I'm seeing a lot of ignorance and misinformation flying around about what happened in Kenosha, and I'm going to set the record straight from a professional legal position... as well as from a former military position. I'm going to explain some things from a more technical angle derived from my many years as a paralegal and from my experience working in federal criminal justice and prosecution.

Legally, if you are in the process of a commission of a crime, it negates your ability to claim self defense if you kill someone. As in, it can't even be entered as your official defense in court. It is similar to getting rear-ended at a red light through zero fault of your own, but you were driving without a license or insurance. It automatically makes you at fault because you weren't even legally allowed to be driving.

That 17 year old in Kenosha had committed two crimes and was not even legally allowed to open carry the rifle he used to shoot three people. This means that he legally cannot claim self defense.

Another key discussion is the Castle Doctrine. Some of you may be vaguely familiar with it, as it is what allows you to use deadly force when someone comes into your house unlawfully, etc. But there are some finer points most people don't realize that you generally have to do some formal legal studies to know.
First, as soon as someone sets foot inside the threshold of your home uninvited that you believe intends to commit a crime, you can legally use deadly force and it is immediately considered self defense, even if they haven't made any violent threats or actions towards harming you.

This is because in every instance outside your home, you are required to retreat and extricate yourself from a dangerous situation if possible. It is a legal mandate, not a suggestion. Your home is considered the final retreat point, and legally you should be safe in your "Castle." There is nowhere else to retreat to, etc. This is why you are able to immediately use deadly force.

However, it is NOT to protect your property, it is for protecting your LIFE. And once the burglar, for instance, has left your home... the threat to your life is considered neutralized, and deadly force is no longer authorized. So if a burglar runs out the door and down the street with your TV, you are no longer allowed to shoot after them because they are not threatening your life. You call the police, you file a claim with your insurance, and you get a new TV. If you shoot a burglar in the back down the street, you can and should be charged with murder.
While you are out in PUBLIC, this means a lot of things obviously. It means that there is far more scrutiny and boxes that must be checked in order to claim self defense. You must be in IMMINENT danger of losing life and limb. Getting into an argument and feeling scared of being punched by an unarmed person? Not likely to be a situation where deadly force is authorized. You MUST retreat.

If someone shoots at you or pulls a knife on you in the street, that is deadly force and can be met with deadly force. But if the person is unarmed, you cannot shoot them because you're afraid of a little scuffle. That is why Rittenhouse illegally shot the first protester, and it is one of the many reasons it cannot be considered self defense. The man threw a plastic bag with trash in it at him AND MISSED, and Rittenhouse shot him. He chased his victim and instigated a fight by brandishing and flagging people with his rifle, because he is an untrained idiot with a gun. The protester was not a threat, and even if he was, all he had to do was retreat back to the police line. He rushed at protesters with a gun drawn to pick a fight, and people are acting as if he were just there to keep the peace.

He fired INTO A CROWD, and it's a miracle he didn't hit more people. More people that hadn't thrown a plastic bag. More people that were just trying to protest police brutality, which is a real issue in this country.
And then when he did finally run away, some more protesters attempted to subdue him after he had already murdered someone, he tripped, and shot two people trying to stop him from shooting others.

The fact that the police didn't arrest him and take him into custody right then and there, even if they suspected it could be self defense, is a grave issue with that police department.
I could further dissect this situation, but for now I'm going to end with people passing around misinformation about the victims being "criminals so they deserved it."

First, there are no actual records of Jacob Blake or the people shot by Rittenhouse being in the official sex offender's registry. None of them raped a 14 year old girl years ago, that is complete fabrication being purposely spread by right wing extremist sites in order to try and justify the shootings.
Jacob Blake was indeed awaiting trial for sexual assault and trespassing, and did have a warrant for his arrest. It was not assault on a child, because that is a different charge with a different title. On the charging document, it would literally say that it was against a child. From what is publicly known, he allegedly broke into an ex girlfriend's house and allegedly assaulted HER, but he is innocent until proven guilty, and still deserves his day in court. He could truly be innocent.

Rittenhouse's victims do not appear to have had any record, and even if they did, he couldn't have known that at the time. You cannot insist a shoot was justified AFTER the fact because "that person was a criminal." Criminals have rights too, whether you like it or not, and it is enshrined in the very documents that built our country. If you don't like the constitution and bill of rights, I don't know what to tell you.

This is also not MY OPINION, this is literally how the criminal justice system and our laws work. I hold a degree in paralegal studies and served 8 years as an Army paralegal. I've worked for the criminal division in the Chicago US Attorney's Office, and currently work in federal law enforcement. This is what I do for a living, and I am not pulling this out of my ass, and my knowlege is a culmination of working in the field and being passionate about justice for 16 years. I'd be happy to send you sources and opines and case law and statutes if you need it. I did not get this from "mainstream media," and I am not brainwashed by the left. I'm an independent progressive.

