    A midterm election season that appeared quite settled Tuesday night has suddenly entered a bitterly contested overtime, with Arizona’s Senate candidates locked in a tight race and trading the lead as votes trickle in – and Florida reprising its 2000 role as the center of a ballot-counting brawl complete with armies of lawyers and allegations of local corruption.

    In Arizona, Democratic candidate Kyrsten Sinema suddenly took a narrow 9,600-vote lead over GOP opponent Martha McSally late Thursday, with some 400,000 votes left to count in a closely watched race that will determine the size and influence of the Republican Senate majority in January.

    That was after McSally had consistently led Sinema since Election Day, and was ahead by 17,000 votes as of early Thursday.

    And while Georgia, too, hosts a war of words over the contested outcome of the state’s gubernatorial contest, Florida has captured the political world’s attention as both sides accuse the other of trying to “steal” the election, with an airtight Senate and gubernatorial race on the line.

    Republican Senate candidate Rick Scott, warning of possibly “rampant fraud,” ratcheted up the fight by filing explosive lawsuits late Thursday against the top election officials in two heavily Democratic counties, as they continue to report new votes and three top races in the state appear headed for recounts.

    In their lawsuit against Broward County, Scott and the National Republican Senatorial Committeee (NRSC) allege that officials there are hiding critical information about the number of votes cast and counted. And in a parallel suit against Palm Beach County, Scott and the NRSC charge that the election supervisor there illegally used her own judgment to determine voter intent when reviewing damaged or incorrectly filled-out absentee ballots, while refusing to allow impartial witnesses to monitor the process.

    "I will not stand idly by while unethical liberals try to steal an election," Scott, who is currently Florida's governor, said at a press conference outside the Governor's Mansion, as he slammed potential "rampant fraud" in the race.

    Scott is running against longtime incumbent Democratic Sen. Bill Nelson. On Thursday, a Nelson spokesperson tersely dismissed Scott's effort: “The goal here is to see that all the votes in Florida are counted and counted accurately. Rick Scott’s action appears to be politically motivated and borne out of desperation.”

    The bombshell litigation comes hours after Florida GOP Sen. Marco Rubio, in an extraordinary series of tweets that alleged incompetence if not outright complicity by Florida officials, charged that Democratic lawyers were "descending on" the state in a calculated attempt to "change the results" and "try and steal" several statewide races.

    Also late Thursday, President Trump threw another wrench into the evening, announcing on Twitter that "Law Enforcement is looking into another big corruption scandal having to do with Election Fraud in #Broward and Palm Beach." He did not elaborate, but speaking to Fox News' "Hannity," Scott said he had directed a Florida law enforcement agency to probe the matter.

    "Late Tuesday night, our win was projected to be around 57,000 votes," Scott told reporters. "By Wednesday morning, that lead dropped to 38,000. By Wednesday evening, it was around 30,000. This morning, it was around 21,000. Now, it is 15,000."

    He continued: "On election night, Broward County said there were 634,000 votes cast. At 1 a.m. today, there were 695,700 ballots cast on election day. At 2:30 p.m. today, the number was up to 707,223 ballots cast on Election Day. And we just learned, that the number has increased to 712,840 ballots cast on Election Day. In Palm Beach County, there are 15,000 new votes found since election night.

    "So, it has been over 48 hours since the polls closed and Broward and Palm Beach Counties are still finding and counting ballots – and the Supervisors – Brenda Snipes and Susan Bucher – cannot seem to say how many ballots still exist or where these ballots came from, or where they have been," Scott said.

    Meanwhile, Senate Minority Leader Chuck Schumer, D-N.Y., fired back on Twitter at Trump saying: “In a democracy, no one—not even the President—can prevent the lawful counting of votes. We will not allow him or anyone else to steal this election.”

    A mandatory recount now appears imminent not only in Scott's race, but also in the agricultural commissioner contest and Florida's high-profile gubernatorial brawl between Democrat Andrew Gillum and Republican Ron DeSantis, based on new vote totals -- even though Gillum has already conceded. Florida law requires a machine recount when candidates are within 0.50 percentage points of each other.

    Scott's first emergency complaint accuses Broward County Supervisor of Elections Brenda Snipes of being "unwilling to disclose records revealing how many electors voted, how many ballots have been canvassed, and how many ballots remain to be canvassed," and charges that the uncertainty "raises substantial concerns about the validity of the election process."

    The NRSC specifically allege that Snipes is in violation of the Florida Constitution and the Florida Public Records Act. They demand an emergency hearing, as well as a court order requiring Snipes to turn over information about ballots in Broward County.

