It certainly CAN determine who the aggressor was. If the guy who was beaten goaded them into beating him, of hurled racial epithets at them, or threatened this kids with a weapon when it might not have been justified, that CERTAINLY has a bearing on what happened. Ignoring all that is being deliberately myopic IMO. For example, in most jurisdictions, if a person is in fear of his life and shoots an aggressor, if the shooter was determined to have started the fight/altercation, that shoot is ruled a homicide rather than self-defense. That is standard law pretty much everywhere (with a few exceptions).

MOBILE, Alabama -- Police have arrested Terry Rawls, 44, in the mob-beating of Matthew Owens, according to the Mobile police spokesman Cpl. Christopher Levy.

Police made contact with Rawls Tuesday night, and he turned himself in today, Levy said.

Rawls declined to comment to a Press-Register reporter as police took him into a squad car.

Rawls has a lengthy criminal history, including a previous conviction for first-degree assault, according to court records. After pleading guilty to the charge in 2000, Judge Joseph Johnston sentenced him to 15 years, with 2 of those to be served in prison and the balance to be suspended.

Rawls was arrested again in 2004 on a pair of third-degree burglary charges, records show, though one of those was dropped. After Rawls pleaded guilty, Johnston sentenced him to 15 years, though only one of those was to be served in confinement, the rest suspended.

Prior to those charges, Rawls was arrested and convicted of first-degree theft of property and firing a weapon into a building or vehicle.

Matthew Owens was beaten badly Saturday, leaving him in critical condition.

Levy said police believe a large number of neighbors from Saturday's incident were present during the attack but that most of them only watched. He said two or three additional arrests are possible.

Chad Tucker, a spokesman for the D.A.'s office, said that, as of 1:20 p.m., police had requested no other arrest warrants related to the case.

Tucker said the suspect and the victim have a history of conflict that dates as far back as the summer of 2009. Levy said that year the two men became involved in a physical confrontation. A witness had reported that Rawls used a baseball bat in the 2009 fight, Levy said, but that the witness later said he could not say for sure.

Levy said police presented information to the Mobile District Attorney's Office at the time. Prosecutors reduced the charge to third-degree assault, but dropped it when Owens declined to pursue it.

"This here is an incident stemming from an ongoing dispute between neighbors," Levy said.

Tucker expressed a similar sentiment. "That's an important fact that needs to get out to the public. This was not some random event that came out of nowhere."

The exact motive of Saturday's attack is still under investigation, Tucker said.

Levy also said that police have set up a meeting to present information in the case to the FBI and the U.S. Attorney's Office.

I suspect Mr. Rawls was more likely the neighborhood "bully" and upon most would care not to rein in for fear of their continued personal safety.

Although threatening unarmed teens with a knife is a little over the top for Mr. Owens -if the report be indeed true.

This whole thing is sounding more and more like clash between predatory animals. Don't like predators.

"Every single day it's a problem with Mr. Owens concerning our kids," Lemica Whisenhunt. "All these kids do is shoot basketball. We keep 'em in the yard. They don't bother anybody. We'd rather them play basketball than to be around here vandalizing, breaking into people's homes. We try to bring our kids up the right way and show people that all black kids are not bad."

The Mob in Mobile

MOBILE, Ala. -- Last Saturday night at 8:20 p.m., when the white Matthew Owens was beaten into critical condition by a mob of dozens of black neighbors, Al Sharpton and the New Black Panthers got what they wanted: a white victim, any white victim, in payback for the killing of Trayvon Martin. May God have mercy on their miserable souls -- because the rest of us should shun them mercilessly from all decent society.

Delmar Drive is one of those long, long blocks, the equivalent of probably four long city blocks without a single cross street, which sometimes gets wedged into odd nooks of American cities. At its entrance off of Pleasant Valley Road, Delmar seems to feature mostly black residents in decently maintained houses. From about three-fourths of the way down the street and on to the dead end, most residents, of similar houses, appear to be white -- but without an absolute segregation on either end of the street. One sees no reason why race should necessarily be an issue there.