May he face justice for what he did, and may we find a way to get on common ground before more fuses to this powder keg are lit.

This weekend, Minnesota and the nation are reacting to Kyle Rittenhouse’s acquittal of all charges.

The 18-year-old was charged with shooting three men — two of them fatally — during protests in Kenosha, Wisconsin, in August of 2020.

"If they don't get no justice, we don't get no peace,” protesters chanted, while marching in the streets of downtown Minneapolis.

Carol Yvonne Lewis of south Minneapolis was among the hundreds marching.

"We have to step out injustice, we have to stamp out hate, we have to stamp it out,” she declared.

"It's time to see people's humanity and people's non-humanity,” said Madeline, a Minneapolis resident. “He had no humanity when he came in with his AR-15 and shot people."

Rittenhouse was charged with homicide, attempted homicide and charges for recklessly endangering safety.

He claimed he acted in self-defense when he shot and killed Joseph Rosenbaum and Anthony Huber — and wounded Gage Grosskreutz — during the protests that erupted after a white officer shot Jacob Blake, a Black man.
Rittenhouse was acquitted on all charges Friday.

"I don't agree with it, it's wrong,” Lewis says. “We need to go back to court. I'm just so upset and I'm hurt. Not surprised, but it's wrong."

The verdicts sparked protests in Portland, Oregon and New York City, as well.

But groups of Rittenhouse supporters have also appeared on the streets.

"Kyle got in over his head, he might have been foolish to be in that situation in the moment,” says Michelle Darnell of Washington state. “At the end of the day, he still had the right to self-defense at that moment."

Rittenhouse had traveled from Illinois to Kenosha, where the protests were underway in August 2020.

He said he was there to help protect property — carrying an AR-15 style rifle.

"He had as much right to be there as anyone else,” says Mark Richards, Rittenhouse’s defense attorney. “And when Mr. Rosenbaum attacked him and then the mob came after him, he protected himself, and that's legal in the state of Wisconsin and most places in the United States."

One of the acquitted "recklessly endangering safety" charges involved Rittenhouse firing at an unknown person trying to kick him.

Huber’s father believes the verdict sends the wrong message.

“I think we’re all in shock,” John Huber says. “We did not expect this. This was just adding insult to injury.”

Brandon Lesko :lol:, of Los Angeles — a Rittenhouse supporter — disagrees.

“Kudos to Kyle, I'm glad he's free,” he said. “I hope these people can respect the decision. Being an American doesn't mean you get a court decision you like, it means you're going to respect the court decision you get."

Protesters in Minneapolis say they believe if Rittenhouse had been a man of color, the verdict would have turned out differently.

D.J. Hooker — marching in Minneapolis — worries the verdict will embolden others.

"I'm here because justice wasn't served,” he says. "All it does is give a green light to white supremacists that they can show up to BLM protests and even if it's not in their community, they can shoot and kill people and claim it's in self-defense."
ABC News is reporting Rittenhouse and his family has left Kenosha.

Experts say despite the not guilty verdict, he could still face legal consequences — including wrongful death lawsuits from the families of those who were killed.

“Will the president ever apologize to Kyle Rittenhouse for suggesting that he is a white supremacist?” Fox News reporter Peter Doocy asked Psaki.

Psaki immediately blamed Trump and doubled down on attacking Kyle Rittenhouse.



Psaki claimed Rittenhouse “took the law into his own hands” that night in Kenosha.

This is a brazen lie and Rittenhouse should sue Psaki as well.

Not guilty on all counts. That was the verdict by a courageous Kenosha, Wisconsin, jury in the unwarranted prosecution of Kyle Rittenhouse.

It had been obvious from the beginning to non-deranged and fair-minded persons who had viewed the widely broadcast video evidence that Rittenhouse had shot his three assailants in self-defense. The prosecution’s decision to charge him with murder and assault was mystifying. At least until we got a look at the bizarre, inept, and straw-grasping performance by the desperate, flop-sweating prosecutors sent into the courtroom to convict Rittenhouse. They appeared to be social justice warriors with law degrees and a tenuous grasp of reality who were on a mission to win at all costs — evidence be damned.

Well, speaking as one old prosecutor to a couple of shave tails, I hope you boys learned a lesson. Torturing facts and trying to pull fast ones on the defense gets you only so far before reality and common sense take over and bite you in the derriere.

Once again, a baseless and largely fictitious media narrative disintegrated when it collided with the facts of the case. Nevertheless, given the threats of violence if Rittenhouse was acquitted, he was at grave risk of conviction right up until the jury spoke.

For now, the young man is free of criminal charges, but, legally speaking, where does he go from here?

Let’s start with the state charges of which he has just been acquitted. Some benighted leftist die-hards are demanding that the prosecution appeal the jury’s verdict. But, under our laws, there is no appeal from an acquittal. Period. The state case is over.