    Scott's complaint against Palm Beach County Supervisor of Elections Susan Bucher, meanwhile, alleges first that officials there illegally refused to allow Republicans, or any witnesses, to monitor the county's handling of damaged absentee ballots.

    "Even more alarmingly," Scott additionally claims, Bucher "failed to allow the Palm Beach County Canvassing Board" to determine, as required by law, which damaged or improperly filled-out absentee ballots were valid and how the voters of those ballots had intended to vote. Instead, Scott and the NRSC argue, Bucher and her staff simply used their own judgment when determining voters' intent.

    The suit against Bucher demands an injunction requiring Bucher to make and compare duplicate copies of all damaged absentee ballots in the presence of Scott's representatives, and to allow the Palm Beach County Canvassing Board to determine voters' intent when counting those ballots.

    Rubio, in his barrage of broadsides against Snipes earlier in the day, pointed to the "slow drip" of tens of thousands of additional ballots that were reported throughout the day Thursday, most of which were favorable to several Democratic candidates. Rubio said those late disclosures violated Florida election law, which necessitates that mail-in and early voting ballots be counted within 30 minutes of polls closing.

    "Bay County was hit by a Cat 4 Hurricane just 4 weeks ago, yet managed to count votes & submit timely results," Rubio wrote. "Yet over 41 hours after polls closed #Broward elections office is still counting votes?"

    Rubio and Scott both made it clear they have no confidence in Snipes' integrity.

    "A U.S. Senate seat & a statewide cabinet officer are now potentially in the hands of an elections supervisor with a history of incompetence & of blatant violations of state & federal laws," Rubio wrote, linking to a Miami Herald article describing several scandals that have gripped Broward County’s Elections Department.

    Earlier this year, a judge found that Snipes had illegally destroyed ballots in a 2016 congressional contest, leading the secretary of state's office to assign election monitors to supervise her.

    “I think the problems are blown out of proportion,” Snipes said in October, in an interview with The Miami Herald. “Broward is nitpicked to the bone. Other places have the same problems, different problems. It’s just that they are not spotlighted like we are.”

    At his Thursday press conference, Scott outlined some of Snipes' troubled history.

    "In 2016, Brenda Snipes’ office posted election results half an hour before polls closed – a violation of election law," Scott said. "That same year, her office was sued for leaving amendments off of ballots. In 2014, Brenda Snipes’ fellow Democrats accused her of individual and systemic breakdowns that made it difficult for voters to cast regular ballots. All Floridians should be concerned about that."

    Vote totals in several major races in the state are changing rapidly, on an irregular schedule and sometimes late into the evening. Scott was ahead of Nelson by roughly one-fourth of one percentage point as of Thursday morning, according to The Tampa Bay Times. The paper also said the agriculture commissioner candidates were separated by only 0.06 points. That race flipped in favor of the Democratic candidate on Thursday afternoon.

    Broward County reported that significantly more votes were received in the agriculture commissioner contest than the much higher-profile Senate election. An attorney for Nelson's campaign suggested a computer error might explain that anomaly.

    In the closely watched gubernatorial race, DeSantis held a narrow 0.52-percentage-point edge over Gillum as of Thursday morning, extremely close to the 0.5 percent threshold needed to trigger a machine recount. Gillum has conceded the race, although his decision is nonbinding.

    But by Thursday afternoon, unofficial figures had DeSantis up by just 38,515 votes out of the more than 8 million cast -- a lead of just 0.47 percent, low enough to trigger a mandatory recount, according to The Tallahassee Democrat. No recount has yet been announced by Florida's secretary of state; the first unofficial vote count is expected to be verified Saturday.

    "On Tuesday night, the Gillum for Governor campaign operated with the best information available about the number of outstanding ballots left to count," Gillum's campaign said in a statement Thursday evening. "Since that time, it has become clear there are many more uncounted ballots than was originally reported. Our campaign, along with our attorney Barry Richard, is monitoring the situation closely and is ready for any outcome, including a state-mandated recount."

    Without providing legally sufficient justification, Rubio said, Democrat-controlled Broward and Palm Beach counties on Wednesday afternoon continued to report new ballots, cutting into Scott's already-thin lead and also flipping the state's agriculture commissioner race to Democrats.

    Palm Beach County Supervisor of Elections Susan Bucher told Fox News that Palm Beach is still counting about 2,000 mail-in ballots where voters circled or highlighted (by drawing an arrow pointing at the candidate’s name) their choice, instead of filling in the appropriate bubbles.