Nonetheless, a white man in a business suit at dusk in a racially tense neighborhood under a national spotlight is wise not to ask too many questions of angry black people on the street. Better to return in broad daylight. But the composite picture from white witnesses about what happened last Saturday night leaves almost no doubt that racial animus played the major role in the vicious beating. Their account, perhaps one-sided but told quietly and with obvious sincerity, follows.
Yes, Mr. Owens apparently had run-ins with black neighbors before. There was another incident where he was reportedly hit in the head (once) with a stick. This beating wasn't just about basketball in the street. Neighbors do describe children or teenagers playing ball and refusing, rather belligerently, to move to let cars pass, but that's the least of it. They also said the children run into neighbors yards, pick up things from yards and porches, make a lot of noise, and adopt aggressive postures.

Neighbor Calvin Speed told Lagniappe, the centrist Mobile alternative weekly, that a few "hoods… looking for trouble" aggravated what was otherwise a merely unpleasant but not necessarily dangerous situation. "It's strictly been a racial issue that's been building," he said, adding that he personally has cordial exchanges with a number of other black residents of the street.

Anyway, on Saturday night, report the witnesses, the tensions seemed higher than usual. Owens, who is no shrinking violet, has a criminal record that includes arrests for domestic assault and driving under the influence. He was visiting people in the yard of 1013 Delmar when the trouble really began. Youths were running through various yards, causing commotion. Owens told them to stop. They didn't; instead repeatedly denigrating him as "white boy." As they argued in the middle of the street, some apparently went to get parents or other adults. It was the adults speeding up in three or four cars within five minutes, not the youths, who are described as basically going berserk.

Owens tried to get to safety at 1012 Delmar, where he was staying. He made it to the porch but not through the door. The mob -- described variously as 15-20 people or, in one telling from a witness, as many as 40, although that is hard to imagine in such a short time period -- grabbed anything they could find as weapons. They beat Owens with paint cans -- paint clearly remained on his clothes and body in the hospital -- brass buckles, chairs, perhaps some bricks, and even some unlit tiki torches (used as sticks) that were in a neighbor's yard; they hit him mostly around the head, with a few kicks or other blows to the groin and stomach for good measure. Some describe the attack as lasting at least five minutes, with Owens screaming for help but neighbors unable to do much in the face of such a large mob.

Several witnesses (not just Owens' sister in the initial TV report) told me and other reporters that at least one of the attackers, a woman, said as she was leaving the scene that "This is justice for Trayvon," referring to the nationally discussed tragedy in Florida that took a black 17-year-old's life and led Sharpton to start his usual race-based histrionics and the New Black Panthers to put a bounty on the shooter, George Zimmerman.

When the Mobile incident was finally over and Owens was taken to the hospital, he was admitted in critical condition, with bruising on his face and jaw, extreme pain, deafness in his right ear, fluid in his abdomen and, most dangerously, bilateral subdural bleeding inside his cranium. By late Tuesday afternoon, his condition had recently been upgraded from "critical" to "serious." All day long the police had promised at least a couple of arrests in the case, as witnesses had identified some of the attackers, but as of 10 o'clock Tuesday night no arrests had actually been announced.

Mayor Sam Jones (see photo above) issued a statement: "Police will certainly explore a racial motive if the evidence supports it. This type of mob violence will not be tolerated. If people think we are going to tolerate that to bring attention to some national event, they are sorely mistaken. They will be arrested and prosecuted for assault or whatever the appropriate charge may be."

Nonetheless, the Mobile police department, at least in public, has been ludicrously behind the curve. Its spokesman said as late as Tuesday that the "Trayvon" statement could not be independently corroborated, even though it took this reporter less than five minutes on the street to find multiple people who say they heard it, and other news outlets reported the same.