But what about double jeopardy? Does the acquittal in state court preclude our woke Justice Department — under the fearless leadership of Attorney General Merrick (“The Hammer of the PTA”) Garland — from bringing federal charges? It does not. Under our system of dual sovereignties, an acquittal in state court does not bar federal charges arising out of the same facts. For example, when the police were acquitted in state court for beating Rodney King, they were subsequently convicted in federal court for violating his civil rights. Same beating, different courts, and different legal results.

Will the feds charge Rittenhouse? Unlike the police in the Rodney King case, he was not a state actor and was not acting at the behest of local government. On that basis, there is no clear legal jurisdiction for federal charges.

But President Joe Biden has denounced Rittenhouse as a white supremacist. And, minutes after the jury found Rittenhouse not guilty, House Judiciary Committee Chairman Jerry Nadler tweeted, “This heartbreaking verdict is a miscarriage of justice and sets a dangerous precedent which justifies federal review by DOJ.”

He added, “Justice cannot tolerate armed persons crossing state lines looking for trouble while people engage in First Amendment-protected protest.”

This, God help us all, from the chairman of the House Judiciary Committee.

Even worse, Laurence Tribe, a professor of constitutional law at Harvard, followed up Nadler’s tweet with one of his own: “I join Chairman Nadler in that request. The idea that other vigilantes could take it upon themselves to shoot innocent people to death the way Rittenhouse did and get away scot-free is incompatible with the survival of a civilized, law-based society.”

Similarly, Rep. Sean Maloney (D-NY), chairman of the Democratic Congressional Campaign Committee, opened his public statement with this: “It’s disgusting and disturbing that someone was able to carry a loaded assault rifle into a protest against the unjust shooting of Jacob Blake, a Black man, and take the lives of two people and injure another – and face absolutely no consequences.”

Now I’m not going to go through the tedium of explaining point-by-point how these proclamations are untethered to the facts. Suffice it to say that those who have obtained and continue to seek political benefit from the false Rittenhouse-as-vigilante narrative peddled by CNN, MSNBC, and the legacy media are not about to stop. They will ride that hobbyhorse until it’s no longer in their interest to do so.

So it is that Rittenhouse remains at severe risk of being criminally charged by the woke social justice warriors who run the Department of Justice. After all, an agency that will willfully and intentionally cease enforcing the law at our Southern border in order to admit what it hopes will be a tidal wave of future Democrat voters while simultaneously targeting as domestic terrorists parents who are fighting the state for control of their children’s fate, is capable of anything no matter how illegal.

Or, to paraphrase the bandit leader in The Treasure of the Sierra Madre, the Justice Department’s social justice warriors don’t need “no stinkin’ jurisdiction.” They will do whatever they want.

And, of course, in addition to that threat, Rittenhouse faces the certainty of civil litigation.

The parents of Anthony Huber, who was killed by Rittenhouse, have issued the following statement:

There was no justice for Anthony, or for Mr. Rittenhouse’s other victims, Joseph Rosenbaum and Gaige Grosskreutz. Today’s verdict means there is no accountability for the person who murdered our son. It sends the unacceptable message that armed civilians can show up in any town, incite violence, and then use the danger they have created to justify shooting people in the street.… Neither Mr. Rittenhouse nor the Kenosha police who authorized his bloody campaign will escape justice. Anthony will have his day in court.
The Kenosha police deny that they authorized armed civilians, including Rittenhouse, to help during the riots.

So, why are Huber’s parents claiming otherwise? Most likely it’s because young Mr. Rittenhouse has no assets and is judgment proof. But, if he was acting under the authority of the police, then the City of Kenosha can be held liable for damages.

Oh, and by the way, the mere claim that the police could have authorized his actions may be enough of a pretext for the woke Justice Department to investigate Rittenhouse as a state actor who violated the civil rights of Huber, Rosenbaum, and Grosskreutz.

In short, the drumbeat continues and Rittenhouse faces a perilous future as every progressive’s favorite legal piñata.

As for those television commentators who insist that he should start suing the media for defamation, my advice is quite to the contrary. Rittenhouse should forget about suing anybody, stop trying to explain why he did what he did, stay out of the public eye, keep his mouth shut, and brace for the onslaught.

In a later article, I will explain why a defamation suit by Rittenhouse is a really bad idea.

Somehow I view those with Molotov cocktails, Bic Lighters, and gallon cans of gasoline carried into a "mostly peaceful protest" and thereby depriving property owners of hundreds of thousands of their hard earned dollars - and face no consequences - as a FAR greater disturb than someone practicing self protection.

No fire in the barn - EVER.

Yes, and no. The bottom up top down method has always worked in the past. But then societies that they have used it in in the past weren't buying weapons and ammo by the millions in the last few years. But don't worry, they are still marching on with their agenda...
