U.S. Senator Bob Menendez (D-NJ) and Congressman Ted Deutch (D-FL) reintroduced on Wednesday the Keep Americans Safe Act, a confiscatory ban on magazines with a capacity over ten rounds.
In addition to banning the importation, sale, manufacturing, transfer, or possession of what they call “high-capacity magazines,” the bill includes the following measures:
“We can no longer afford to do nothing as the scourge of gun violence continues to ravage communities across the country, and must address this as the real emergency that it is,” he continued.
Rep. Deutch likewise expressed a need for outlawing these commonly owned accessories.

“As President Biden told the country, there is absolutely no need for high-capacity magazines that can hold 100 rounds, 50 rounds, or 30 rounds: not for sport, not for self-defense, not for law-abiding gun owners,” he argued.
“These are the magazines of choice in mass shootings because they maximize human casualties,” he added. “This bill helps to significantly reduce the number of casualties in horrific mass shootings that have returned to the headlines in recent weeks. Congress must not turn away from these tragedies; we must take action to save lives.”
Mark Oliva, the Director of Public Affairs for the National Shooting Sports Foundation, slammed the duo for “proposing to put a limit in the amount of self-defense Americans can use to protect themselves and their loved ones.”
“We know criminals don’t obey the law and this won’t stop the criminal misuse of firearms. This will only disarm those who follow the law,” he added.
Oliva also questioned the interesting timing of the legislation.
“Senator Menendez and Congressman Deutch are ignoring right now in Brooklynn, Minnesota, Black men are protecting Black-owned businesses with black rifles, fitted with these magazines,” he explained. “While other businesses burn, these businesses are untouched because of the lawful use of firearms to defend life and property.
“Senator Menendez and Congressman Deutch weren’t sent to Washington, D.C. to make it easier for criminals to prey on Americans. They should adhere to their oath of office, do their job and protect the rights of their constituents,” he concluded.
In short, this legislation is confiscation. This legislation is infringement. This legislation is unconstitutional.

In addition to banning the importation, sale, manufacturing, transfer, or possession of what they call “high-capacity magazines,” the bill includes the following measures:
- Provides limited exceptions for devices possessed before enactment, for certain current and former law enforcement personnel, for certain Atomic Energy personnel and purpose, for tubular devices that can only accept .22 rimfire ammunition, and for certain authorized testing or experimentation;
- Modifies the high-capacity definition to prevent coupled or joined magazines;
- Authorizes a buyback program for high capacity magazines using Byrne JAG grants;
- Requires devices manufactured after enactment to have conspicuous serial numbers and date of manufacture to help law enforcement identify restricted magazines;
- Harmonizes forfeiture provisions for magazines with current law; currently FBI and ATF can seize and destroy certain firearms but not high capacity magazines.