It must be stressed that this is not the norm for Mobile. Mobile integrated peacefully in the 1960s even as the rest of Alabama featured infamous scenes of violence; the city elected Mayor Jones, who is black, in 2005 when the black voter registration percentage was in the low 40s. While nobody could honestly claim that racism doesn't exist around here and that it isn't obnoxious where it does, this is a coastal rather than "Deep South" city, one that has historically enjoyed at least a genteel comity among the races. This sort of incident is definitely an anomaly here.
All of which lends credence, although far from proof, to the idea that national race-roiling by the likes of Sharpton provided the match-light to an unfortunate tinderbox on one particular city street.

Now, however, look back to my opening paragraph. It's not really fair. It represents the sort of racially inflammatory cheap shot in which Sharpton and an unfortunate number of media mavens specialize. One woman may have made reference to Trayvon, but that doesn't mean that all 20 or more of the attackers had anything in their minds other than a criminal version of racial animus, further inflamed by purely street-level friction. I hereby take back the allegation that Sharpton "got what he wanted" when Delmar Drive produced a white victim. The allegation remains in the opening paragraph as a demonstration of how easy it is to stir racial tensions beyond the boiling point.

Oh, yes, of course it was racism, not some other motive, that caused George Zimmerman to pull the trigger. Oh, yes, of course it was right-wing hate that caused Jared Lee Loughner to shoot Gabrielle Giffords and others. Just like it was left-wing moral depravity and corruption of cultural norms that caused a woman named Susan Smith (according to Newt Gingrich) to deliberately drown her own children in an automobile.

This is crazy. These sorts of blanket-level blame games are outrageous. Yes, Sharpton has instigated violence before, and yes he has been wholly irresponsible with respect to the Trayvon Martin case. Yes, Attorney General Eric Holder was morally depraved when lauding Sharpton, just days after Sharpton's latest outrages regarding Trayvon Martin, while lifting not a finger to punish New Black Panthers for putting a bounty on Zimmerman's head.

But they aren't responsible for the brutal beating of Matthew Owens. Twenty or more individual attackers are responsible. But Lord Almighty, if Sharpton and Holder and their ilk aren't at least more obviously culpable indirectly for fomenting racial hatred than anything Sarah Palin said was responsible for the Giffords shooting, then Alice's rabbit hole has taken over all of reality.

A real leader with Sharpton's profile would travel to Mobile, denounce the Owens beating, announce that this is not how self-respecting members of any race should act, and call for swift and sure punishment for the attackers whether their motives were racial or "just" hateful and vicious without regard to skin color at all. Matthew Owens is a seriously injured man, not a seriously injured white man. And his attackers are criminal individuals who should be punished regardless of their skin color -- and made an example of the wages of mob violence, which cannot and must not be allowed to use race or even racial insults as pretext for outright thuggery.

Mobile County District Attorney Ashely Rich says her office met with the U.S. Attorney, FBI and the police department about the Matthew Owens beating case.

Rich tells News 5’s Rose Ann haven she believes the investigation has been handled properly.

Deputy Chief Lester Hargrove says investigators believe only 3 people, including Terry Rawls, were directly involved in the attack. They believe the rest of the mob just watched.

Mayor Sam Jones says “we don't want this (beating) to define our city's reputation.”

A second civil war in the United States would be an unparalleled disaster. Nobody who is sane and who has studied modern civil wars from Spain to Lebanon to the Balkans and beyond would ever wish to see one occur. But if political, cultural and demographic trends are sweeping us toward that unhappy destiny, it would be wise to at least cast a weather eye over the possible terrain.

First, a caveat. I am not going to waste our time making politically-correct genuflections after every controversial sentence, because this essay is intended to be read by mature and rational adults.

Before we move on to the cube, let’s begin with the CW2 Square. The cube is best tackled in another step. Draw the square and label one axis Poorer to Richer. Label the other axis Darker to Lighter. Darker, for brevity, includes African-Americans, Hispanics and so on. Lighter refers to those of European ancestry. The two opposed meta-groups are the poorer and darker versus the richer and lighter, or whiter if you wish to be blunt. The richer/whiter have the power of their wealth, but counterbalancing that advantage is the fact that the poorer/darker have succeeded in wresting control of much of government power. This is so, even if most of their elected leaders are anything but poor or dark.

