St. Louis couple who brandished guns being investigated after clash with protesters

The St. Louis couple caught on video brandishing guns in the front yard of their home while protesters passed through their private neighborhood are being investigated by local law enforcement.

Mark McCloskey, the 63-year-old homeowner seen in the now-viral video holding a black rifle, said in a recent interview he, his wife and his home were threatened by a fringe group that accompanied protesters marching to the mayor's nearby home.

“There were people wearing body armor. One person pulled out a loaded pistol magazine, he clipped them together and said, ‘You’re next,’” McCloskey told the "Today" show in a segment that aired Tuesday morning. “We were threatened with our lives, threatened with the house [being] burned down.”

Video shows McCloskey holding the black, long gun, and yelling, ‘Private property. Get out now.’”

The footage continues to show McCloskey’s wife, Patricia, at times pointing a handgun at protesters.

The crowd grew “enraged” after he told them to leave his property, said McCloskey. But Daniel Shular, a photojournalist who said he witnessed the encounter, described in an interview how the situation “went to another level” when McCloskey grabbed the gun.

Circuit Attorney Kimberly Gardner issued a statement late Monday characterizing what happened differently, saying her office was working with police to investigate the confrontation.

“I am alarmed at the events that occurred over the weekend, where peaceful protesters were met by guns and a violent assault,” Gardner said. “We must protect the right to peacefully protest, and any attempt to chill it through intimidation or threat of deadly force will not be tolerated.”

No charges were filed against the couple as of Tuesday morning.

The McCloskeys called the St. Louis Police Department shortly before 7:30 p.m. Sunday, according to an incident summary provided to Fox News by the department. They told arriving officers that they heard a "commotion," then “observed a large group of subjects forcefully break an iron gate marked with ‘No Trespassing’ and ‘Private Street' signs."

But the video shows the protesters walking through the gate, which did not appear to be damaged at the time.

“Once through the gate, the victims advised the group that they were on a private street and trespassing, and told them to leave,” the police summary further states. “The group began yelling obscenities and threats of harm to both victims. When the victims observed multiple subjects who were armed, they then armed themselves and contacted police.”

Based on the couple’s account, police called the incident a case of trespassing and assault by intimidation, according to the incident summary. No other police reports were filed that night, a department spokesperson told Fox News.

Al Watkins, an attorney for the McCloskeys, said the protest was largely peaceful and the pair did not bring their guns outside the home until two men in particular, both of whom were white, started menacing them.

The couple, he said, was hesitant to come forward with the full story out of fear that they would "disparage the importance of Black Lives Matter."

"At the time, their fear was, these people, two in particular, that were marching along with the Black Lives Matter protest participants – all peaceful. They were acting in a fashion inconsistent with the message being given," Watkins said. "My clients were not arming themselves against peaceful protesters, they were arming themselves about people with a really bad motive, a motive that runs afoul of the fundamental tenets of our country."

Watkins said the McCloskeys have each practiced law for more than 30 years and "their practices have included, on an ongoing basis, representing individuals in pursuit of protection of their civil rights."

"One hundred percent of my client's clients in those cases have been people of color," Watkins said.

At the time of the tense confrontation, the protesters were reportedly marching toward Mayor Lyda Krewson's home to demand her resignation.

There needs to be immediate fortification of the gates and fence. Prayers said for the innocent residents in that community, including those attorneys. There should be immediate charges of disorderly conduct and trespassing for each of the invaders. And that is not racist.

At this point you're going to need a garrison worth of Blackwater/Triple Canopy/G4S for that private community. That being said, the place isn't defendable with what they could afford, never mind the available supply of such people.

I don't think the commie mob is willing to do a suicide charge...yet.

Predators and scavengers have a sense of self preservation.

Demonstrate a willingness to defend the area by shooting a few of the horde and the rest will find easier pickin's.

Think in terms of the garage built stuff being used in Syria or by the IRA back in the 70s. The "good stuff" won't be coming out until they're really rolling. I've said it before and will again, if they can smuggle tons of cocaine in annually, what's a fire team's worth of the "good stuff" every now and then if the price is right?

Demonstrators who marched through a gated community in St. Louis are being investigated for trespassing and assault, local media reported, after footage of an armed couple protecting their home from the mob went viral.
Mark and Patricia McCloskey have been criticized for pointing guns – an assault rifle and a pistol – at the protesters and demanding that they leave their private neighborhood. But it appears that St. Louis police believe the demonstrators were in the wrong. Law enforcement is investigating Sunday’s incident as a case of trespassing and fourth-degree assault by intimidation, according to the St. Louis Dispatch.
The McCloskeys claim that the crowd broke an iron gate leading to the private community and began shouting threats and obscenities as they approached their home. It was only then that the couple armed themselves and stood guard on their front lawn.

Footage of the confrontation shows the duo shouting down the protesters as they point their weapons at them. “Get out! Private property, get out!” Mark McCloskey is heard shouting.
Although police are reportedly focusing their investigation on the protesters, St. Louis Circuit Attorney Kimberly M. Gardner appears to have taken a different view of the altercation.
In a statement released on Monday, she claimed that the “peaceful” protesters were “met by guns and a violent assault.” She said that her office was launching its own probe into the events and “will use the full power of Missouri law to hold people accountable.”

The husband only had ONE MAG. The wife only had what looks like a .380 pistol with no extra mags.

In PA if you are told you are trespassing, told to leave and you do, it is just trespassing. If you do not leave when told it is defiant trespassing, with higher fines.

For any of these people to complain would be an admission of guilt. Interested to see what happens.

I love it!

They vote democrat. They file civil suits against the police. They contribute thousands of dollars to Democrats. Then, when the rioters come for them on their private property and threaten their lives, they exercise their 2nd Amendment rights. Now the Democrats in charge of the government are considering filing charges.

Good! No quarter, no mercy and no sympathy! Let them eat their own!

Hey Don Lemon and everyone at CNN: I saw your news story on this a few nights ago. How come you neglected to mention that the little darlings numbered in the hundreds and they broke down the gates of the gated community? You didn't mention that they were trespassing in a gated community, after busting in??? How come.

Tell the full story or don't tell it all. Bias and agenda is not acceptable, and leaving out pertinent facts is lying.