    Bucher told Fox News that elections department staff is going through each of the 2,000 mail-in ballots, and where voter intent is determined, a worker is filling in a new ballot on behalf of the voter. Where voter intent cannot be determined, the ballot is sent to the canvassing board to undergo review.

    Elections officials are also reviewing 1,500 military and overseas ballots which are still being counted. Florida law allows military servicemembers to mail or fax ballots in. A provisional vote report is due in Tallahassee on Saturday by noon.

    "#Broward election supervisors ongoing violation of #Florida law requiring timely reporting isn’t just annoying incompetence," Rubio wrote. "It has opened the door for lawyers to come here & try to steal a seat in the U.S. Senate & Florida Cabinet."

    Florida law dictates that if the margin in any race hits 0.25 percent or lower, a manual recount of any ballots set aside from the machine recount will be ordered -- reminiscent of the scene in the 2000 presidential election, when the country was gripped by images of poll workers counting votes deciphering hanging chads by hand.

    Broward County election officials did not return Fox News' multiple requests for comment.

    I think it was last night that I saw a video attached to a tweet. Reportedly, FL ballots were being loaded into vans and then offloaded into trucks. I didn't post it because I couldn't verify it. But I did see boxes of something being taken out of the vans and loaded into the back of a truck. Hmmm..........

    When I moved to Wisconsin, I voted absentee for Oregon for about a decade. I NEVER voted for a presidential candidate, but limited myself to Oregon ballot measures and Oregon state reps.

    Republican Senator Lindsay Graham has always been a defiant voice in the face of Democratic games and he recently made headlines for roasting his Leftist colleagues during the confirmation hearing of Supreme Court Justice Brett Kavanaugh.

    During the September confirmation, Graham condemned Democrats for using petty tactics to delay and obstruct Kavanaugh’s eventual nomination and he is similarly going after those on the Left for trying to “steal” elections in Florida.

    There has been a lot reported about the election crisis happening in Florida affecting both the governor and the senatorial races and Graham has clearly had enough.

    As BizPac Review reports, Fox News host Sean Hannity asked Graham about the elections, specifically the senatorial race between Republican Rick Scott and Democrat incumbent Bill Nelson. Hannity noted that Scott lead on election night by 57,000 votes, a number which has dwindled down to 38,000 votes, then 30,000, then 21,000, and finally 15,000 votes.

    “The law exists to avoid this situation,” Graham replied to Hannity. “You want a count for the votes 30 minutes after the election and then every 45 minutes. There’s been over 90,000 votes come in after the close of voting — in clear violation of Florida law designed to prevent this situation.

    “Broward County is a national joke when it comes to elections and here’s where [the situation with] Kavanaugh has in common,” Graham continued. “When it comes to counting votes and confirming judges, there’s nothing Democrats won’t do to win.”



    “They tried to destroy Brett Kavanaugh, it didn’t work. They are trying to steal this election, it’s not going to work. And, I can’t wait to get back to work and make sure we put men and women on the judiciary that will actually follow the law. The law means nothing to liberal Democrats—it’s all about outcome—and they’re not going to win. They didn’t destroy Kavanaugh and they’re not going to screw Rick Scott,” Graham said.

    Here’s more on their exchange, via BizPac Review:

    “Same players, same characters, same M.O., same objective. Win by any means necessary,” [Hannity] said.

    “Look at Brett Kavanaugh,” Graham noted. “They tried to deny him a place on the court by being deceitful, withholding information from the committee, ambushing him, changing the legal standards.”

    “What are they doing in Broward County? They are taking Florida law and turning it upside-down to get a result. This liberal activist lawyer, the Clinton lawyer, went to Florida with the purpose of winning the election,” Graham explained, referring to a member of Nelson’s legal team, Marc Elias, who blatantly described the reason for the recount demands.

    “We’re doing this not just because it’s automatic, but we’re doing it to win,” he said as teams descended on Florida.

    “The election was held on Tuesday. You know, Bill Nelson was running, not the lawyer. Rick Scott won fair and square,” Graham continued on “Hannity” Friday. “What’s going on in Broward County is not fair and it’s not square, and we’re going to get to the bottom of it. Rick is going to win.”

    “But please remember this about 2018: the 2018 cycle is going to be remembered for liberal Democrats doing whatever it takes when it comes to judges and votes to win,” the lawmaker continued. “The law be damned, in the eyes of liberal Democrats. The law is just something to get around when it comes to winning what you want.”

    Graham was just as fiery during Kavanaugh’s second confirmation hearing (where Kavanaugh had to testify against allegations of sexual assault brought by an accuser, Dr. Christine Blasey Ford) where he called Democrat tactics a “sham” and said they were trying to “destroy this guy’s life.”