Now, before you scream out your exceptions, yes, there are rich black cattle ranchers and poor whites living in blighted urban areas and so on. However, to focus on them is to miss the critical centers of gravity of Civil War Two for the over-study of interesting but insignificant outliers. Filling one corner of the CW2 Square will be the poorer and darker, who primarily are liberal and progressive Democrats who believe in a malleable “living Constitution.” And in the other corner will be the richer and whiter, who mainly are conservative or libertarian Republicans who believe in the original intent of the written Constitution. Again, keep your eyes on the two meta-cores, not the exceptions.

Now, let’s add the third dimension and shoot another axis out from the square to form the CW2 Cube. Label the third axis Urban versus Rural, or City versus Country if you prefer. This axis gives a geographical dimension to the meta-terrain, but there will be no convenient dividing line between the opposed sides as there was during the first civil war. It has frequently been observed that today’s red-blue political map is better understood at the county than at the state level. Even blue states like Illinois, California and New York are rural-red outside of their blue urban cores. Obviously, these urban cores are heavily populated but geographically small, with all that means to the electoral process today and to a possible civil war later.

So the opposing corners of the CW2 Cube can be seen as the poorer, darker cities versus the richer, whiter rural areas. Again, don’t quibble about outliers. Yes, there are a few rich, conservative African-Americans living in Wyoming, many poor white liberal Democrats in rural West Virginia, some rich conservatives in San Francisco and every other exceptional case imaginable.

Most of us live in the mushy, mongrel middle, far from the tips of the two opposite corners. But the centers of gravity of Civil War Two shall be as I have described: the relatively richer, whiter and more rural against the poorer, darker and urban. One can also propose many more axes of conflict than can fit on a cube, such as the religious versus the non-believers, socialists versus capitalists, statists versus individualists and so on. However, after you reflect upon the CW2 Cube, I think you will find that most of these extra axes can be overlaid parallel to one of the three already posited.

So, of what use is the CW2 Cube, other than in providing a conceptual map for Civil War Two? In my research as a novelist who attempts to write realistic fiction about the coming years, I have long been a student of modern civil wars. One repeated lesson of modern civil war is that there is inherently dangerous, even fatal terrain. Some of this predictably-dangerous terrain is often highly desirable and even advantageous before the outbreak of civil war.

To begin: you do not want to live as a trapped and cut-off minority in what might become “enemy territory.” If you live amidst your civil war enemies, as defined and located within the CW2 Cube, you will be in mortal danger even if your immediate neighbors know, love and respect you. Those persons who have a stake in fanning the flames of CW2 (and their number shall be legion), will intentionally target those remaining “holdouts” who may be respected minority neighbors. (In this essay, minority means “the minority within a given group or area.” Blacks are the majority in some areas, and whites are the minorities in others, and so on.)

Frequently in modern civil wars, roaming armed groups (in or out of uniform) will even force people to kill their own beloved and respected minority neighbors as an ultimate loyalty test. If they refuse, they may themselves be killed as “traitors.” Besides pre-conflict racists and radicals, there will be an ever-increasing pool of persons attempting to expel minorities from their homes. Those embittered unfortunates who have already been ethnically cleansed will be seeking new living quarters, and the homes and property of “enemy” minorities still living in majority territory will be the first on the chopping block. (Not the auction block, because payment of any kind is rarely offered.) This process of minority eviction becomes self-perpetuating.

Often, those members of minorities who escape as refugees are the lucky ones who do not lose their lives during the back-and-forth of escalating violence. The fact that they may have been loved, admired and respected for many years by their majority-population neighbors will not protect them. This is a clear lesson of modern civil war. Another is that while the rich or the well-to-do can sometimes hide their wealth and pass as proles, the same cannot be said about concealing one’s racial or ethnic identity. Religious affiliation and political leanings can also be hidden, but outward appearance cannot. Civil War Two may begin on purely political grounds, but it will devolve into something worse.

