CCLA Will Fight Invocation of Emergencies Act in Court

The Canadian Civil Liberties Association (CCLA) announced today that it will pursue litigation to challenge the federal government’s use of the Emergencies Act.

“We have retained Ewa Krajewska of Henein Hutchison LLP to take the federal government to court. We have said all along that the federal government did not meet the high burden necessary to invoke the Emergencies Act,” said Noa Mendelsohn Aviv, Executive Director of the CCLA.

“This morning I listened carefully to the Prime Minister and heard no new legal justifications for a national emergency and the enormous power the government is hoping to give to itself to bypass the typical democratic process. The situation in Ottawa has been complicated, difficult and painful, in particular for marginalized communities who have experienced racial and homophobic intimidation by some. Governments already have the lawful authority to address difficult situations and do so all the time. This use of the Emergencies Act is unnecessary, unjustifiable and unconstitutional.”

“Our society needs peaceful assembly – a critical democratic tool – even though not every person agrees with the content of every movement.”

“Some protests can even be disruptive. It is possible for a gathering to be both disruptive and also peaceful and nonviolent. Disruptive protest that may be unlawful, like blocking a pipeline or occupying a a public space, can also be the most effective way of raising awareness for people who do not have power,” concluded Mendelsohn Aviv.

“We do not want to minimize the impacts of the protests that are occurring across the country. But, while some of the blockades have been immensely disruptive, it is unclear that the ongoing protests “endanger the lives, health or safety of Canadians” so as to rise to the threshold of a national emergency under the law,” said Abby Deshman, Director of Criminal Justice for the CCLA.

“The emergency orders that the government has tabled are not targeted. They are not limited to specific protests, or specific geographic locations. They are expansive emergency orders that have already come into effect and apply equally across the entire country. And they place unprecedented restrictions on every single Canadian’s constitutional rights.”

“The current emergency orders place significant limits on peaceful assembly across the entire country. They require financial institutions to turn over personal financial information to CSIS and the RCMP, and to freeze the bank accounts and cut off financial services provided to anyone who has attended, or who has provided assistance to those participating in, a prohibited assembly – all without judicial oversight.”

“It is in light of all these violations of civil liberties that we will be taking the government to court,” finished Deshman.

In the first Ottawalks video of today, he captures police breaking the windows of an RV in from of the Chapter store, arresting the driver, and then a tow truck yanks the RV away, probably damaging it.

Recently, in Zoke's live stream, one can clearly see at least four men, dressed in black, on a rooftop who might be snipers. Guns are not visible.

The live streams aren't being jammed (yet) and are enlightening. Some in the crowd believe this is all just a show of force. Time will tell on that.

Two recent polls show Canada’s Prime Minister Justin Trudeau’s favorability is at 16%. The truckers are more unpopular than popular at 44% approval but they’re doing better than Trudeau.

So, to get his numbers up, Blackface Justin is declaring martial law against the truckers.

Justin Trudeau is making a declaration of “emergency” to suspend civil rights and impose a state of martial law due to the Freedom Convoy protests.

Trudeau is invoking an executive order that was formerly called the War Measures Act. The Emergencies Act is the War Measures Act that was used during two world wars and in 1970 when militant Quebec separatists kidnapped a British diplomat.
Canadian media reports Trudeau is considering using the military. In other words, Trudeau is suspending their Constitution and their fundamental rights.

Some premiers are pushing back against Trudeau for invoking the Emergencies Act. Why won’t he just give them back their rights? Instead, he does the opposite.
At the same time, he claims he will always defend the rights of Canadians. He didn’t care a hoot about blockades by BLM.

The law he’s using is not to be used against protesters or dissenters but he’s likely making them into criminals or terrorists.

Ontario Premier Doug Ford announced Monday that the province will begin to ease some COVID-19 restrictions; vaccine passports will no longer be required as of March 1. He is working with the trucker organizers to end the blockade.

Four premiers have stated their discontent with Prime Minister Justin Trudeau’s reported decision to invoke the Emergencies Act. Premier Scott Moe (Sask.), Jason Kenney (Alb.), Francois Legault (Queb.), and Heather Stefanson (Man.) voiced their displeasure with Trudeau’s move.

The B.C. government would support federal officials invoking the Emergencies Act to deal with ongoing trucker convoy protests in Ottawa, Deputy Premier Mike Farnworth said Monday.

Freedom Convoy organizer Tamara Lich messaged Trudeau, “We will hold the line.” Lich said that the protestors would remain “peaceful and planted at Parliament till the mandates are removed.”

On Friday, former President Trump called Trudeau a “far-left lunatic.”

“The Freedom Convoy is peacefully protesting the harsh policies of far-left lunatic Justin Trudeau who has destroyed Canada with insane Covid mandates,” Trump said.

Yes! I've been watching this unfold on several live streams today (during other tasks). It's horrific, for many reasons. Trudeau needs to be removed. Immediately.

If they tear-gas the crowd, the new police chief needs to be removed. Immediately.