    “What you want to do is destroy this guy’s life, hold this seat open and hope you win [the presidency] in 2020. You said that! Not me,” Graham shouted to lawmakers across the aisle, via CNBC.

    “Boy, y’all want power. God, I hope you never get it. I hope the American people can see through this sham,” he continued.

    And, “To my Republican colleagues, if you vote no, you’re legitimizing the most despicable thing I have seen in my time in politics.”

    Graham then looked at Kavanaugh and said: “Let me tell you when it comes to this. You’re looking for a fair process? You came to the wrong town at the wrong time, my friend.”

    Graham, speaking to a group of reporters, became animated in saying that the hearings are a “delay” that he has decided he won’t “reward.”

    “I’m not going to reward people for playing a political game,” he said.

    He said he believes Ford was betrayed by the person who released her letter, which was sent to Democratic Sen. Dianne Feinstein of California, on the allegations.

    “She is just as much a victim of this as I think Brett Kavanaugh is,” he said. “Because somebody betrayed her trust. And the people who betrayed her trust…they owe her an apology.”

    The scene in Florida is spiraling into a full-flung crisis and the integrity of democracy hangs in the balance as shady actions by an election board could be compromising the state Governor and U.S. Senate races.

    Here’s how everything has gone down:

    On election night, Republican gubernatorial candidate Ron DeSantis and Republican senatorial candidate Rick Scott (Florida’s current governor) each held a lead over their opposition. Then came Broward County.

    Broward County Election Supervisor Brenda Snipes has not revealed pertinent information relating to the total number of ballots which were cast on election day, how much each candidate had received, and how many were left to be counted. This information, by state and federal law, is required to be publically shared.

    Days went by and Republican leads were dwindling. Scott had enough. He sued Snipes for breaking state and federal laws which require the voter tallies to be publically known.

    On Friday, a judge ruled in Scott’s favor and required the information to be publically released. Via the Daily Wire:

    On Friday, Florida Judge Carol-Lisa Phillips ruled in favor of Florida Governor Rick Scott, who was ahead in votes in his race for the Senate seat held by incumbent Democratic Senator Bill Nelson when the polls closed Tuesday night, and had filed suit along with the National Republican Senatorial Committee against Broward County election supervisor Brenda Snipes in order to force her to release public records surrounding the votes in Broward County. The lawsuit stated that Snipes was “unwilling to disclose records revealing how many electors voted, how many ballots have been canvassed, and how many ballots remain to be canvassed.”

    The lawsuit stated:

    Voting in the 2018 General Election concluded November 6, 2018. Two days after voting has concluded, the Supervisor Of Elections is unwilling to disclose records revealing how many electors voted, how many ballots have been canvassed, and how many ballots remain to be canvassed. The lack of transparency raises substantial concerns about the validity of the election process. An emergency hearing is necessary as the Canvassing Board is obligated to submit the unofficial elections results to the Division of Elections by noon November 10, 2018. A recount in at least two, possibly three, of the statewide races appears likely. Plaintiffs seek an immediate, emergency hearing of this matter pursuant to section 119.11, Florida Statutes; an Order from this Court declaring Defendants to be in breach of their constitutional and statutory duties to permit access to public records; and an Order from this Court compelling Defendants to provide Plaintiffs with access to those records.

    “The judge found that Snipes, the Broward Supervisor of Elections, violated public records act and the Florida constitution, and must provide public records requested by Scott and NRSC,” the Daily Wire reports.

    So, Snipes had until 7 p.m. on Friday to hand over the records.

    She didn’t.


    Snipes openly defied the court order and refused Flordia Congressman Matt Gaetz access to the information, BizPac Review reports.

    The election crisis in Broward County spiraled further out of control Friday when elections supervisor Brenda Snipes defied a court order to allow state officials to inspect the voter records she’s been handling.

    “That was supposed to be complied with by 7:00. The lawyers for Brenda snipes will not allow our team to come in and comply with the court order,” Florida Rep. Matt Gaetz revealed Friday on Fox News.

    “That very same order ruled that Brenda Snipes violated the Florida Constitution by not allowing access to these important records.”



    According to the report, this is not the first time or even the second time Snipes has violated state and federal election laws:

    In May a judge ruled that Snipes, a Democrat, had violated state and federal laws by illegally destroying ballots for the 2016 congressional primary race between her leftist ally, Debbie Wasserman Schultz, and Tim Canova, who ran as an Independent.

    Later this year in August, a judge again ruled against Snipes after the Florida GOP reportedly filed a suit against her claiming her office “was opening ballots in private, preventing people from challenging if they were properly cast,” according to Fox.