Does this mean that all white city-dwellers should head for the hinterland, or that dark-skinned folks living in the country should move to the city? It’s not for me to say. We all hope and pray that there will never be a second “hot civil war” in America, instead of merely the “cold civil war” we are engaged in today. But the lessons of modern civil wars should not be ignored. Another lesson is that it will take tremendous moral courage to defy the hot-heads and radicals, and shield your minority neighbors from harm. Think of Anne Frank. Think of those indescribably brave inhabitants of the former Yugoslavia who hid their minority neighbors, when the discovery of that fact could and often did lead to their own deaths.

While Civil War Two is on the table for discussion, allow me to introduce two aggravating factors that don’t fit neatly on the cube. The first is the concept of multiple embedded minorities. Picture the old cartoon mainstay showing a line of fish getting ready to gobble another fish, from the leviathan down to the small fry. You might live in a neighborhood where you are in the majority, but the neighborhood is in a town where you are in the minority. And the town is surrounded by a larger area where your own kind once again predominates.

Or you might fit into the picture as the smallest of all fish, living in the only minority household within a majority neighborhood. From street to neighborhood to city to state to region can easily place you in the middle of several levels of embedded minorities-within-majorities. This formulation might work for many decades during times of relative prosperity and well-being, but during a civil war it is a recipe for disaster, as unstable as nitroglycerin-filled bowling pins. It’s all cool just as long as the pins are standing still and calmly hanging out together, but look out when the Black Swan bowling ball comes rolling in! An unstoppable chain reaction ensues, as each new act of violence is avenged up and down the line.

Remember that funny line-of-fish cartoon, and imagine it a few seconds later when the biting begins. It’s not so funny then — especially for the smaller fish.

The second aggravating factor is the unstable triangle of the three-sided civil war. The Bosnian Serbs, Croats and Muslims provide a classic example. Each side of the unstable triangle will backstab yesterday’s ally at the moment they perceive themselves to be at a local disadvantage, or when they see an opportunity to wipe out an historic enemy with a new Final Solution. The unstable ethnic triangle in the United States will in many places be composed of black, white and Hispanic sides. By comparison, the old black and white social dichotomy was inherently stable, even when it might have been rife with injustice.

In some areas, Asians, Middle-easterners, Native Americans and other groups will contribute to the formation of regional social geometries that are even more unstable than the unstable triangle. Study modern civil wars and you will cringe at the implications. A steel roller-coaster overloaded with old dynamite and electric blasting caps during a lightning storm comes to my mind.

And finally, some urban settings are just disastrous during a modern civil war, even if they might offer a terrific quality of life during peacetime. Perhaps the top of the list of danger areas are high-rise buildings located near potential civil war flashpoints or fault lines. Living in a cluster of high-rises divided by a “green line” during a guerrilla sniper war is a worst-case horror show. Not to mention the misery attendant to life in a tall building without running water, electricity, sewage service, working elevators, heating or air-conditioning. While under intermittent sniper fire. For months.

So should you stay or should you go? If you don’t believe that another civil war in America is possible, then simply disregard this column. But if you think that a second civil war could happen then picture the CW2 Cube and map your location within it. If you think that you live near a possible civil war fault line, especially as a local minority, consider relocating.

After the fact, a common sentiment heard from urbane, secular Bosnians living in the Olympic City of Sarajevo expressed complete disbelief that a brutal, bloody civil war could have come to their modern European city and tear their lives apart.

But it did.

A parting suggestion to students of modern civil war is to read “Seasons in Hell: Understanding Bosnia’s War” by the British journalist Ed Vulliamy. It’s currently collecting dust at your local public library, waiting only to be read.

Mobile County District Attorney Ashley Rich says her office met with the U.S. Attorney, FBI and the police department about the Matthew Owens beating case.

