    Looks like I may not be able to have the job after all.

    All,

    Got a call this afternoon. I have 4 moving violations in 3 years, and the atm co says that's one too many for business liability for me to be traveling for them. It's not an issue of just insurance for the rental car they were going to give me. They have asked to see if I can have one expunged. I have an attorney who will look at this tomorrow. This is hard.

    1 speed ticket because I was trying to get wife's car to shop before radiator lost all coolant.
    1 speed ticke 33 in 20 school zone, trying to get to my mother and didn't see the little 20 sign, 1 minute before that was over at 4pm
    1 other speed ticket I think
    1 small accident.

    Hopefully you can get this fixed to your satisfaction. I've tried to warn my kids and their friends that insurance is getting harder on businesses about who they hire because of liability limitations and costs. We have an umbrella policy and almost missed out on the best rate just because we have a 19 year old male residing in our home ... our own son who doesn't technically work for the business and is in fact employed by Chik-fil-a. A local bank required hubby to assign one of his life insurance policies to them in order to renew one of our business loans. Had a friend who almost lost his own license because of something his brother did on the job while working for him. It isn't like the old days where you could keep your private life and your business life separate. This economy only makes it worse.

    So sorry you are having to face this, especially after they'd told you something different.

    That being said, I cannot imagine what your car insurance bill must be like. You must have almost 12 points against your driver license, and most DMVs will pull your license for a year at 12. Every speeding ticket is normally 3 pts. There are diversion programs that one an enroll in that will normally remove one issue from your MVR. But dude, you need to be a lot more careful in your driving. I have a Cass A CDL. If I get ONE traffic ticket, many/most companies wouldnt hire me.

    Yeah and you ain't kidding. My brother is a trucker and he's been in one accident in the last 10 years and none before that and the accident wasn't even his fault but they still gave him the stinky eye on a couple of his contracts. Man it is rough out there.

    Go in to your insurance agent, and have him run your record. Find out what has the most points against you. In Kansas at least, the 3 points the first year is two points the second year and one point the third year; it takes 4 standard speeding tickets in a year to lose your license. (Family member with a leadfoot)

    Ask your agent as well, if there is anything else that can be done, or if he can recommend a lawyer who works to get violations expunged. Then see about getting the violation with the most remaining points removed, it will lower the score that insurance agencies use and your prospective employer is looking at.

    People should fight tickets rather than just paying them. What many do not realize is that a ticket is a 'criminal' conviction and you have the same rights in the situation as you would if you were arrested for any other crime.

    When the officer stops you it is his word and evidence against yours. Fight it. When you get to court, often the officer will not show up so the ticket is dismissed because you did not get your opportunity to face your accuser. If they do show up:

    1. Ask when was the last time his instruments were calibrated. Often, if this was not done on a timely basis, the evidence he may have recorded on them is thrown out.

    2. Take pictures of the area where the offense supposedly occurred and look for hindrances to speed signs or other things that may have interfered with your ability to comply. It is their responsibility to make sure signs are visible. If it isn't you cannot be held responsible.

    The last thing anyone should do is just pay a ticket because that is the same as pleading guilty in a court of law. Unless of course it is overwhelming that you were guilty and you don't want to waste your own time for the impossible.

    I would think that your attorney should get the 33 in a 20 overturned. You only need one, right?

    Excellent point. The City of San Francisco (IIRC) just discovered that the calibrating people were not calibrating. Consequently, tickets by the 100's have been thrown out.

    Unless of course it is overwhelming that you were guilty and you don't want to waste your own time for the impossible.

    Two tickets in over 60 yrs of driving and I was guilty as Hell both times. However, last one was caused by a town moving its city limits sign about 2 miles out into the country with a speed sign alongside. I came tooling along probably for the 100th time (had lived there 30 yrs) and never noticed, got nailed. So did a lot of other people. Sign got moved back after public uproar, but by that time I had paid my $5 fine. ( You can tell when that was!)

    Checked into that. It would drop points by 2, but not remove tickets. Per the contracting co, number of events was issue, not number of points.

    I got a ticket once and asked the officer on the spot for a calibration a tree beside the road. He pointed the gun at the tree and it registered 24 mph. Cop said it was his swing and not the tree. I went to court and explained the above and I was still cited. I was going 8 mph over the limit, big deal huh, they cited me for 20 mph over.


    This all happened in 1985 and I made sure I never received a ticket since that day.

    If you are like me, and incapable of driving within the posted speed limits, get a radar detector. They're a lot cheaper than tickets. My last ticketed violation was in 1998. They are not fool proof, but evens out the playing field. Hell, I do 30 mph in my driveway, which is the posted limit on my rural road.

    Actually, I think the Magistrate was afraid of being lynched. The natives were really hot.

    Radar detectors are illegal in some states. You want to keep a low silhouette with them.

    You might be able to do a safe driving course with AAA auto assoc., or online with a test to remove points and show 'remediation'. It would be a good bargaining chip in having one or more of your violations removed. Also would bring down your car insurance amount. Hope this helps...good luck!

    That's something I don't understand. The FCC has ruled that U.S. citizens have the right to receive any and all radio signals. Traffic Radar is a radio signal.

    I haven't had a ticket in a while.
    Every time I got one in the past I just got lawyer and had it reduced to a non-moving violation.
    Paid him + court cost = no points.

    Didn't see Neveser's post above until after I posted...but I see he is indeed in Missouri as well...

    One of the biggest businesses in the legal profession in Missouri is "fixing tickets".

    Here all the state wants is your money and they don't really care how they get it.

    For a few hundred bucks plus court costs, almost any moving violation can become "loud exhaust" or some other such non-moving violation.

    I'm sure the insurance companies hate it because it destroys their point system and thus their ability to crank your rates up for moving violations.

    Anyone else in a state where "fixing tickets" is the way it is done to avoid the moving violation and insurance points issues?

    Missouri was the first and only one I personally know about.

    Well, VA among other states says it's a higher class misdemeanor for a radar/laser detector, AND you forfeit the device. Their argument is that possession is prima facie evidence of intent to break the speed laws and they are considered tools for violating the law (or so it was explained a long time ago)...

    Kris, in NC my bro-outlaw will be happy to fix your ticket. ESPECIALLY if you are an undocumented worker...

    You can usually get a ticket changed to "defective vehicle" locally.

    It costs the same as a speeding ticket...but no points come off your lisc.

    You have to hire an attorney, but it pays in the long run.

    Another preemptive law. Arrest someone because the authorities think you intend to break a law. The same argument could be made to outlaw radios. Both fly in the face of Federal law. Now if they caught you speeding, and had a radar detector in use, I might could see the enhancement of charges. Maybe.
    Most speed limits are set too low, to accommodate the lowest common denominator, those people who shouldn't be out there driving in the first place. School zones are about the only place I think of, that they are appropriately set.
