state to do this to restrict access to any of the constitutional rights.

I believe part of the court's decision specifically called out these kinds of "workarounds" of their decision. They won't stand; they'll be stalled by injunctions - until the court tells them WHY. This is just another front line in the ongoing battle.

The people do have the right to go after elected officials for violating their constitutional provisions and rights and the elected officials are subject to fines payable to the plaintiff (I'm not making this up), you are the beneficiary of the United States Constitution.

Who defines what "legally" constitutes "social media?"

Would TB2K "properly" fit the "intended" definition of "social media?"

Every pizzeria, restaurant, bookstore, and everywhere else in New York needs to get sued, pronto. Just like the man said. "Decide whether or not I can express my constitutional right."

It seems the Courts are going to have to readdress this with simple language that states NO Infringement of any kind including permits or prequalification