They want the feds to decide whether a hate crime was committed.

Owens was beaten by a mob of 20 people Saturday night across the street from his sister's house on Delmar Drive. Despite witnesses telling News 5 that one of the attackers said "This is justice for Trayvon" after the beating, police say the shooting of the unarmed teenager in Samford, Florida was not the reason for this attack.

"I can tell you this without a doubt, 100% certainty, that Trayvon Martin was not the motivating factor in this incident," says Cpl. Chris Levy.

Deputy Chief Lester Hargrove says investigators believe only four people, including Terry Rawls, were directly involved. They believe the rest of the mob just watched.

Police say the beating is the result of a three year neighborhood dispute between Rawls and Owens.

I agree. The reference to the Bosnian Civil War was apt and current. Also I noted that he (perhaps only the graphics) have (1) and (2) mixed up on the cube. The rest of the numbers read fine.

Americans just have NO idea today about civil war. Despite being covered in 10 grade history classes from an example that SHOULD be right on everyone's A list of remembrance. The American Civil War was the first "modern" war - to the tune of tactics had not yet caught up with technology.

American Civil War was the war that obsoleted the Cavalry Sabre - and pretty much the mounted light Cavalry as well.

It's funny though. That 19th century generation of humans continued to hold their wartime experiences and titles in high esteem for LONG after their departure from military service. Both North and South. The "Kentucky Colonel" was a nom-de-plume taken directly from the Civil War. And this an affectation used by that generation until their deaths by natural causes after the turn of the 20th century. It was like they were pleased to have survived the war and proud of what they did - on both sides. Or does time and reflection on the past do that to humanity?

Do you suppose after the current "turning" has turned, humans today will hold a similar fond memory?

I don't trust these kid's parents or friends of the parents or any liberal bs investigation with regards to the victim's supposed past or how he was the real aggressor with these innocent children.

IMO blacks are liars and will stick with their race over the truth any time.

Mayor Sam Jones is urging the public not to jump to conclusions and to wait until the investigation is finished.

“Police will certainly explore a racial motive if the evidence supports it,” said Jones. “This type of mob violence will not be tolerated. If people think we are going to tolerate that to bring attention to some national event, they are sorely mistaken. They will be arrested and prosecuted for assault or whatever the appropriate charge may be," he said.

I haven't read beyond this post so I don't know if it has been mentioned yet....the mayor of Mobile is black. My brother and SIL think he's a a fair man and will do his best to to find the ones that were involved and bring them to justice.

That's true enough, but now we have no idea how provocative the man's actions had been in times past. had he threatened the kids before? Had he brandished a weapon at them before? Was he know in the neighborhood as an outspoken racist? The problem with the man's history is that now there is doubt as to whether or not the "mob" felt justification in what they did. Lord knows, we've talked often enough on the forum about how "Well, if I was the parent of the kid that had xxxx happen to them, I'd have beat the perp to within an inch of his life." And we always get a chorus of "HELL YEAH!" in replies.

So I can't say at this point whether or not this guy "got what was coming to him." Maybe he did. Maybe it was a race attack on the part of the blacks. But there's enough uncertainty now that I won't say EITHER side was "more right" than the other...

Because that's what the gov't and media tell us to think. I knew it wouldn't take long before the media dug up any and all dirt on Owens to put out there to discredit him. And they've done a good job. When will the media start looking into the criminal behavior of the perpetrators? Now it's getting blown out of proportion with wild accusations. Supposedly he chased the kids with 2 knives? Two? Really? Soon they will have him hurling hand grenades or pipe bombs and will claim he was often seen in a Klan outfit. We all know had this been the other way around, the "reverend$" would be calling for the burning of Moblie and the NBP would have placed a bounty on the entire neighborhood. This system of double standards needs to end. What's good for one side should apply to the other. If a group of white folk took to the streets of Mobile to demand more (and swifter) arrests, they would be taunted by militant blacks and portrayed by the media as white supremacist lunatics.
