Charges against Kyle Rittenhouse formally filed in Kenosha shootings

A 17-year-old suspected of fatally shooting two protesters in Kenosha, Wis., and injuring a third was hit with more criminal charges Thursday.

Kenosha County District Attorney Michael Graveley filed the charges against Kyle Rittenhouse, which include one count of first-degree intentional homicide; one count of first-degree reckless homicide; one count of attempted first-degree intentional homicide; two counts of first-degree reckless endangerment and one count of possession of a dangerous weapon by a person under 18, all felonies, according to court records obtained by Fox News.

If convicted of intentional homicide, he could face a mandatory life sentence.

Investigators said Rittenhouse was armed with a Smith and Wesson AR-15 style rifle during Tuesday's protest over the shooting of Jacob Blake.

Cellphone footage shows the shooter being chased into a used car lot by someone, before shots are heard and the person is seen on the ground. The shooter then runs down the street where he is chased by several people shouting that he just shot someone. He stumbles after being approached by several more people and fires, killing another man and injuring a third.

Rittenhouse's attorney, Lin Wood, said his client acted in self-defense.

"I think any average citizen would know self-defense when they see it," Wood told Fox News. "This young man was attacked. He was attacked with what was clearly lethal force. He had the right to defend himself."

John Pierce, another attorney representing Rittenhouse, told Fox News his legal team will prove self-defense and "will obtain justice for Kyle no matter how hard the fight or how long it takes."

Rittenhouse was arrested Wednesday in Antioch, Ill., where he lives, hours after the chaos that unfolded the night before. He is being held in the Lake County Juvenile Detention Center pending extradition to Wisconsin.

The New York Post reports that the teenager dedicated his social media to law enforcement and guns.

The men killed were Joseph Rosenbaum, 36, of Kenosha, and Anthony Huber, 26, of Silver Lake, about 15 miles west of the city. A third man, George Grosskreutz, 26, of West Allis, Wis., was wounded and is recovering.

The American Civil Liberties Union of Wisconsin and its national chapter called for the resignation of Kenosha County Sheriff David Beth and Kenosha Police Chief Dan Miskinis over the law enforcement response to demonstrations, which have led to businesses being vandalized.

So they are charging him as an Adult or Juvenile? Can they charge him for one crime as a minor and another crime as an adult? Anyone know?

The only charge he'll have problems with is the under-18 firearms one. The rest should be cleared once all the video evidence is presented.
They had to charge him or risk escalation.
But they did it right. No way can they prove murder 1.
So he'll skate. And they can't come back with manslaughter once he beats murder 1.
Insiders might see this as intentional.

I think if the others go away he would have to be charged as a minor on the firearms charge... It would make no sense to charge him as an adult on a charge that only applies if you are under 18... Hmmm

I'm not an attorney, but would like to get your folks opinion reference the following.

1) Kyle was on private property at the time this incident 'started'.
2) It appears he had permission from the property owner to be on said property.
3) The first assault on Kyle occurred on the property he had permission to be on, at the request of the owner.

If that proves to be the case, then there is an argument that can be made that he was not violating the curfew no more than you or I standing in our front yard or our own business during the time of curfew.

From what I understand; The DA is basing his case on the violation of curfew being a crime, and anything that follows such as self defense cannot be claimed if one is in the process of violating a law at the time of that claim.

Any thoughts?

The DA is going to be what this is all about, he’s probably going to try to make a name for him self against some big attorney’s. The court room is way different place theatrics first, law second.

Guys this kid meant well but even if he gets outta this things aren't gonna get better. There are at least 3 wrongful death/harm lawsuits coming, not counting people were just standing around who are gonna sue for mental cruelty or whatever. I don't like it but that's how it works now.

Yep you are correct. Even if they prevail, he is young enough to simply bankrupt them and get clear.

Well, the town is burning down around DA's ears, howling mobs are screaming for blood, so what to do? Obviously. Go for max charge.

Some states the charge can be Murder 1, but the jury could find him guilty of a lesser charge such as hunting without a license if they so choose. In other States, the trial is on the charge. No Murder 1, he goes free. I suspect WIs is that way which might further explain what the DA is doing. Let us hope.

This issue was discussed at length on the big thread. All 3 who attacked and were shot were felons, one of whom was illegally in possession of a handgun. Further, the video clearly shows they were in fact assaulting him. No jury would find for the attackers.

Depends, what kind of castle laws do you have out there?
Oh and it's awfully difficult to sue a minor.

And just who made up that stupid rule? If you are a minor you have no right of self defense?

Crazy just can't get any worse.

Please Dear God, just bring an end to all of this STUPID.