    “And then in 2016, Broward County violated the law when it posted early voting results online before polls even closed,” the outlet added.

    A similar situation is happening in Palm Beach County where election officials are similarly refusing the court order and are violating state and federal election laws.





    Liberals are very outspoken when they believe Russia influenced the 2016 presidential election by posting on Facebook, but here in Florida where actual elections are being compromised, they are pretty quiet.

    What does “canvassed” mean in this context?
    Is it counting the total quantity of sealed ballots, versus opening and tabulating the individual votes?

    FL law says they need to know how many ballots are yet to be evaluated and "canvassed" or "COUNTED" since the ballots are for all races.

    an interesting perspective - but - a moot point as the law would appear to simply states they are to be "IN her possession" (i.e. accounted for and secured if not counted) by a specific time. as I understand it the problem is not only the presence of Boxes appearing "after the deadline" but ballots appearing from unknown locations as well as unconfirmed provisional votes being co mingled and included with those that have been validated as legitimate. although you could call it your basic cluster on steroids - I personally would call it DEMOCRAT ELECTION FRAUD - and something "Dr" Snipes historically has had quite a bit of experience with.

    Vote-by-mail refers to voting a ballot received by mail or picked up by, or for, a voter. The deadline to ask for a ballot to be mailed is 5:00 p.m. on Wednesday, August 22. A voter may pick up a vote-by-mail ballot from the office of their Supervisor of Elections through the day before the election or, if an emergency exists, on the day of the election.     Early Voting

    as I understand this - even with a "recount" the results will not be accurate since there are ballots presented for recount which are INELIGIBLE and ILLEGAL based on the time they were presented for consideration and the co mingling of validated with invalidated provisional ballots

    in the case of Broward county we can thank Snipes for that. in the case of palm beach county we simply have a complete and utter disregard for the law and out right refusal to comply with orders to produce the ballots - even beyond the statutory deadline - by Butcher.

    A Florida election supervisor mixed some invalid ballots along with about 200 valid ones, according to a report, in the latest example of what Republicans say has been the incompetent handling of votes as the state braces for a possible recount.

    The error was found after Brenda Snipes, a Broward County official who has a long history of controversies involving vote counting, agreed to present 205 provisional ballots to the county’s canvassing board for inspection, the Miami Herald reported.

    The canvassing board declared Friday that 20 of the 205 provisional ballots were illegal due to mismatched signatures. The 205 ballots had been set aside then counted in a voting machine, though the results weren’t added to the election's final total vote count, the report said.

    As of Friday night, no solution to the mistake had been found.

    Snipes agreed to present the ballots for inspection to the board after Republican attorneys objected to Snipes’ initial plan to handle the ballots administratively.

    “We have found no clear authority controlling the situation faced by the board,” said Broward County Attorney Andrew Meyers, according to the newspaper.

    Broward County collected more than 600 provisional ballots on the Election Day, but the vast majority were declared invalid by the board for reasons such as the voter had registered too late or had voted at the wrong precinct.

    Just over 200 ballots were also deemed neither valid nor invalid due to an issue related to the system that looks up voter registrations. Some voters apparently swiped their ID, but the precinct system couldn’t confirm whether they were registered voters, prompting staffers to ask such voters to fill out provisional ballots.

    Republican lawyers pressed Snipes, using the latest case to argue that she has been mismanaging the voting procedure, and asked whether the 205 votes will be counted. She reportedly declined to answer.

    Broward County is mandated to provide its unofficial vote total from the midterm elections to the state by midday Saturday.

    The county and Snipes have come under heavy scrutiny because Broward -- Florida's No. 2 most populous county, with more than 1.9 million residents -- could be the area that decides two key races: the U.S. Senate election between Democratic incumbent Bill Nelson and Republican challenger Gov. Rick Scott, and the Florida governor race between Democrat Andrew Gillum and Republican Ron DeSantis.

    very simple - the votes that are presented by "close" are "legal" while the votes that are presented there after are "illegal" . . . no harm no foul and definitely within the law as written. are there disenfranchised voters as a result - YES - but that must be laid at the the feet of the involved non-compliant election supervisors and NO ONE else.

    I'm not certain about that - but the race was called and Gillium conceded. the "ballots" in question were presented AFTER that. I acknowledge SOME of those may be legal - others - those presented AFTER the deadline to present such things - are simply SHIT CANNED as "illegal" due to failure to comply with statutes governing election proceedings. assuming those are the facts - and as I presently understand them they are - it would seem pretty simple and straightforward.
